Regulation-Making in the United Kingdom and Australia by Andrew Edgar Pdf

This book shines a spotlight on the way in which parliamentary scrutiny of regulations provides the primary support for democratic legitimacy for regulations in the UK and Australia. This democratic safeguard is supplemented by public consultation processes. Despite commonly expressed concerns that regulation-making is secretive and undemocratic, it can be recognised to be a democratically sound and important feature of modern law. There are, however, modern practices that remove or limit these safeguards on regulation-making, raising concerns about executive aggrandisement. This book has two aims. The first is to explain the systems of parliamentary scrutiny in the UK and Australia and their historical development. The development of parliamentary checks on regulation-making through the 20th century established the primary basis for the democratic legitimacy of regulations. The second aim is to examine recent developments in regulation-making that avoid or minimise this safeguard. Constitutional changes in the UK, transnational regulation, and emergencies such as the COVID-19 pandemic have affected regulation-making in a manner that avoids or minimises the parliamentary checks that were carefully developed and implemented in the 20th century. The book contributes to public law in the UK and Australia by analysing recent developments that involve executive over-reach, with reference to the historical development of parliamentary checks on regulation-making.

Reimagining Parliament by David Judge,Cristina Leston-Bandeira Pdf

With trust in Parliament and politicians at a seriously low level, there is an increasing need to rebuild our public institutions. This innovative book questions what Parliament should be in the 21st century and how it can be reimagined. It shows how a new democratic parliamentary space can be created to better represent and engage with citizens; to furnish a safe, inclusive and fair working environment for all staff and members; and to secure greater responsiveness and accountability of government. Bringing together a vibrant group of parliamentary scholars and practitioners, it proposes an institutional world of possibilities beyond the present Westminster village, to help restore faith in democracy. .

The Law-Making Process by Michael Zander Pdf

As a critical, in-depth analysis of the law-making process, this book has no equal. It deals with all the stages and forms of law-making: - the preparation of legislation; - its passage through Parliament; - statutory interpretation; - the operation of the rules of precedent in judicial decision-making; - the many facets of judicial law-making; - the machinery of law reform. The new eighth edition covers the operation of EU law in the UK after Brexit. It also covers pre-Brexit events such as the unprecedented legislation by backbench MPs to stop a No Deal Exit from the EU and the two great Supreme Court decisions over the triggering of Brexit and the prorogation of Parliament. The books draws on a wide range of sources including important new empirical research such as Lord Sumption's 2019 Reith lectures (Trials of the State – Law and the Decline of Politics) and the work of Sir Geoffrey Palmer, former Prime Minister and Justice Minister of New Zealand on The Law Reform Enterprise. There are new sections on the attempt to control the size of the House of Lords, on whether Parliament should have a role in the selection of senior judges and on the topical question whether decisions of the courts on constitutional questions are 'legal' or 'political'.

HC 1130 - Legacy Report by Great Britain. Parliament. House of Commons. Scottish Affairs Committee Pdf

In this report the Committee has set out key elements of its work over the 2010-15 Parliament. The Committee believes that it is crucial that select committees follow up their work and do not simply see the publication of a report as the end of the process of scrutiny. Scrutiny should not end with the Dissolution of Parliament. The Scottish Government was clear that the 2014 referendum on independence would be a once generation event, but that does not mean that the relationship between Scotland and the rest of the United Kingdom will remain unchanged. The recommendations of the Smith Agreement will be implemented during the course of the next Parliament. The major package of legislation, and the revised fiscal framework that will accompany it, will require careful and detailed scrutiny, as will any proposals to go further that the Smith Commission envisaged.

Public Law by John Stanton,John (Senior Lecturer in Law Stanton, The City Law School City University of London),Craig (Senior Lecturer in Law and Director of the Centre for Parliament and Public Law Prescott, University of Winchester) Pdf

Fresh, modern, and practical, Public Law provides law undergraduates with a unique approach to constitutional and administrative law, aptly demonstrating why this is an exciting time to be studying the subject.Writing in a fluid, succinct style, the authors carve a logical pathway through the key areas studied on the LLB, guiding students to a solid understanding of the fundamental principles. This theoretical grounding is then rooted in reality, with each concept applied to a hypothetical scenario(included at the start of each chapter) to set it into a practical context. While this practical element helps students to understand how the law applies and develop problem-solving skills, a trio of supportive learning features also encourages active engagement with and a critical appreciation of public law. 'Key case' boxes highlight and analyse the significant case lawin each area; "Counterpoint" boxes flag alternative viewpoints and areas of debate; and "Pause for reflection" boxes prompt readers to consider the impact of laws, and what potential developments and reforms may lie ahead.Public Law's modern approach and unique combination of practical application and theoretically critical discussion makes it the ideal choice for students seeking to understand concepts not only in the abstract but in practice, helping them to develop the skills they need to succeed at university andbeyond.Online ResourcesThis title is supported by an online resources platform for students featuring guidance on approaching and analysing the real life scenarios in the book, a bank of multiple choice questions, legal updates, and links to useful material elsewhere on the web.
