Monitoring State Compliance with the UN Convention on the Rights of the Child by Ziba Vaghri,Jean Zermatten,Gerison Lansdown,Roberta Ruggiero Pdf

This open access book presents a discussion on human rights-based attributes for each article pertinent to the substantive rights of children, as defined in the United Nations Convention on the Rights of the Child (UNCRC). It provides the reader with a unique and clear overview of the scope and core content of the articles, together with an analysis of the latest jurisprudence of the UN Committee on the Rights of the Child. For each article of the UNCRC, the authors explore the nature and scope of corresponding State obligations, and identify the main features that need to be taken into consideration when assessing a State’s progressive implementation of the UNCRC. This analysis considers which aspects of a given right are most important to track, in order to monitor States' implementation of any given right, and whether there is any resultant change in the lives of children. This approach transforms the narrative of legal international standards concerning a given right into a set of characteristics that ensure no aspect of said right is overlooked. The book develops a clear and comprehensive understanding of the UNCRC that can be used as an introduction to the rights and principles it contains, and to identify directions for future policy and strategy development in compliance with the UNCRC. As such, it offers an invaluable reference guide for researchers and students in the field of childhood and children’s rights studies, as well as a wide range of professionals and organisations concerned with the subject.

The Routledge International Handbook of Shared Parenting and Best Interest of the Child by José Manuel de Torres Perea,Edward Kruk,Margarita Ortiz-Tallo Pdf

This multidisciplinary volume offers an essential, comprehensive study of perspectives on the scope and application of the best interests of the child and focuses mainly on its application in relation to child custody. With expert contributions from psychological, sociological and legal perspectives, it offers scientific analysis and debate on whether it should be the primary consideration in deciding child custody cases in cases of divorce or separation or whether it should be one of several primary considerations. It explores complex dilemmas inherent in shared parenting and whether the advantages it offers children are sufficient when compared to attributing custody to one parent and limiting visitation rights of the other. Offering a comprehensive analysis of this complex topic, chapters provide detailed insight into the current state of research in this area, as well as expert guidelines aimed at resolving the controversies when parents agree or disagree over their children’s living arrangements. Cutting-edge topics explored include: transnational shared parenting; alternative dispute resolution; breastfeeding parents; religious disputes between parents and the psychological, social and economic factors that affect shared parenting. The Routledge International Handbook of Shared Parenting and Best Interest of the Child will be essential reading for scholars and graduate students in law, psychology, sociology and economics interested in shared parenting and family law.

Human Rights in Child Protection by Asgeir Falch-Eriksen Pdf

This open access book critically explores what child protection policy and professional practice would mean if practice was grounded in human rights standards. This book inspires a new direction in child protection research – one that critically assesses child protection policy and professional practice with regard to human rights in general, and the rights of the child in particular. Each chapter author seeks to approach the rights of the child from their own academic field of interest and through a comparative lens, making the research relevant across nation-state practices. The book is split into five parts to focus on the most important aspects of child protection. The first part explains the origins, aim, and scope of the book; the second part explores aspects of professionalism and organization through law and policy; and the third part discusses several key issues in child protection and professional practice in depth. The fourth part discusses selected areas of importance to child protection practices (low-impact in-house measures, public care in residential care and foster care respectively) and the fifth part provides an analytical summary of the book. Overall, it contributes to the present need for a more comprehensive academic debate regarding the rights of the child, and the supranational perspective this brings to child protection policy and practice across and within nation-states. .

Children’s Constitutional Rights in the Nordic Countries by Trude Haugli,Anna Nylund,Randi Sigurdsen,Lena R.L. Bendiksen Pdf

The book presents a comparative study of children’s constitutional rights in Denmark, Finland, Iceland, Norway and Sweden. The authors discuss the value of enshrining children’s rights in national constitutions in addition to implementing the Convention on the Rights of the Child (CRC). Central issues are whether enshrining children’s rights in the Constitution improves implementation and enforcement of those rights by providing advocacy tools and by mandating courts, legislators, policy-makers and practitioners to take children’s rights seriously. The study assesses whether the Nordic constitutions are in line with the child rights approach of the CRC both on a general level and in detail in three domains; the best interests of the child, participation rights, and the right to respect for family life.

Parenting Plan Evaluations by Kathryn Kuehnle,Leslie Drozd Pdf

When conducting parenting plan evaluations, mental health professionals need to be aware of a myriad of different factors. More so than in any other form of forensic evaluation, they must have an understanding of the most current findings in developmental research, behavioral psychology, attachment theory, and legal issues to substantiate their opinions. With a number of publications on child custody available, there is an essential need for a text focused on translating the research associated with the most important topics within the family court. This book addresses this gap in the literature by presenting an organized and in-depth analysis of the current research and offering specific recommendations for applying these findings to the evaluation process. Written by experts in the child custody arena, chapters cover issues associated with the most important and complex issues that arise in family court, such as attachment and overnight timesharing with very young children, dynamics between divorced parents and children's potential for resiliency, co-parenting children with chronic medical conditions and developmental disorders, domestic violence during separation and divorce, gay and lesbian co-parents, and relocation, among others. The scientific information provided in these chapters assists forensic mental health professionals to proffer empirically-based opinions, conclusions and recommendations. Parenting Plan Evaluations is a must-read for legal practitioners, family law judges and attorneys, and other professionals seeking to understand more about the science behind child custody evaluations.

Before the Best Interests of the Child by Joseph Goldstein,Anna Freund,Albert J. Solnit Pdf

The second volume in a classic trilogy of reference works often cited in child custody cases, which introduced the concept of the “least detrimental alternative” when addressing a child’s welfare. The second volume in a classic trilogy of works by Joseph Goldstein, former Sterling Professor Emeritus of Law at Yale Law School; Albert J. Solnit, the former director of the Yale Child Study Center, and Anna Freud, daughter of Sigmund Freud. These texts (Beyond the Best Interests of the Child was the first in the series, and In the Best Interests of the Child was the third) are classic references often cited in child custody cases; Before the Best Interests of the Child specifically addresses when the state should intervene. Rather than the familiar legal "best interests of the child" doctrine, the authors’s work is based on the more realistic standard of finding the "least detrimental alternative." This is indispensable reading for social workers, family court judges, lawyers, psychologists, and parents.

Education and Science in the Best Interest of the Child by Christopher K. Slaton EdD Pdf

Search for Policy We have confirmed through our October 11, 2016, building human assets meeting with the California Department of Education that there is no federal or state policy in place to address the eligibility status of children from a family history of suffering from substance abuserelated disorders. Hence, the Building Human Assets Project Human Systems Research in Education study is in an area not covered by federal or state laws or regulations. This is why a new scientific approach is needed in the best interest of the child. To the benefit of all children, the Individuals with Disabilities Act was reauthorized and signed into law on December 3, 2004 as the Individuals with Disabilities Education Improvement Act of 2004, Public Law 108-446. This includes several requirements effective July 1, 2005, which calls for states to establish policies and regulations that require referral for early intervention services of a child under the age of three who is identified as affected by illegal substance abuse or withdrawal symptoms resulting from parental drug exposure (Section 637[a][6][B]). This relates to the anatomy of the child suspected of suffering from a family history of substance abuserelated disorders The Keeping Children and Families Safe Act of 2003 was intended to add new requirements under the Child Abuse Prevention and Treatment Act of 2004, to include the requirement that states have policies and procedures in place which require health care providers to notify Child Protective Services of infants born and identified as being affected by illegal substance abuse or withdrawal symptoms that result from prenatal drug exposure. Hence, the educational implications for children inflicted with disorders as a result of exposure to drugs in the utero. Early intervention and treatment is a basic need. The 2015 Every Student Succeeds Act (ESSA) shifts federal accountability provisions to the states. ESSA is the law that governs the United States K-12 public education policy, and replaces the No Child Left Behind Act through the reauthorization of the 1965 elementary and secondary education Act (ESEA). ESEA established the American federal governments expanded role in funding education in the best interest of the child. This is the sense through which the words the family community engagement reflects on the compelling needs of the child, the family, and the community.

The Ethics of Vaccination by Alberto Giubilini Pdf

This open access book discusses individual, collective, and institutional responsibilities with regard to vaccination from the perspective of philosophy and public health ethics. It addresses the issue of what it means for a collective to be morally responsible for the realisation of herd immunity and what the implications of collective responsibility are for individual and institutional responsibilities. The first chapter introduces some key concepts in the vaccination debate, such as ‘herd immunity’, ‘public goods’, and ‘vaccine refusal’; and explains why failure to vaccinate raises certain ethical issues. The second chapter analyses, from a philosophical perspective, the relationship between individual, collective, and institutional responsibilities with regard to the realisation of herd immunity. The third chapter is about the principle of least restrictive alternative in public health ethics and its implications for vaccination policies. Finally, the fourth chapter presents an ethical argument for unqualified compulsory vaccination, i.e. for compulsory vaccination that does not allow for any conscientious objection. The book will appeal to philosophers interested in public health ethics and the general public interested in the philosophical underpinning of different arguments about our moral obligations with regard to vaccination.
