Copyright Vigilantes by Ezra Claverie Pdf

Copyright Vigilantes: Intellectual Property and the Hollywood Superhero explains superhero blockbusters as allegories of intellectual property relations. In movies based on characters owned by the comics duopoly of DC and Marvel, no narrative recurs more often than a villain’s attempt to copy the superhero's unique powers. In this volume, author Ezra Claverie explains this fixation as a symptom of the films’ mode of production. Since the 1930s, the dominant American comics publishers have treated the creations of artists and writers as work for hire, such that stories and characters become company property. Thus, publishers avoided sharing the profits both from magazine sales and from licensing characters into other media. For decades, creators have challenged this regime, demanding either shares of profits or outright ownership of their creations. Now that the duopoly rents, licenses, and adapts superheroes for increasingly expensive franchises, and for growing international audiences, any challenge to intellectual property relations threatens a production regime worth billions of dollars. Duopoly movies, therefore, present any attempt to break the superhero’s monopoly on their powers as the scheme of terrorists, mad scientists, or space Nazis—assuaging studio anxieties and revealing the fears of those who benefit most from the real-world ownership of superheroes. Weaving together legal analysis, Marxist political economy, and close readings of movies, Copyright Vigilantes explains the preoccupations of Hollywood’s leading genre.

The Internet and the Emerging Importance of New Forms of Intellectual Property by Susy Frankel,Daniel Gervais Pdf

The term ‘intellectual property’ has come to include numerous intangible rights beyond the traditional ‘Big Three’ (patent, trademark and copyright) – rights that force us to reconsider and maybe also change the object and purpose of intellectual property (IP). Not only do these rights generally have less solid normative footing and few if any well understood inherent limits, but the borders of their misappropriation are hard to draw. This groundbreaking book scrutinizes the existence of commonalities in this realm, and poses the question of what risks and advantages accrue to such IP or ‘IP-like’ rights. Sixteen distinguished contributors offer in-depth analyses of such rights as the following: - trade secrets; - image and publicity rights; - geographical indications; - traditional knowledge; - protection of databases; and - sports rights and ambush marketing. Recommendations and solutions investigated include the use of specialized courts or judges and of private standards. There are also thoughtful considerations of practices such as forum-shifting and an analysis of the special value of evolving Chinese law as a ‘norm laboratory’. Two chapters discuss the complexities of enforcement. Enforcement impacts substantive intellectual property and can be said to be its own ‘form’ of IP. Practitioners, judges, academics, and policymakers will all welcome this work and value it highly. Its contributors collectively take a giant step toward clarifying and synthesizing one of the most baffling areas of current law both internationally and at national level around the globe.

The Vigilante Thriller by Cary Edwards Pdf

This is a detailed examination of vigilantism in 1970s American film, from its humble niche beginnings as a response to relaxing censorship laws to its growth into a unique subgenre of its own. Cary Edwards explores the contextual factors leading to this new cycle of films ranging from Joe (1970) and The French Connection (1971) to Dirty Harry (1971) and Taxi Driver (1976), all of which have been challenged by contemporary critics for their gratuitous, copycat-inspiring violence. Yet close analysis of these films reveals a recurring focus on the emerging moral panic of the 1970s, a problematisation of Law and Order's role in contemporary society, and an increasing awareness of the impossibility of American myths of identity.

Vigilantes and Unauthorized Militia in America by Charles Doyle Pdf

A vigilante group is an armed private group that has taken the law into its own hands or that has the announced potential of doing so. There are quite a number of such organisations in the contemporary United States, and many have members who are said to be anti-government, racist or both. There is a strong history of vigilante activity in the United States that is unique in modern world history. In order to avoid civil disturbances, Congress and a number of state legislatures have passed laws governing the organisation, instruction and activities of private groups assembled to drill with, practice with, or demonstrate the used of firearms or explosives. This is a brief overview of those laws.

Wyatt Earp: A Vigilante Life by Andrew C. Isenberg Pdf

Finalist for the 2014 Weber-Clements Book Prize for the Best Non-fiction Book on Southwestern America In popular culture, Wyatt Earp is the hero of the Gunfight at the O.K. Corral in Tombstone, Arizona, and a beacon of rough cowboy justice in the tumultuous American West. The subject of dozens of films, he has been invoked in battles against organized crime (in the 1930s), communism (in the 1950s), and al-Qaeda (after 2001). Yet as the historian Andrew C. Isenberg reveals in Wyatt Earp: A Vigilante Life, the Hollywood Earp is largely a fiction—one created by none other than Earp himself. The lawman played on-screen by Henry Fonda and Burt Lancaster is stubbornly duty-bound; in actuality, Earp led a life of impulsive lawbreaking and shifting identities. When he wasn't wearing a badge, he was variously a thief, a brothel bouncer, a gambler, and a confidence man. As Isenberg writes, "He donned and shucked off roles readily, whipsawing between lawman and lawbreaker, and pursued his changing ambitions recklessly, with little thought to the cost to himself, and still less thought to the cost, even the deadly cost, to others." By 1900, Earp's misdeeds had caught up with him: his involvement as a referee in a fixed heavyweight prizefight brought him national notoriety as a scoundrel. Stung by the press, Earp set out to rebuild his reputation. He spent his last decades in Los Angeles, where he befriended Western silent film actors and directors. Having tried and failed over the course of his life to invent a better future for himself, in the end he invented a better past. Isenberg argues that even though Earp, who died in 1929, did not live to see it, Hollywood's embrace of him as a paragon of law and order was his greatest confidence game of all. A searching account of the man and his enduring legend, and a book about our national fascination with extrajudicial violence, Wyatt Earp: A Vigilante Life is a resounding biography of a singular American figure.
