The Death Penalty and U.S. Diplomacy by Wesley Kendall,Joseph M. Siracusa Pdf

This unique book examines how U.S. domestic policy regarding the death penalty has been influenced by international pressures, in particular, by foreign nations and international organizations. International pressure has mounted against America’s use of the death penalty, straining diplomatic ties. U.S. policies that endorse the execution of juveniles, the mentally handicapped, and disadvantaged foreign nationals have been recognized by allied nations and international organizations as human rights abuses and violation of international law. Further, organizations such as the United Nations and Amnesty International have issued scathing reports revealing racial bias and fundamental procedural flaws in almost every phase of the judicial process in capital cases. International pressures directed at governmental entities, in particular specific states such as Texas, can have a profound impact on governmental operational efficiency and public opinion and effectively render capital punishment cost-prohibitive from a public policy standpoint. The Death Penalty and U.S. Diplomacy analyzes the institutional response to specific forms of foreign intervention and influence such as consular intervention, international litigation, and extradition negotiation. This is documented through case studies such as how a judge in Texas v. Green turned to a comparative Delaware case that relied on the Vienna Convention to remove the death penalty as possible punishment, and how Mexico pressured the White House in two separate cases. By demonstrating that foreign actors have done much to constrain the United States to abandon its policies of executing foreigners, as well as its own citizens, the book explores the foreign dimensions of the U.S. death penalty while advancing the debate surrounding the viability of this controversial policy.

The Biblical Truth about America's Death Penalty by Dale S. Recinella Pdf

While secular support for capital punishment in America seems to be waning, religious conservatives, particularly in the "Bible belt," remain staunch advocates of the death penalty, citing biblical law and practice to defend government-sanctioned killing. Dale S. Recinella compares biblical teaching about the death penalty, including such passages as "eye for eye, tooth for tooth, life for life," with the nation's current system of capital punishment, and offers persuasive arguments for a faith-based moratorium on -- and eventual abolition of -- executions. Framing his careful and incisive analysis as a legal brief to those who believe the Bible mandates the ultimate punishment, the author addresses two critical areas of inquiry: what do the scriptures tell us about who is deserving of death and who has the authority to kill, and what do they tell us about the required standards for execution and the plight of victims' families. Recinella's examination of the Hebrew Torah, or Christian Pentateuch, and the Talmud reveals that the biblical death penalty was not a simple system of swift retribution, but a complex and practical set of laws that guided capital courts established under the Sanhedrin. His scrutiny of these texts, the Christian doctrine of atonement, and Romans 13 in the Pauline Epistles, draws parallels between the traditional biblical arguments used in favor of capital punishment and those used as the basis for pro-slavery positions in the nineteenth century. Demonstrating that both approaches are unsubstantiated in biblical terms, Recinella debunks the accepted religious reasoning for support of the death penalty and shows instead that the Bible's strict conditions for sanctioning execution are at odds with the arbitrary ways in which capital punishment is administered in the United States. He provides convincing evidence that a sentence of death in today's criminal justice system in fact fails to meet both the Bible's exacting procedural requirements and its strict limitations on judicial authority. By providing actual scriptural language and foundation to counter the position that biblical truth justifies a pro-death penalty stance, this thoughtful, solidly researched, and well-reasoned work will give pause to religious fundamentalists and challenge them to rethink their strongly held views on capital punishment.

Women and Capital Punishment in the United States by David V. Baker Pdf

The history of the execution of women in the United States has largely been ignored and scholars have given scant attention to gender issues in capital punishment. This historical analysis examines the social, political and economic contexts in which the justice system has put women to death, revealing a pattern of patriarchal domination and female subordination. The book includes a discussion of condemned women granted executive clemency and judicial commutations, an inquiry into women falsely convicted in potentially capital cases and a profile of the current female death row population.

Hidden Victims by Susan F. Sharp Pdf

"Sharp’s book reemphasizes the tremendous costs of maintaining the death penalty—costs to real people and real families that ripple throughout generations to come."—Saundra D. Westervelt, author of Shifting the Blame: How Victimization Became a Criminal Defense "Everyone concerned with the effects of capital punishment must have this book."—Margaret Vandiver, professor, department of criminology and criminal justice, University of Memphis Murderers, particularly those sentenced to death, are considered by most to be unusually heinous, often sub-human, and entirely different from the rest of us. In Hidden Victims, sociologist Susan F. Sharp challenges this culturally ingrained perspective by reminding us that those individuals facing a death sentence, in addition to being murderers, are brothers or sisters, mothers or fathers, daughters or sons, relatives or friends. Through a series of vivid and in-depth interviews with families of the accused, she demonstrates how the exceptionally severe way in which we view those on death row trickles down to those with whom they are closely connected. Sharp shows how family members and friends—in effect, the indirect victims of the initial crime—experience a profoundly complicated and socially isolating grief process. Departing from a humanist perspective from which most accounts of victims are told, Sharp makes her case from a sociological standpoint that draws out the parallel experiences and coping mechanisms of these individuals. Chapters focus on responses to sentencing, the particular structure of grieving faced by this population, execution, aftermath, wrongful conviction, family formation after conviction, and the complex situation of individuals related to both the killer and the victim. Powerful, poignant, and intelligently written, Hidden Victims challenges all of us—regardless of which side of the death penalty you are on—to understand the economic, social, and psychological repercussions that shape the lives of the often forgotten families of death row inmates.

The volume also provides an account of strategies employed by the abolition community which challenges tired methodologies and offers a level of transparency previously unseen. This collection tackles complex but fundamental components of the capital punishment debate using empirical data and expert observations and is essential reading for those wishing to comprehend the fundamental issues which underpin capital punishment discourse.

Deterrence and the Death Penalty by National Research Council,Division of Behavioral and Social Sciences and Education,Committee on Law and Justice,Committee on Deterrence and the Death Penalty Pdf

Many studies during the past few decades have sought to determine whether the death penalty has any deterrent effect on homicide rates. Researchers have reached widely varying, even contradictory, conclusions. Some studies have concluded that the threat of capital punishment deters murders, saving large numbers of lives; other studies have concluded that executions actually increase homicides; still others, that executions have no effect on murder rates. Commentary among researchers, advocates, and policymakers on the scientific validity of the findings has sometimes been acrimonious. Against this backdrop, the National Research Council report Deterrence and the Death Penalty assesses whether the available evidence provides a scientific basis for answering questions of if and how the death penalty affects homicide rates. This new report from the Committee on Law and Justice concludes that research to date on the effect of capital punishment on homicide rates is not useful in determining whether the death penalty increases, decreases, or has no effect on these rates. The key question is whether capital punishment is less or more effective as a deterrent than alternative punishments, such as a life sentence without the possibility of parole. Yet none of the research that has been done accounted for the possible effect of noncapital punishments on homicide rates. The report recommends new avenues of research that may provide broader insight into any deterrent effects from both capital and noncapital punishments.

The Death Penalty by Roger Hood,Carolyn Hoyle Pdf

This new edition of a classic study assesses the global status of capital punishment. As in previous editions, this work draws on Roger Hood's experiences as consultant to the United Nations for the Secretary General's five-yearly surveys of capital punishment as well as the latest literature from non-governmental organizations and academic experts. This edition examines significant developments around the world including the Chinese plan for the People's Supreme Court to review all death sentences, and the abolition in the USA of the death penalty for offenders who committed murder while under the age of 18. Recent legal challenges to lethal injection as a form of execution are also examined. This edition also includes an additional chapter on the role and influence of victims' families and victim interest movements. This volume shows how, despite a number of set-backs, the movement to abolish the death penalty has continued to gather pace; that international organizations and human rights treaties continue to put pressure on retentionist countries; that further developments have been made in securing protection for those facing the death penalty in retentionist counties; and that, despite such advances, in some parts of the world the range of crimes subject to the death penalty remains wide and the number of executions considerable. This work engages with the latest debates on the realities of capital punishment, with claims that the death penalty is a unique deterrent to murder and other serious crimes, and contains expanded coverage of arguments about the role of public opinion in the debate on capital punishment.
