My Life in Court by Louis Nizer Pdf

In this electrifying bestseller, the shrewd and voluble trial lawyer Louis Nizer, who made a long career of representing famous people in famous cases, recounts some of his significant civil and criminal cases. Nizer rose to national fame with his real-life accounts of tension-filled courtrooms and the fervor of the advocate, and “My Life in Court” proved to be no exception: it rose to the top of the Times’s best-seller list on its publication in 1961 and logged 72 weeks as a sales leader. The book is an in-depth collection of some of Mr. Nizer’s court case success stories, including his client Quentin Reynolds’ famous libel action against the columnist Westbrook Pegler, which would also become the basis of the 1963 Broadway play “A Case of Libel.” Praised by critics as “entertaining and philosophically instructive, an unusual combination,” Nizer’s movie-like plots of real-life courtroom drama will keep you captivated until the very last page.

Not illustrated. 1921 edition. Excerpt: ...seldom apparent to the mere spectator, however it may be appreciated by the lawyers engaged in the case, who may be able to recognize with what ingenuity and tact the desired facts have been elicited and the weak points suppressed or at least not clearly revealed. Is it not far easier to propound cross-questions which will put a man in an unattractive position before an audience than to so conduct his direct examination as to make him show himself to the greatest possible advantage? Many an idle boy has broken painted windows, but no one but an Albert Diirer could have made them! If the direct examination is properly and skilfully conducted, the impression thus made by an honest witness is more lasting than any argument of counsel. The vivid story of a single witness told in a winning way will leave a first impression upon a juror's mind that no eloquence can efface. It is no easy matter for an advocate to get his own evidence properly before a court and jury. It is an important fact for him to remember that cases are often won or lost by the straightforward statements of the parties themselves, and the natural homely way they sometimes have of putting things. A builderwas suing for extra work done on a dwelling. The defence was that everything had been paid for as originally contracted, but that much of the work had not been done according to agreement. An expert was called as defendant's witness. He testified that the house was six inches lower than called for by the specification; that the windows were on weights instead of opening out like French windows on hinges, and that therewere other material defects in workmanship. Item by item had to be carefully scrutinized. There was a chimney too short, a cornice defective, etc. The jurors...

The Majesty of the Law by Sandra Day O'Connor Pdf

NATIONAL BESTSELLER • “Shows us why Sandra Day O’Connor is so compelling as a human being and so vital as a public thinker.”—Michael Beschloss In this remarkable book, Sandra Day O’Connor explores the law, her life as a Supreme Court Justice, and how the Court has evolved and continues to function, grow, and change as an American institution. Tracing some of the origins of American law through history, people, ideas, and landmark cases, O’Connor sheds new light on the basics, exploring through personal observation the evolution of the Court and American democratic traditions. Straight-talking, clear-eyed, inspiring, The Majesty of the Law is more than a reflection on O’Connor’s own experiences as the first female Justice of the Supreme Court; it also reveals some of the things she has learned and believes about American law and life—reflections gleaned over her years as one of the most powerful and inspiring women in American history.

History on Trial by Deborah E. Lipstadt Pdf

In her acclaimed 1993 book Denying the Holocaust, Deborah Lipstadt called putative WWII historian David Irving "one of the most dangerous spokespersons for Holocaust denial." A prolific author of books on Nazi Germany who has claimed that more people died in Ted Kennedy's car at Chappaquiddick than in the gas chambers at Auschwitz, Irving responded by filing a libel lawsuit in the United Kingdom -- where the burden of proof lies on the defendant, not on the plaintiff. At stake were not only the reputations of two historians but the record of history itself.

Sandra Day O'Connor by Joan Biskupic Pdf

“Sandra Day O’Connor takes you behind the closed doors of the Supreme Court to reveal how Justice O’Connor helped craft landmark decisions on abortion, affirmative action, and a host of other critical issues. Joan Biskupic has broken new ground in reporting on O’Connor’s life and historic role on the high court. This lively, fast-paced account will make people rethink how they view this extraordinary woman and her fellow justices. An indispensable read for anyone interested in politics, the law, and power as exercised by one of the most fascinating women of our time.” -Andrea Mitchell Sandra Day O'Connor, America's first woman justice, became the axis on which the Supreme Court turned. She was called the most powerful woman in America, and it was often said that to gauge the direction of American law, one need look only to O'Connor's vote. Then, just one year short of a quarter century on the bench, she surprised her colleagues and the nation by announcing her retirement. Drawing on information from once-private papers of the justices, hundreds of interviews with legal and political insiders, and the insight gained from nearly two decades of covering the Supreme Court, Joan Biskupic examines O'Connor's remarkable career, providing an in-depth account of her transformation from tentative jurist to confident architect of American law. The portrait that emerges is of a complex and multifaceted woman: lawyer, politician, legislator, and justice, as well as wife, mother, A-list society hostess, and competitive athlete. To all appearances, she was the polite lady in pearls, handbag on her arm. But in the back rooms of politics and the law, she was a determined, focused strategist. O'Connor was the feminist who, rather than rebel against the male-dominated system, worked from within -- and succeeded. As Biskupic demonstrates, Justice O'Connor became much more than a "first." During her twenty-four-year tenure, she wrote the decisions on some of the most controversial social battles of our time. O'Connor's tie-breaking opinions on issues such as abortion rights, affirmative action, the death penalty, and religious freedom will have a lasting effect far into the future. O'Connor also cast one of the five votes that cut off the Florida recounts and allowed George W. Bush to take the White House in the 2000 contested presidential election. With an eye to the American people and a keen sense of public attitudes, she worked behind the scenes to shape the law and transform the legal standards by which future cases will be decided. From O'Connor's isolated upbringing on the Lazy B ranch in Arizona through her time as a state legislator to her rise as a justice -- along the way confronting her own personal challenges and crises, including breast cancer -- Biskupic presents a vivid, astute depiction of the justice -- and of the woman beneath the black robe. In so doing, Sandra Day O'Connor also provides an unprecedented look inside the exclusive, famously secretive High Court.

Dissent and the Supreme Court by Melvin I. Urofsky Pdf

“Highly illuminating ... for anyone interested in the Constitution, the Supreme Court, and the American democracy, lawyer and layperson alike." —The Los Angeles Review of Books In his major work, acclaimed historian and judicial authority Melvin Urofsky examines the great dissents throughout the Court’s long history. Constitutional dialogue is one of the ways in which we as a people reinvent and reinvigorate our democratic society. The Supreme Court has interpreted the meaning of the Constitution, acknowledged that the Court’s majority opinions have not always been right, and initiated a critical discourse about what a particular decision should mean before fashioning subsequent decisions—largely through the power of dissent. Urofsky shows how the practice grew slowly but steadily, beginning with the infamous and now overturned case of Dred Scott v. Sandford (1857) during which Chief Justice Roger Taney’s opinion upheld slavery and ending with the present age of incivility, in which reasoned dialogue seems less and less possible. Dissent on the court and off, Urofsky argues in this major work, has been a crucial ingredient in keeping the Constitution alive and must continue to be so.

Seeking the Court’s Advice by Kate Puddister Pdf

Can Parliament legalize same-sex marriage? Can Quebec unilaterally secede from Canada? Can the federal government create a national firearms registry? Each of these questions is contentious and deeply political, and each was addressed by a court in a reference case, not by elected policy makers. Reference cases allow governments to obtain an advisory opinion from a court without a live dispute or opposing litigants – and governments often wield this power strategically. The first study of its kind, Seeking the Court’s Advice draws on over two hundred reference cases from 1875 to 2017 to show that the actual outcome of a reference case – win or lose – is often secondary to the political benefits that can be attained from relying on courts through the reference power.

A Court Divided: The Rehnquist Court and the Future of Constitutional Law by Mark Tushnet Pdf

"An incisive consideration of the Supremes, offering erudite yet accessible clues to legal thinking on the most important level."--Kirkus Reviews In this authoritative reckoning with the eighteen-year record of the Rehnquist Court, Georgetown law professor Mark Tushnet reveals how the decisions of nine deeply divided justices have left the future of the Court; and the nation; hanging in the balance. Many have assumed that the chasm on the Court has been between its liberals and its conservatives. In reality, the division was between those in tune with the modern post-Reagan Republican Party and those who, though considered to be in the Court's center, represent an older Republican tradition. As a result, the Court has modestly promoted the agenda of today's economic conservatives, but has regularly defeated the agenda of social issues conservatives; while paving the way for more radically conservative path in the future.
