African Legal Theory and Contemporary Problems by Oche Onazi Pdf

The book is a collection of essays, which aim to situate African legal theory in the context of the myriad of contemporary global challenges; from the prevalence of war to the misery of poverty and disease to the crises of the environment. Apart from being problems that have an indelible African mark on them, a common theme that runs throughout the essays in this book is that African legal theory has been excluded, under-explored or under-theorised in the search for solutions to such contemporary problems. The essays make a modest attempt to reverse this trend. The contributors investigate and introduce readers to the key issues, questions, concepts, impulses and problems that underpin the idea of African legal theory. They outline the potential offered by African legal theory and open up its key concepts and impulses for critical scrutiny. This is done in order to develop a better understanding of the extent to which African legal theory can contribute to discourses seeking to address some of the challenges that confront African and non-African societies alike.

Access to Information in Africa by Fatima Diallo,Richard Calland Pdf

For a long time, Africa has 'lagged' behind global advances in transparency, but there are now significant developments on the continent. In a ground-breaking book, Access to Information in Africa brings together for the first time a collection of African academics and practitioners to contribute to the fast-growing body of scholarship that is now accumulating internationally. This is therefore an African account of progress made and setbacks suffered, but also an account of challenges and obstacles that confront both policy-makers and practitioners. These challenges must be overcome if greater public access to information is to make a distinctive, positive contribution to the continent’s democratic and socio-economic future. This book offers a necessarily multi-dimensional perspective on the state of ATI in African jurisdictions and the emerging, new praxis - a praxis that will entail a genuine domestication of the right of access to information on the continent.

Women's Social and Legal Issues in African Current Affairs by Victoria M. Time Pdf

This volume explores the difficulties that beset African women and inhibit them from excelling in many walks of life in the twenty-first century. Asymmetrical relations in society position women in subjugated and marginalized roles. This is caused by customary practices that have left women in vulnerable and subsidiary positions, as well as statutory provisions that fester this process. Despite its richness in raw materials and minerals, Africa remains slow to grow when compared to other continents. The economies of most African countries is severely anemic: corruption is rife, poor governance is systemic, and wars, conflicts, famine and diseases abound. Stalled economies disproportionately affects women; for example, as nurturers, women have the extra responsibility of taking care of children and members of the extended family. In times of want, women are more likely to give up the little they have so that their children and others may survive. This book shows the various social and legal obstacles that stall women’s upward mobility and offers recommendations on how these issues can be resolved.

Legitimate Governance in Africa by Edward Kofi Quashigah,Obiora Chinedu Okafor Pdf

Any attempt to address the ever-present problem of instability in Africa gives rise to questions regarding legitimate governance. Without future thinking and action on the legitimacy of governance in Africa and how to secure it, past mistakes will go unheeded rather than informing forward movement. Surprisingly, no existing work has comprehensively addressed this critical issue. Legitimate Governance in Africa provides this needed coverage for the first time, examining such key components in the struggle for legitimate governance as the role of the international community in addressing the problem, the particular role women can play and ways in which women can improve their involvement in the whole enterprise of governance, and the roles of non-governmental organizations and civil society. In this diverse collection of essays, a wide range of expert legal contributors, all familiar with the status of the struggle for legitimate governance in a specific institution or particular African state, brings unique perspectives to the scholarly investigation of legitimate governance in Africa. The individual authors have thought deeply about the complexities and subtleties of conducting and evaluating the business of African state governance, considering both the practical sustainability of potential approaches and theoretical problems and issues. The probing, high-quality essays facilitate a real understanding of the obstacles to progress in the struggle for legitimate governance. Through their depth and diversity of views, every one of the papers included in this collection enriches the pool of knowledge on this important subject.

Peace Maintenance in Africa by Giovanni Cellamare,Ivan Ingravallo Pdf

This book discusses the many legal aspects arising in relation to the maintenance of peace in Africa. Over the past twenty years, the majority of peace operations have been deployed on this continent, most of them established by the UN Security Council, sometimes in cooperation with the African Union and other African regional organizations, with contributions from the European Union and NATO. In some cases, the African Union has invoked its ‘primary responsibility for promoting peace, security and stability in Africa’, thus questioning the legal partnership between UN and regional organizations provided for in Chapter VIII of the UN Charter. The peace operations deployed in Africa have sometimes received a very robust mandate, which also includes the use of force and the protection of civilians’ human rights. The implementation of this broad mandate, which goes well beyond the traditional ‘peacekeeping approach’, requires considerable human and economic resources. Moreover, it raises several issues of concern with regard to the impact on the economic and political systems of the states in which the operations are deployed and, more generally, on the exercise of sovereignty over their territorial communities by these states. Offering an update for lawyers in practice and in academia interested in the field of international law, the book also contributes to the theoretical studies concerning the activities of international organizations, focusing on one of the most challenging issues to emerge in recent times.

The Emergent African Union Law by Olufemi Amao,Michèle Olivier,Konstantinos D. Magliveras Pdf

This book is a groundbreaking study of the emergence of a unique African Union legal system, with contributions from a diverse collection of scholars and practitioners. It highlights how law stands at the heart of the successful regional integration effort in Africa and explores, among either issues, the extent to which African Union law is having an impact on domestic laws. This trend has been particularly noticeable in the area of human rights, the rule of law, democratic principles, and aspects of constitutional law. Furthermore, the book examines how the African Union is engendering new norms from its legal order, such as the non-indifference norm, the norm on unconstitutional change of government, free trade, free movement of people, economic regulation, and democratic constitutionalism. The book also analyses how the African Union legal order has led to the emergence of a continental-level judicial system. The quasi-judicial system put in place under the African Charter on Human and Peoples' Rights, and administered by the African Commission on Human and Peoples' Rights, is now complemented by the African Court on Human and Peoples' Rights. This book contends that the continental-level judicial system is playing a crucial role in the moulding of emergent norms.

Model Law on Access to Information for Africa and other regional instruments: Soft law and human rights in Africa Edited by Ololade Shyllon 2018 ISBN: 978-1-920538-87-3 Pages: 255 Print version: Available Electronic version: Free PDF available About the publication The adoption in 2013 of the Model Law on Access to Information for Africa by the African Commission on Human and Peoples’ Rights is an important landmark in the increasing elaboration of human rights-related soft law standards in Africa. Although non-binding, the Model Law significantly influenced the access to information landscape on the continent. Since the adoption of the Model Law, the Commission adopted several General Comments. The AU similarly adopted Model Laws such as the African Union Model Law on Internally Displaced Persons in Addressing Internal Displacement in Africa. This collection of essays inquires into the role and impact of soft law standards within the African human rights system and the AU generally. It assesses the extent to which these standards induced compliance, and identifies factors that contribute to generating such compliance. This book is a collection of papers presented at a conference organised by the Centre for Human Rights, University of Pretoria, with the financial support of the government of Norway, through the Royal Norwegian Embassy in Pretoria. Following the conference, the papers were reviewed and reworked.
