The Global Community Yearbook of International Law and Jurisprudence 2020 by Giuliana Ziccardi Capaldo Pdf

The 2020 edition marks the 20th Anniversary of The Global Community Yearbook of International Law and Jurisprudence. The Yearbook has established itself as an authoritative source of reference on global legal issues and international jurisprudence. It includes analysis of the most significant global trends in a way that allows readers to monitor the development of the global legal order from several perspectives. The Yearbook publishes annually in a volume of carefully chosen primary source material and corresponding expert commentary. The General Editor, Professor Giuliana Ziccardi Capaldo, employs her vast expertise in international law to select excerpts from important court opinions and to choose experts from around the world to contribute essay-guides, which illuminate those cases. Although the main focus is recent case law from the major international tribunals and regional courts, the first four parts of each year's edition features expert articles by renowned scholars who address broader themes in current and future developments in international law and global policy, themes that appear throughout the case law of the many courts covered by the series as a whole. The Global Community Yearbook has thus become not just an indispensable window to recent jurisprudence: the series now also serves to prepare researchers for the issues facing emerging global law. This anniversary edition updates readers on the important work of long-standing international tribunals and introduces readers to more novel topics in international law. The journal's founding editor, Professor Emeritus Giuliana Ziccardi Capaldo, in her Editorial gives a presentation of the Yearbook's intellectual trajectory, as developed from its original roots, showing intriguing prospects for a publication that aims at the very forefront of events in law, politics, ethics, and jurisprudence in a global community. The Yearbook continues to provide expert coverage of the Court of Justice of the European Union and diverse tribunals from the International Court of Justice (ICJ), human rights courts (ECtHR, IACtHR, ACtHPR), criminal tribunals such as the International Criminal Court (ICC) and the International Residual Mechanism for Criminal Tribunals (MICT), to economically based tribunals such as ICSID and the WTO dispute settlement system. This edition contains original research articles on the development and analysis of the concept of global law and the views of the leading global law theorists on the subject of globalization. This 20th anniversary edition also includes a special section which provides an interdisciplinary overview of China's Belt and Road Initiative; and an examination of the global public health order in a post-COVID-19 world. The Yearbook provides students, scholars, and practitioners alike a valuable combination of expert discussion and direct quotes from the court opinions to which that discussion relates, as well as an annual overview of the process of cross-fertilization between international courts and tribunals.

Emerging Powers, Global Justice and International Economic Law by Andreas Buser Pdf

The book assesses emerging powers’ influence on international economic law and analyses whether their rhetoric of reforming this ‘unjust’ order translates into concrete reforms. The questions at the heart of the book surround the extent to which Brazil, Russia, India, China, and South Africa individually and as a bloc (BRICS) provide alternative regulatory ideas to those of ‘Western’ States and whether they are able to convert their increased power into influence on global regulation. To do so, the book investigates two broader case studies, namely, the reform of international investment agreements and WTO reform negotiations since the start of the Doha Development Round. As a general outcome, it finds that emerging powers do not radically challenge established law. ‘Third World’ rhetoric mostly does not translate into practice and rather serves to veil economic interests. Still, emerging powers provide for some alternative regulatory ideas, already leading to a diversification of international economic law. As a general rule, they tend to support norms that allow host States much policy space which could be used to protect and fulfil socio-economic human rights, especially – but not only – in the Global South.

Negotiating the New Normal by Saurav Jha Pdf

" The world economy was still reeling from the Global Financial Crisis of 2008 when the COVID-19 pandemic struck like a bolt of lightning in late 2019. Whatever remained of the neoliberal credo - based on the salience of free markets - was upended, and economic nationalism fast became the new stock ideology. In Negotiating the New Normal, Saurav Jha carefully examines why, in the wake of the coronavirus shock, strong economic recovery in the developed world is more doubtful than ever. Instead of throwing its weight behind a multipolar world order, China, by far the largest economy among the BRICS nations, has chosen to create a Pax Sinica. However, it is unlikely to make much headway owing to both internal economic contradictions and pushback from the West and beyond. And what of India? Can it become a 'new China' to serve as a key engine of global growth, overcoming the pandemic-induced setback, as well as earlier policy missteps like demonetization? Answering all these questions and raising many more, Jha's deeply researched and cogently argued account examines the 'new normal' of a transactional, even predatory geoeconomic climate where central banks are fast running out of answers and heavily indebted governments are desperately searching for silver bullets. This work of extraordinary depth and ambition, tracing the destinies of the major economic centres of the world, provides a nuanced if sobering context to the reader as it suggests what India must do to rise in this grave new pandemic-ridden world. International Negotiation and Political Narratives by Fen Osler Hampson,Amrita Narlikar Pdf

This book shows that political narratives can promote or thwart the prospects for international cooperation and are major factors in international negotiation processes in the 21st century. In a world that is experiencing waves of right-wing and left-wing populism, international cooperation has become increasingly difficult. This volume focuses on how the intersubjective identities of political parties and narratives shape their respective values, interests and negotiating behaviors and strategies. Through a series of comparative case studies, the book explains how and why narratives contribute to negotiation failure or deadlock in some circumstances and why, in others, they do not because a new narrative that garners public and political support has emerged through the process of negotiation. The book also examines how narratives interact with negotiation principles, and alter the bargaining range of a negotiation, including the ability to make concessions. This book will be of much interest to students of international negotiation, economics, security studies and international relations.

The International Legal Order in Global Governance by Alain Germeaux Pdf

The space occupied by international law in shaping political action is subject to continuing debate and controversy. This book aims to answer the question of how and why international law impacts the behaviour of actors on the international stage in the absence of central authority and faced with asymmetric power. At a time when the role of normative restraints in international relations, and international law in particular, has come under renewed questioning, it advances an analytical framework for understanding the effect of norms on behaviour that is not contingent on material restraints or a given political constellation, while being informed by the practical realities and practice of international organisation. In doing so, this book draws on an interdisciplinary range of sources, including international law, political theory, cognitive psychology and behavioural economics to explore a communicative action-based approach of how norms and ideas persuade actors to engage in a course of action consonant with international law to achieve a particular outcome. In probing the role of norms on questions such as the use of force and accountability, and issues of equity and justice, it examines the challenges international law faces and what the way forward may look like.

The UK's Withdrawal from the EU by Michael Dougan Pdf

Following a national referendum on 23rd June 2016, the UK announced its intention to end its decades-long membership of the EU, perhaps the most dramatic and important change in national policy since 1945. That decision initiated a process of complex negotiations aimed at making the arrangements required for an "orderly Brexit". The UK's Withdrawal from the EU explores the UK's departure from the EU from a legal perspective: Michael Dougan provides a critical analysis of the final EU-UK Withdrawal Agreement, including explorations of the future protection of citizens' rights, the border between Ireland and Northern Ireland, and the prospects for future EU-UK relations in fields such as trade and security. These explorations also include an analysis of the primary problems that arose during the Brexit negotiation process and various constitutional principles relevant to EU withdrawal law.
