Oceans Policy by Myron H. Nordquist,John Norton Moore Pdf

"Oceans Policy: New Institutions, Challenges and Opportunities" draws attention to three new international institutions created by the 1982 Convention on the Law of the Sea. The International Seabed Authority located in Jamaica governs global activities to convert polymetallic resources into reserves of metal. The Legal Counsel for the Authority provides the first public review of the Authority's draft Mining Code containing the rules, regulations, and procedures for deep seabed mining. The second institution dealt with is the International Tribunal for the Law of the Sea. Professor Louis Sohn outlines several innovative uses of advisory opinions available to the Tribunal while the President of the Tribunal reports on a busy first year of work by this new institution located in Hamburg. Other items discussed are the jurisdiction of the Tribunal and its working methods, including its rules, proceedings and internal procedures. The third international institution established to implement the 1980 Convention is the Commission on the Limits of the Continental Shelf beyond 200 nautical miles. An explanation is given of the geographical context for the development of the legal concept of the Continental Shelf. The principal problems that the Commission must resolve are summarized, in particular with respect to the definition in the Convention of the outer limit of the Continental Shelf. The fourth part of this work is focused on the global challenges posed by drug trafficking in the Caribbean region. The international legal framework governing intercepting illegal drug shipments at sea is analyzed. Recent counter-drug initiatives undertaken at the International Maritime Organization are thenreviewed. The book also contains discussion of the growing threat to ocean freedom posed by piracy and armed robbery at sea, as well as the increasing problems in reconciling the rules for salvage of shipwrecks and underwater archeology. The publication is based on a conference held in Jamaica that was organized by the Center for Oceans Law and Policy, University of Virginia School of Law.

The Regulation of Continental Shelf Development by University of Virginia. Center for Oceans Law and Policy. Conference Pdf

The lack of international conventional law governing the operational aspects of continental shelf activity may be characterized as unfinished business of the UN Convention on the Law of the Sea. The Convention, adopted in 1982, generally addressed the issue but did not consider more detailed development of the legal regime for the continental shelf. In The Regulation of Continental Shelf Development: Rethinking International Standards, leading experts from around the world identify and explore a multitude of unresolved legal concerns related to the continental shelf. The current state of continental shelf activities is explored through the following lenses: - Contemporary uses, including an overview on offshore wind energy in the EU, an analysis of the use of submarine cables under UNCLOS, and a discussion of the varied potential for mining marine materials; - Emerging challenges, such as ISA seabed mining standards, the recent ITLOS decision regarding the Bay of Bengal, and the role of the IMO in establishing safety standards for transboundary effects of oil pollution for offshore platforms; - Comparative best practices in environmental regulation; - Probabilistic risk assessment, with a thorough definition of PRA and a critical examination of continental shelf disasters; - Decommissioning offshore installations and structures, including an overview of the global regime as particularly provided in Articles 60(3) and 80 of UNCLOS; - Liability and compensation; and finally, - Unfinished business on UNCLOS III. The varied voices of experts collected within The Regulation of Continental Shelf Development: Rethinking International Standards offer a timely understanding of past, present, and future issues related to the continental shelf. The volume is a must-read for all those interested in environmental law and the law of the sea.

The Law of the Sea by Thomas A. Clingan Pdf

The most current text available on the international and U.S. law of the sea, this much-needed reference is built around the 1982 United Nations Convention on the Law of the Sea and other relevant maritime materials. While it addresses all aspects of ocean usage, much emphasis has been placed on issues of contemporary importance such as international fisheries, maritime boundaries, and deep seabed mining. The first Chapter introduces traditional zones of jurisdiction and doctrine such as inland waters, territorial seas, or high seas, as well as some new concepts related to navigation: the regimes of international straits and archipelagic waters and exclusive economic zones. The latter Chapter analyzes functional issues such as fishing, oil and gas exploitation, mining, scientific research, and maritime pollution, referring on each subject to the U.S. law for comparison.
