This book provides a new, linguistic approach to Argumentation Theory. Its main goal is to integrate the logical, dialectical and rhetorical dimensions of argumentation in a model providing a unitary treatment of its justificatory and persuasive powers. This model takes as its basis Speech Acts Theory in order to characterize argumentation as a second-order speech act complex. The result is a systematic and comprehensive theory of the interpretation, analysis and evaluation of arguments. This theory sheds light on the many faces of argumentative communication: verbal and non-verbal, monological and dialogical, literal and non-literal, ordinary and specialized. The book takes into consideration the major current comprehensive accounts of good argumentation (Perelman’s New Rhetoric, Pragma-dialectics, the ARG model, the Epistemic Approach) and shows that these accounts have fundamental weaknesses rooted in their instrumentalist conception of argumentation as an activity oriented to a goal external to itself. Furthermore, the author addresses some challenging meta-theoretical questions such as the justification problem for Argumentation Theory models and the relationship between reasoning and arguing.

This book is concerned with the conditions under which epistemic reasons provide justification for beliefs. The author draws on metaethical theories of reasons and normativity and then applies his theory to various contemporary debates in epistemology. In the first part of the book, the author outlines what he calls the dispositional architecture of epistemic reasons. The author offers and defends a dispositional account of how propositional and doxastic justification are related to one another. He then argues that the dispositional view has the resources to provide an acceptable account of the notion of the basing relation. The limited scope of participation in the making of EU law remains a continued source of controversy, featuring prominently in recent institutional and political developments that have been shaping the EU's constitutional framework - most intensely in the follow up of the Commission's White Paper on Governance. Yet little attention has been paid to participation rights as a means of ensuring the procedural protection of persons affected by EU regulation in its diverse forms. This is a dimension of the rule of law that has been largely ignored by EU legislative and judicial bodies. Not only the legislator, but also the Court of Justice and the Court of First Instance tend to adhere to excessively formal conceptions of participation rights that are premised on the right to be heard in individual procedures, as well as to a restrictive view regarding the relationships between the citizens and the administration. This book shows why, in the face of new regulatory developments, these conceptions are currently inadequate to ensure the legal protection of rights and interests affected by EU regulation.
