In 1943, as part of the Manhattan Project, the Hanford Nuclear Reservation was established with the mission to produce plutonium for nuclear weapons. During 45 years of operations, the Hanford Site produced about 67 metric tonnes of plutoniumâ€"approximately two-thirds of the nation's stockpile. Production processes generated radioactive and other hazardous wastes and resulted in airborne, surface, subsurface, and groundwater contamination. Presently, 177 underground tanks contain collectively about 210 million liters (about 56 million gallons) of waste. The chemically complex and diverse waste is difficult to manage and dispose of safely. Section 3134 of the National Defense Authorization Act for Fiscal Year 2017 calls for a Federally Funded Research and Development Center (FFRDC) to conduct an analysis of approaches for treating the portion of low-activity waste (LAW) at the Hanford Nuclear Reservation intended for supplemental treatment. The first of four, this report reviews the analysis carried out by the FFRDC. It evaluates the technical quality and completeness of the methods used to conduct the risk, cost benefit, schedule, and regulatory compliance assessments and their implementations; waste conditioning and supplemental treatment approaches considered in the assessments; and other key information and data used in the assessments.

The Department of Energy (DOE) contracts with not-for-profit universities and private companies to operate its facilities. As part of the cost of operating these facilities, DOE can reimburse its contractors for the legal costs associated with cases brought against them. These cases involve such matters as equal employment opportunity, radiation and/or toxic exposure, personal injury, and wrongful discharge. In a letter dated May 26, 1998, you expressed concern that the federal government might be subsidizing contractors that violate the law. Specifically, you asked us to (1) determine what laws and regulations provide for DOE to reimburse its contractors for the litigation, settlement, and judgment costs in cases brought against them; and (2) provide information on such cases, particularly those involving equal employment opportunity, as to the number of cases and the costs that DOE reimbursed its contractors and that contractors paid themselves. On January 28, 2002, we briefed your staff on information related to the legal basis for DOE's reimbursement of contractor litigation costs and the number of, cost associated with, and disposition of contractor litigation cases. At that time, your staff requested that we transmit this information to you.

In fiscal year 2015, the federal government spent almost $19 billion on 22 DOE M&O contracts-a form of contract that traces its origins to the Manhattan Project. DOE uses M&O contracts to operate sites to carry out missions such as maintaining nuclear weapons and conducting energy and science research. Regulations require agencies to perform acquisition planning to ensure that the government meets its needs in the most effective, economical, and timely manner. GAO was asked to review DOE's use of M&O contracts. This report examines (1) why DOE uses M&O contracts and key attributes associated with them, (2) the extent to which M&O contractors carried out mission-support activities and used subcontracts in fiscal year 2015, and (3) the extent to which DOE considered alternatives during acquisition planning for M&O contracts. GAO reviewed acquisition planning documents and other information on the 22 M&O contracts in place at the end of fiscal year 2015 and DOE regulations and procedures. GAO also interviewed DOE headquarters and M&O site office officials, contractors, and other federal contracting officials.
