The Catholic Church on Marital Intercourse by Robert Obach Pdf

The Catholic Church on Marital Intercourse traces the development of the Church's theology of marital sexuality from New Testament times to the present day. The early ecclesial leaders promoted a theology of sexuality based on Stoicism's biological perception that sexual activity was solely for the purpose of reproduction. Only in the early twentieth century did a few theologians begin to move beyond discussing 'the purposes of marital intercourse' to discussing the meaning that the marital act might have for the spouses themselves. With the Second Vatican Council (1962-1965), a new and positive view of marital sexuality emerged recognizing the Pauline view that the couple's marital acts express their love for each other along the lines of Christ's love for his church (Ephesians 5). In sum, The Catholic Church on Marital Intercourse treats the way in which the Catholic Church has moved away from an attitude of conditional acceptance of marital intercourse on the basis of its utility to recognition that the dynamics of sexual union are both good and holy, not only because that is the way children are conceived, but also because the marital act enhances the love of husband and wife for each other.

Marriage and Life after Death by Anthony Onyekwe Pdf

In Africa, the emphasis on family, marriage, and offspring suggest that there is a kind of an unwritten ancestral law that imposes on every male the duty of begetting a son. The reason is because the core of African ‘soteriology’ is centered on offspring. The predicament of the childless couples, therefore, stems from the desire for immortality and salvation that culminates in the admission of the dead into the ancestral world. This quest for salvation and immortality constitute social, emotional, psychological, and spiritual problems for Christian as well as non-Christian childless couples.

Marital Agreements and Private Autonomy in Comparative Perspective by Jens M Scherpe Pdf

This book deals with a subject that has recently been the focus of debate and law reform in many jurisdictions: how much scope should spouses have to conclude agreements concerning their financial affairs - and under what circumstances should such agreements be binding and enforceable? These marital agreements include pre-nuptial, post-nuptial and separation agreements. The book is the result of a British Academy-funded research project which investigated and compared the relevant law of England and Wales, Australia, Austria, Belgium, France, Germany, Ireland, the Netherlands, New Zealand, Scotland, Singapore, Spain, Sweden and the jurisdictions of the United States. In addition to chapters on these jurisdictions, the book includes a chapter on the 'English practitioner's view'. It also provides a comparative analysis of the different matrimonial property regimes and the rules on marital agreements that explores underlying themes and principlesand makes recommendations for regulating marital agreements. A key theme is the function and effect of marital agreements in the different jurisdictions. Thus, each chapter first explains the underlying 'default' rules for ancillary relief/matrimonial property and maintenance. It then analyses the current rules for marital agreements, and gives a brief account of the private international law rules. The book provides a comprehensive source of reference on ancillary relief/matrimonial property and maintenance and the rules on pre-nuptial, post-nuptial and separation agreements in 14 jurisdictions. It offers guidance for academics and practitioners dealing with international matters, and a basis for discussions on law reform. 'I applaud the vision and perseverance of Jens Scherpe in having conceived this book and, with so much distinguished help, in now bringing it to birth. I will be using it for many years and I warmly invite my fellow family lawyers across the world to do likewise.' Foreword by The Rt Hon Lord Wilson of Culworth, Justice of the Supreme Court of the United Kingdom

On Same-Sex Marriage, Civil Unions, and the Rule of Law by Mark Strasser Pdf

The United States Constitution has already been interpreted to provide a variety of family-related protections which, if applied consistently, also protect same-sex couples and their children. Only by radically reformulating and severely undermining existing protections can courts and commentators justify the claim that the Federal Constitution does not offer a wealth of family protections, including the right to marry a same-sex partner. Discussing the constitutional implications of civil unions with a special focus on how they might be treated in the interstate context, Strasser explains how the courts and commentators have reworked and significantly weakened a variety of constitutional protections in their attempts to establish that same-sex couples are not afforded constitutional protections. He further suggests that the constitutional protections for religion support rather than undermine the constitutional protection of same-sex unions.

International Marriages and Marital Citizenship by Asuncion Fresnoza-Flot,Gwénola Ricordeau Pdf

While marriage has lost its popularity in many developed countries and is no longer an obligatory path to family formation, it has gained momentum among binational couples as states reinforce their control over human migration. Focusing on the case of Southeast Asian women who have been epitomized on the global marriage market as ‘ideal’ brides and wives, this volume examines these women’s experiences of international marriage, migration, and states' governmentality. Drawing from ethnographic research and policy analyses, this book sheds light on the way many countries in Southeast Asia and beyond have redefined marriage and national belonging through their regime of ‘marital citizenship’ (that is, a legal status granted by a state to a migrant by virtue of his/her marriage to one of its citizens). These regimes influence the familial and social incorporation of Southeast Asian migrant women, notably their access to socio-political and civic rights in their receiving countries. The case studies analysed in this volume highlight these women’s subjectivity and agency as they embrace, resist, and navigate the intricate legal and socio-cultural frameworks of citizenship. As such, it will appeal to sociologists, geographers, socio-legal scholars, and anthropologists with interests in migration, family formation, intimate relations, and gender.
