Honour based violence and abuse manifests itself in different forms, and this book offers a comprehensive understanding of this phenomenon. This book evaluates the effectiveness of current international human rights law, and in particular the recent Istanbul Convention, in eradicating so-called honour killings in Turkey. So-called ‘honour killings’ have become an issue of concern for the international community. In Turkey, in particular, the practice still exists despite the adoption of the relevant human rights instruments. The book argues that the improvement of the status of women in Turkey in accordance with gender equality as well as the application of the principle of state due diligence, both requirements of the Istanbul Convention and international human rights law, are fundamental means towards eradicating the killing of women in the name of ‘honour’. Using feminist approaches, in particular the intersectionality approach, the study looks at the application of such standards as well as the current obstacles. Through such a lens, the study discusses the strengths and weaknesses of the Turkish Constitution, Turkish Civil Code, Turkish Penal Code and Law to Protect Family and Prevent Violence Against Women and questions the judicial approach to the implementation of the women’s right to life. It identifies the lacunae in the Turkish legislation that allow inadequate legal protection for women and the inconsistency of the judicial approach to the definition of the so-called honour killings in the judgements. The study then recommends some concrete amendments to the relevant legal provisions in order to better reflect the international framework and the feminist approaches. The book will be a valuable resource for academics, researchers and policy-makers in the areas of international human rights law and feminist legal theory.

Punitive responses towards this type of violence have been adopted, including ad hoc criminalisation and legislation containing direct references to the concepts of honour, culture, and tradition. However, criminal law-based responses present several shortcomings and have often disregarded the specific needs that victims of such crimes might encounter. This book examines the possibility of using alternative programmes to address cases of honour-based violence and forced marriages. After reviewing previous existing literature, it presents new empirical data. Introducing a case study from the United Kingdom, the book recalls the debate on Sharia Councils and the Muslim Arbitration Tribunal, but examines instead other community-based secular programmes. By comparison, a study from Norway on the work of the National Mediation Agency and the so-called Cross-Cultural Transformative Mediation model is investigated as part of a larger multi-agency approach. Ultimately, in an attempt to reconcile pluralism and the rule of law, the book proposes effective ways to tackle honour crimes based on cooperation and individualisation of the proceedings, and capable of improving women’s access to justice and reducing secondary victimisation. The media in western countries tends to magnify differences especially from and to the Islamic world (Nelken 2010). Honour crimes and killings do not only occur in Eastern and Arab countries such as Pakistan Turkey or Iran etc., through globalisation and the increase of migration, honour killings have become an increasing problem in western countries as well (Schirrmacher, 2009). Continuing improvements of various means of transport and mobility has acquired a new dimension in the world of modernity (Garland, 2001). Globalisation is as Held (1999) writes, the widening deepening and speeding up of worldwide interconnections in all aspects of contemporary life. Honour killings are closely linked to globalisation and migration issues. The most striking similarity between England and Germany is the total number of committed honour killings in the past few years. One can also find high resemblances in the convictions and sentences of perpetrator of honour killings. Despite these similarities the focus is to examine the cultural, social political and historical context of these high profile crimes in both countries. The United Nation has published a response to crimes in the name of honour against women. In their last resolution from 2004 the UN expressed deep concerns that women and girls continue to be victims of honour based crimes. They remind states to exercise, to prevent, investigate and punish the perpetrators of such crimes committed against women and girls (UN, 2004). This comparative case study will focus on the state responses, which are required by the UN. Therefore the examination will lay out the differences and similarities of state responses through legislations and police task forces and other law enforcements, how honour killings are recognised by the state in these two European countries. This examination will explore these responses within the cultural political social and historical context. In this project the focus is on honour killings, the extremist form of honour based violence and will undertake a comparison on how these two European countries respond to this violation of human rights in a broader context.
