Limitations by Scott Turow Pdf

From the #1 New York Times bestselling author of Presumed Innocent comes a compelling new legal mystery featuring George Mason from Personal Injuries. Originally commissioned and published by The New York Times Magazine, this edition contains additional material. Life would seem to have gone well for George Mason. His days as a criminal defense lawyer are long behind him. At fifty-nine, he has sat as a judge on the Court of Appeals in Kindle County for nearly a decade. Yet, when a disturbing rape case is brought before him, the judge begins to question the very nature of the law and his role within it. What is troubling George Mason so deeply? Is it his wife's recent diagnosis? Or the strange and threatening e-mails he has started to receive? And what is it about this horrific case of sexual assault, now on trial in his courtroom, that has led him to question his fitness to judge? In Limitations, Scott Turow, the master of the legal thriller, returns to Kindle County with a page-turning entertainment that asks the biggest questions of all. Ingeniously, and with great economy of style, Turow probes the limitations not only of the law but of human understanding itself.

Copyright Limitations and Contracts:An Analysis of the Contractual Overridability of Limitations on Copyright by Lucie Guibault Pdf

This book explores this conflict, focusing on statutory copyright limitations that enshrine constitutional rights such as freedom of expression and privacy, foster dissemination of knowledge, safeguard competition, and protect authors from market failure. It explains the rationale for these limitations and questions the legality of overriding them by contractual means. The author finds a complex array of factors clouding the emergence of coherent rules in the matter and points out that the United States' Uniform Computer Information Transactions Act (UCITA) leaves this issue essentially unresolved. Among the author's insights is that, contrary to the commonly held notion that the Internet is a bastion of free speech, in fact it is now possible (via encryption technology) to exercise absolute control over copyrighted material, even under circumstances of global mass distribution.

Law of Limitation by Gino Evan Dal Pont Pdf

"[This book focuses] on the structure and application of limitations legislation. Australian limitation laws differ from jurisdiction to jurisdiction, and recent attempts to implement uniform legislation across all jurisdictions have not been achieved. Additionally, different limitation periods apply across a range of areas of legal practice, and so having a definitive resource on limitations is of critical importance for legal practitioners."--

Nudging - Possibilities, Limitations and Applications in European Law and Economics by Klaus Mathis,Avishalom Tor Pdf

This anthology provides an in-depth analysis and discusses the issues surrounding nudging and its use in legislation, regulation, and policy making more generally. The 17 essays in this anthology provide startling insights into the multifaceted debate surrounding the use of nudges in European Law and Economics. Nudging is a tool aimed at altering people’s behaviour in a predictable way without forbidding any option or significantly changing economic incentives. It can be used to help people make better decisions to influence human behaviour without forcing them because they can opt out. Its use has sparked lively debates in academia as well as in the public sphere. This book explores who decides which behaviour is desired. It looks at whether or not the state has sufficient information for debiasing, and if there are clear-cut boundaries between paternalism, manipulation and indoctrination. The first part of this anthology discusses the foundations of nudging theory and the problems associated, as well as outlining possible solutions to the problems raised. The second part is devoted to the wide scope of applications of nudges from contract law, tax law and health claim regulations, among others. This volume is a result of the flourishing annual Law and Economics Conference held at the law faculty of the University of Lucerne. The conferences have been instrumental in establishing a strong and ever-growing Law and Economics movement in Europe, providing unique insights in the challenges faced by Law and Economics when applied in European legal traditions.

The Principle of Purpose Limitation in Data Protection Laws by Maximilian von Grafenstein Pdf

This thesis examines the principle of purpose limitation in data protection law from the perspective of regulating data-driven innovation. According to this approach, the principle of purpose limitation not only protects an individual's autonomy but simultaneously leaves sufficient room for data controllers to innovate when finding the best solution for protection. The first component of the principle of purpose limitation (i.e. to specify the purpose of data processing) is a precautionary protection instrument which obliges the controller to identify specific risks arising from its processing against all fundamental rights of the data subject. In contrast, the second component (i.e. the requirement to limit data processing to the preceding purpose) aims to control the risk caused by data processing that occurred at a later stage and adds to the risks which were previously identified. This approach provides an answer to the question of how the General Data Protection Regulation which does not only effectively protect an individual's autonomy but also helps controllers to turn their legal compliance into a mechanism that enhances innovation, should be interpreted with regard to all the fundamental rights of the data subject.

The Universal Declaration of Human Rights in the 21st Century by Gordon Brown Pdf

The Global Citizenship Commission was convened, under the leadership of former British Prime Minister Gordon Brown and the auspices of NYU’s Global Institute for Advanced Study, to re-examine the spirit and stirring words of The Universal Declaration of Human Rights. The result – this volume – offers a 21st-century commentary on the original document, furthering the work of human rights and illuminating the ideal of global citizenship. What does it mean for each of us to be members of a global community? Since 1948, the Declaration has stood as a beacon and a standard for a better world. Yet the work of making its ideals real is far from over. Hideous and systemic human rights abuses continue to be perpetrated at an alarming rate around the world. Too many people, particularly those in power, are hostile to human rights or indifferent to their claims. Meanwhile, our global interdependence deepens. Bringing together world leaders and thinkers in the fields of politics, ethics, and philosophy, the Commission set out to develop a common understanding of the meaning of global citizenship – one that arises from basic human rights and empowers every individual in the world. This landmark report affirms the Universal Declaration of Human Rights and seeks to renew the 1948 enterprise, and the very ideal of the human family, for our day and generation.
