Excerpt: ... excluded.1 Thus, in proving a charge of perjury or false swearing, committed at a military trial, the record of the trial is clearly the best evidence of the testimony given by the accused, and parol evidence of the same, unless introduced by consent, will be inadmissible.2 The rule excluding the oral testimony in such cases is adopted not only because the writing must necessarily afford the most satisfactory evidence of the facts which it sets forth, but also, as Greenleaf observes, "for the prevention of fraud;" since, as he adds, "whenever it is apparent that better evidence is withheld, it is fair to presume that the party has some sinister motive for not producing it, and that, if offered, his design will be frustrated. The rule thus becomes essential to the pure administration of justice."3 But it may happen that oral testimony may be the original and best evidence as to a fact or facts when a statement of the same exists in writing. Thus where certain facts within the knowledge of the writer, and material to the issue in a case on trial, have been recited in an official endorsement, certificate, communication, or other writing, the primary and best evidence of such facts will be not the writing but the personal declaration of the same, under oath and subject to cross-examination, by the writer, and if he can be obtained as a witness, the written statement should not be received.4 Exceptions.
