A Barrister's Guide to Your Personal Injury Claim by Julian Benson Pdf

Every day, people get injured, often by accidents where no one is to blame. However, sometimes injuries happen because someone else - a person or an organisation - is at fault. These personal injuries can lead to compensation, particularly if the injury is life changing. Usually, people only experience one significant injury that leads to a personal injury claim in their lifetime. So, for most, dealing with a claim is unfamiliar and stressful, especially when they're already coping with the injury. This guide aims to explain the legal process and help injured individuals (and their loved ones) understand what to expect. Aimed at members of the public in England and Wales, this guide contains authoritative, impartial advice to enable individuals to understand and participate in their personal injury claim with confidence. The guide aims to: - Help you understand the legal process, what to expect, and your role. - Assist you in building a clear and reasonable claim, maximising the prospect that you will receive a reasonable compensation settlement. - Guide you in choosing the right representatives, assessing their service, identifying and addressing problems early, and replacing advisors if needed. It is written by a highly regarded specialist barrister with 30 years experience and is aimed at making the claims process less stressful whilst promoting fairer, quicker and more cost-effective settlements.

The Road to Recovery by Richard Auger,Brenda Hollingsworth Pdf

A personal injury claim shouldn't add to your pain. If you're dealing with the aftermath of a serious accident in Ontario, it's hard to know where to turn, and which route to go. Not only are you dealing with your physical and psychological trauma, but the stress and confusion of navigating a personal injury claim is only adding to your pain and suffering. The personal injury broker companies that have moved into the province, with questionable promises of instant gratification through fast settlement awards, are making things even more difficult to understand. The Road to Recovery is your guidebook through this maze, with behind-the-curtain insights into all aspects of personal injury law that matter most to you-the injured person, family and loved ones, caregivers, lawyers, and professionals from different areas of practice who are there to support you. Written as part of Auger Hollingsworth's mission to be "a different kind" of personal injury law firm, this empowering guide takes you through every step of the way in clear, simple language that's free of heavy legal jargon. We've also tried to make the reading somewhat enjoyable-something that can't always be said about the personal injury process! You can't change the accident, or what has happened since. But knowing what to expect and why certain things happen the way they do can help bring you clarity and, more importantly, confidence. We're only a phone call away. While you're thinking of calling, or if you've already started the process, we hope this book becomes your roadmap.

Blocking Public Participation by Byron Sheldrick Pdf

Strategic litigation against public participation (SLAPP) involves lawsuits brought by individuals, corporations, groups, or politicians to curtail political activism and expression. An increasingly large part of the political landscape in Canada, they are often launched against those protesting, boycotting, or participating in some form of political activism. A common feature of SLAPPs is that their intention is rarely to win the case or secure a remedy; rather, the suit is brought to create a chill on political expression. Blocking Public Participation examines the different types of litigation and causes of action that frequently form the basis of SLAPPs, and how these lawsuits transform political disputes into legal cases, thereby blocking political engagement. The resource imbalance between plaintiffs and defendants allows plaintiffs to tie up defendants in complex and costly legal processes. The book also examines the dangers SLAPPs pose to political expression and to the quality and integrity of our democratic political institutions. Finally, the book examines the need to regulate SLAPPs in Canada and assesses various regulatory proposals. In Canada, considerable attention has been paid to the “legalization of politics” and the impact on the Charter in diverting political activism into the judicial arena. SLAPPs, however, are an under-studied element of this process, and in their obstruction of political engagement through recourse to the courts they have profound implications for democratic practice.
