Le propos de cet ouvrage n'est ni de célébrer la loi de 1905, " centenaire " mais toujours " vaillante ", ni de méditer sur son sens et son esprit, mais de porter un nouvel éclairage sur les faits qui se sont produits aux moments de l'élaboration de la loi de séparation des Églises et de l'État, de son adoption puis de sa mise en œuvre. Fondé sur de nouvelles recherches, portant sur des domaines aussi variés que la médecine, la mort, l'histoire de la colonisation ou de la " laïcité scolaire " croisant les approches d'historiens, de sociologues, de politistes et de juristes, l'ensemble constitue une mise au point novatrice, analysée des points de vue juridique, politique, social et culturel. La loi de 1905 ne symbolise pas seulement un épisode fort de la vie politique française. Il s'agit d'un texte soulevant contentieux, débats, confrontations à des situations géopolitiques particulières - les musulmans de l'Empire, le problème de l'Alsace-Moselle, etc. Dans le temps, la laïcité s'inscrit dans le droit ; s'institutionnalisant, s'adaptant aux circonstances, son principe finit par être accepté par la seule des trois religions qui en avait refusé les termes et les conséquences. Après la Seconde Guerre mondiale, l'école est longtemps demeurée le théâtre d'affrontements virulents. Depuis une vingtaine d'années, le modèle républicain laïque d'intégration nationale est questionné par l'émergence de l'islam, dans un contexte de développement de la diversité culturelle et religieuse. Des conditions politiques ayant entouré l'adoption de la loi de 1905 jusqu'aux représentations de la laïcité chez les Français d'aujourd'hui, c'est donc toute une partie décisive de l'Histoire de la France au XXe siècle qui est retracée ici.

To understand the concept of laïcité, one must begin in the sixteenth century with the Protestant Reformation and freedom of conscience recognized by the Edict of Nantes in 1598. This has been called the period of incipient laïcité in the toleration of Protestantism. The Revocation of the Edict of Nantes in 1685 reestablished the union of the throne and altar, which resulted in persecution of the Huguenots who fought for the principle of the freedom of conscience. French laïcité presents a specificity in origin, definition, and evolution which led to the official separation of church and state in 1905. The question in the early twentieth century concerned the Roman Catholic Church’s compatibility with democracy. That same question is being asked of Islam in the twenty-first century.

Why do secular states pursue different policies toward religion? This book provides a generalizable argument about the impact of ideological struggles on the public policy making process, as well as a state-religion regimes index of 197 countries. More specifically, it analyzes why American state policies are largely tolerant of religion, whereas French and Turkish policies generally prohibit its public visibility, as seen in their bans on Muslim headscarves. In the United States, the dominant ideology is 'passive secularism', which requires the state to play a passive role, by allowing public visibility of religion. Dominant ideology in France and Turkey is 'assertive secularism', which demands that the state play an assertive role in excluding religion from the public sphere. Passive and assertive secularism became dominant in these cases through certain historical processes, particularly the presence or absence of an ancien régime based on the marriage between monarchy and hegemonic religion during state-building periods.
