Jurisdiction and Procedure of the Federal Courts (Classic Reprint) by John C. Rose Pdf

Excerpt from Jurisdiction and Procedure of the Federal Courts The first edition of this book was published in 1915. It was intended to state and illustrate the fundamental principles governing the jurisdiction and procedure of the Federal Courts concisely and clearly, so that it would be of use both to those who had previously had little familiarity with Federal practice, and to those who, frequently engaged in the Courts of the United States, wanted readily at hand a precise and accurate statement of the basic rules, with references to the leading cases in which they had been laid down and applied. The present second edition is enlarged and brings the work down to date. The appendix contains the Judicial Code, with all amendments made to it up to the adjourn ment of Congress in September, 1922. The author is indebted to Mr. Robert France of Balti more for a verification of the references. Everything else in it has been personally prepared by him. Handbook on the Law of Judicial Precedents, Or the Science of Case Law (Classic Reprint) by Henry Campbell Black Pdf

Excerpt from Handbook on the Law of Judicial Precedents, or the Science of Case Law Nearly a quarter of a century ago, the late Mr. Justice Miller, of the Supreme Court of the United States, in a public address on the use and value of authorities in the argument and decision of cases, expressed his surprise that no book had yet been written, or none that he had seen, distinctively devoted to the subject on which he was speaking, adding, perhaps by way of explanation of the fact, that the sources of such a work are not ample and are difficult to come at. If a systematic and comprehensive treatise on the law of judicial precedents was a desideratum at that time, it is much more so to - day. For the reported decisions have enormously multiplied, and the lawyer's problem now is not merely to find the law, but to weigh and estimate the value of what he discovers. Now, more than ever, he needs a guide through the lawless science of the law, the count less myriad of precedents. Moreover the rules which gov ern the subject, - ii rules they can be called, which rest only in judicial discretion and have no stronger sanction than judicial habit, - are intricate and not free from confusion, and have long been in need of clear and discriminating ex position. Also it is true that the very theory of the prece dent has been vigorously assailed of late in high quarters, and there are evidences of an insistent demand for greater flexibility in the interpretation of the law and a closer cor respondence between the rulings of the courts and what is supposed to be the spirit of the age or the wants and wishes of the people. The Law and Procedure of United States Courts by John W. Dwyer Pdf

Excerpt from The Law and Procedure of United States Courts The purpose of this book is to give a brief and concise statement of the Organization, Jurisdiction, and Practice of the various courts of our national government. It is not intended to be a complete work in every detail; but rather an elementary work for students in law schools, students in law offices and for young lawyers who have not received systematic instruction on this subject. The object of the chapter on the history of the United States is to remind the student of the circumstances as they existed at the time our government was formed - to recall the principal events in our historical development - so that the constitutional provisions may be interpreted in their true light. In stating the jurisdiction of the courts, I inserted a number of decisions of the Supreme Court. This seemed the best thing to do as the decisions reviewed the various statutes touching the points under consideration; explained what provisions were repealed; the reasons for such repeals; and besides, they give us the law as it exists at the present time under the latest acts of Congress. In conclusion, I wish to state that a knowledge of this branch of the law is more necessary than ever before. The steady increase of litigation, arising from the rapid growth and reaching out of the business of the country, and the bringing of certain questions within Federal control, demands a thorough preparation on this subject. With this in view, I hope this little volume will enable beginners to learn more, work with greater advantage, and be better able to investigate the legal problems that may come to them in their practice. The Code of Procedure of the State of New York, as Amended to 1870 by John Townshend Pdf

Excerpt from The Code of Procedure of the State of New York, as Amended to 1870: With Notes on Pleading and Practice, Rules of the Courts, and a Full Index I am grateful for the opportunity to present to my professional brethren a Tenth Edition of my Notes to the Code of Procedure. By the teachings of a'long experience, industrious] y applied, 1 flatter myself I have exhausted every resource in producing a complete and useful work. My first edition of these Notes was published in 1851, and I have edited every subsequent edition. If not the first to conceive, I was at least the first to execute, the idea of an Annotated Code. The favor the work has found with the profession evidences that it met a general want. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. The Removal of Causes from State to Federal Courts by Robert Desty Pdf

Excerpt from The Removal of Causes From State to Federal Courts: With a Preliminary Chapter on Jurisdiction of the Circuit Courts of the United States The right of removal depends, first, on the subject-matter of the controversy, without regard to citizenship Of the parties; and secondly, on the diversity of citizenship of the parties. Under the first clause Of sec. 2 of the Act of 1875, as to the right of removal based on the subject-matter of the cause, all those on one side of the controversy must unite, and the cause be wholly removed; while under the second clause of the same section any one or more of either party could remove, if the entire controversy could be wholly determined between the parties litigant. The latest decisions of the Supreme Court, followed by those still later Of the circuit and district courts, seem to have at last settled these points.
