Offshore Financial Centres and the Law by Dominic Thomas-James Pdf

This book considers the ability of island jurisdictions with financial centres to meet the expectations of the international community in addressing the threats posed to themselves and others by their innocent (or otherwise) facilitation of the receipt of suspect wealth. In the global financial architecture, British Overseas Territories are of material significance. Through their inalienable right to self-determination, many developed offshore financial centres to achieve sustainable economic development. Focusing on Bermuda, Turks and Caicos, and Anguilla, the book concerns suspect wealth emanating from financial crimes including corruption, money laundering and tax evasion, as well as controversial conduct like tax avoidance. This work considers the viability of international standards on suspect wealth in the context of the territories, how willing or able they are to comply with them, and how their financial centres can better prevent receipt of suspect wealth. While universalism is desirable in the modern approach to tackling suspect wealth, a one-size-fits-all approach is inappropriate for these jurisdictions. On critically evaluating their legislative and regulatory regimes, the book advances that they demonstrate willingness to comply with international standards. However, their abilities and levels of compliance vary. In acknowledging the facilitatively harmful role the territories can play, this work draws upon evidence of implication in transnational financial crime cases. Notwithstanding this, the book questions whether the degree of criticism that these offshore jurisdictions have encountered is warranted in light of apparent willingness to engage in the enactment and administration of internationally accepted laws and cooperate with international institutions.

Re-Imagining Offshore Finance by Christopher M. Bruner Pdf

Small jurisdictions have become significant players in cross-border corporate and financial services. Their nature, legal status, and market roles, however, remain under-theorized. Lacking a sufficiently nuanced framework to describe their functions in cross-border finance - and the peculiar strengths of those achieving global dominance in the marketplace - it remains impossible to evaluate their impacts in a comprehensive manner. This book advances a new conceptual framework to refine the analysis and direct it toward more productive inquiries. Bruner canvasses extant theoretical frameworks used to describe and evaluate the roles of small jurisdictions in cross-border finance. He then proposes a new concept that better captures the characteristics, competitive strategies, and market roles of those achieving global dominance in the marketplace - the "market-dominant small jurisdiction" (MDSJ). Bruner identifies the central features giving rise to such jurisdictions' competitive strengths - some reflect historical, cultural, and geographic circumstances, while others reflect development strategies pursued in light of those circumstances. Through this lens, he evaluates a range of small jurisdictions that have achieved global dominance in specialized areas of cross-border finance, including Bermuda, Dubai, Singapore, Hong Kong, Switzerland, and Delaware. Bruner further tests the MDSJ concept's explanatory power through a broader comparative analysis, and he concludes that the MDSJs' significance will likely continue to grow - as will the need for a more effective means of theorizing their roles in cross-border finance and the global dynamics generated by their ascendance.

Democracy in Small States by Jack Corbett,Wouter Veenendaal Pdf

Populism and the personalization of politics appears to be threatening the existence of democracy as we know it all over the world. It is now more important than ever to understand the history of this form of regime: why it has thrives and fails. But, existing studies are limited by their focus on a few large and predominately rich states. This book takes the opposite approach: it investigates how politics is practiced in the smallest states where hyper-personalization has always been a ubiquitous feature of political life. It optimistically finds that hyper-personalized democracy can actually persist against all odds, but also cautions that political practices in small states are often markedly different to larger states. Oxford Studies in Democratization is a series for scholars and students of comparative politics and related disciplines. Volumes concentrate on the comparative study of the democratization process that accompanied the decline and termination of the cold war. The geographical focus of the series is primarily Latin America, the Caribbean, Southern and Eastern Europe, and relevant experiences in Africa and Asia. The series editor is Laurence Whitehead, Senior Research Fellow, Nuffield College, University of Oxford.

Small States in Multilateral Economic Negotiations by Amrita Narlikar Pdf

This book addresses the puzzle, Can David take on Goliath in multilateral economic negotiations, and if so, then under what conditions? The question of how the weak bargain with the strong in international politics is exciting theoretically and empirically. In a world of ever-increasing interdependence, and also a time of economic crisis, it acquires even greater significance. With the help of issue-specific case studies, the volume offers new insights into the vulnerabilities that small states face in multilateral economic negotiations, and also mechanisms whereby these weaknesses might be overcome and even used as an advantage. The attention that this volume pays to questions of smallness and negotiation allow it to address a long-standing problem of international politics. The case studies, which cover monetary, financial, trade, and climate change negotiations, ensure a unique and valuable topicality to the volume. This book was published as a special issue of The Round Table.

Offshore Finance and State Power by Andrea Binder Pdf

Offshore Finance and State Power asks how offshore financial services affect the power of the state. Combining a concept analysis with empirical research, the book finds that economic actors go offshore to create money more than to hide it and it also reveals that the relationship between the two is not straightforward.

Small States and International Security by Clive Archer,Alyson J.K. Bailes,Anders Wivel Pdf

This book explains what ‘small’ states are and explores their current security challenges, in general terms and through specific examples. It reflects the shift from traditional security definitions emphasizing defence and armaments, to new security concerns such as economic, societal and environmental security where institutional cooperation looms larger. These complex issues, linked with traditional power relations and new types of actors, need to be tackled with due regard to democracy and good governance. Key policy challenges for small states are examined and applied in the regional case studies. The book deals mainly with the current experience and recent past of such states but also offers insights for their future policies. Although many of the states covered are European, the study also includes African, Caribbean and Asian small states. Their particular interest and relevance is outlined, as is the connection between their security challenges and their smallness. Policy lessons for other states are then sought. The book is the first in-depth, multi-continent study of security as an aspect of small state governance today. It is novel in placing the security dilemmas of small states in the context of wider ideas on international and institutional change, and in dealing with non-European states and regions.

Challenges in Correspondent Banking in the Small States of the Pacific by Jihad Alwazir,Mr.Fazurin Jamaludin,Dongyeol Lee,Niamh Sheridan,Ms.Patrizia Tumbarello Pdf

Access to financial services in the small states of the Pacific is being eroded. Weaknesses in Anti-Money Laundering and Combating the Financing of Terrorism compliance in the context of high levels of remittances are contributing to banks’ decisions to withdraw corresponding banking relationships and close bank accounts of money transfer operators. In this paper, we gather evidence on these developments in the small states of the Pacific, discuss the main drivers, and the potentially negative impact on the financial sector and macroeconomy. We then identify the collective efforts needed to address the consequences of withdrawal of corresponding banking relationships and outline policy measures to help the affected countries mitigate the impact.
