Although there is a vast body of literature covering the ongoing debates concerning the novelty and gravity of the contemporary terrorist threat, as well as the most appropriate response to it, few authors have thus far analysed the complex set of counterterrorism measures that both the individual Member States and the European Union (EU) have attempted to develop. This volume offers a critical analysis of the measures the European Union has taken to combat terrorism and how, in a number of key areas, EU counterterrorism policy is more of a paper tiger than an effective counterterrorism device. Several legal EU counterterrorism instruments have not been properly implemented at the national level and questions have been raised regarding their effectiveness, appropriateness, and proportionality. The capabilities of EU agencies in the area of counterterrorism remain rather weak and the EU Counterterrorism Coordinator does not have any real powers apart from persuasion. However, this does not mean that EU level action cannot offer any value-added in the fight against terrorism. There are several areas where the EU can provide genuine value-added in the fight against terrorism due to the transnational nature of the contemporary terrorist threat and the nature of a borderless Europe.

This book represents the first attempt to evaluate the first two decades of the EU counterterrorism policy. It aims to assess the collective securitization process in EU counterterrorism, evaluating this as a process between a construction of security threats and the development of supranational governance through crisification. Compared to the lack of shared perception of the terrorist threat and the virtual absence of counterterrorism cooperation amongst European states in the 1970s and 1980s, the existence of EU-wide debates, legislative instruments and practical cooperation nowadays is particularly remarkable. The chapters in this volume explore this change and seek to explain it by drawing upon the concept of ‘collective securitization’. The book posits that EU counterterrorism needs to be analysed as a process driven by collective securitization as part of an ongoing process of crisification that leads to increased supranational governance. The book is both extremely relevant and timely for readers outside the area of research for several reasons. First of all, EU counterterrorism is often argued to be at the forefront of the EU’s response to new security threats. The ‘EU acquis’ on the Area of Freedom, Security and Justice (AFSJ) has grown significantly over the last years. This paper examines the EU counterterrorism policy responses to the attacks in Paris, 7-9 January 2015. It provides an overview of the main EU-level initiatives that have been put forward in the weeks following the events and that will be discussed in the informal European Council meeting of 12 February 2015. The paper argues that a majority of these proposals predated the Paris shootings and had until that point proved contentious as regards their efficacy, legitimacy and lawfulness. A case in point is the EU Passenger Name Record (PNR) proposal. The paper finds that EU counterterrorism policy responses to the Paris events raise two fundamental challenges: A first challenge is to the freedom of movement, Schengen and Union citizenship. The priority given to the expansion in the use of large-scale surveillance and systematic monitoring of all travellers including EU citizens stands in contravention of Schengen and the free movement principle. A second challenge concerns EU democratic rule of law. Current pressures calling for an urgent adoption of measures like the EU PNR challenge the scrutiny roles held by the European Parliament and the Court of Justice of the European Union on counterterrorism measures in a post-Lisbon Treaty setting. The paper proposes that the EU adopts a new European Agenda on Security and Liberty based on an EU security (criminal justice-led) cooperation model firmly anchored in current EU legal principles and rule of law standards. This model would call for 'less is more' concerning the use, processing and retention of data by police and intelligence communities, and it would instead pursue better and more accurate use of data that would meet the quality standards of evidence in criminal judicial proceedings.

The attacks of September 11 prompted the Bush Administration to improve law enforcement and other co-ordination between the United States and European governments dealing with international terrorism. European governments have also taken measures to enhance co-operation among themselves. Most notable are European Union efforts to enhance cross-border sharing of intelligence and police information, extend the reach of warrants, and strengthen external border controls. Also, immediately following the attacks, there was an unprecedented European co-operation with the US in fighting terrorism. However, by early 2002 the emphasis placed by the Bush Administration on military action beyond Afghanistan, and on strong support for the Sharon government in Israel in its conflict with Palestine, began to raise doubts among some Europeans about the overall US approach to counter-terrorism. Discussed in this book are the efforts that the different European countries are making in response to the new threat of terrorism, as well as the concern that by supporting the Unites States' approach to terrorism, they will inevitably be helping the US pursue broader and more controversial foreign policy goals.
