The discipline of rhetoric - adapted through a wide range of reformulations to the specific requirements of Greek, Roman, Medieval, and Renaissance societies - dominated European education and discourse, whether public or private, for more than two thousand years. The end of classical rhetoric's domination was brought about by a combination of social and cultural transformations that occured between the seventeenth and nineteenth centuries. Concurrent with the 'theory boom' of recent decades, rhetoric has appeared as a center of discussion in the humanities and social sciences. Rhetorical inquiry, as it is thought and practiced today, occurs in an interdisciplinary matrix that touches on philosophy, linguistics, communication studies, psychoanalysis, cognitive science, sociology, anthropology, and political theory. Rhetoric is now an area of study without accepted certainties, a territory not yet parceled into topical subdivisions, a mode of discourse that adheres to no fixed protocols. It is a noisy field in the cybernetic sense of the term: a fertile ground for creative innovation. This volume embodies the interdisciplinary character of rhetoric. The essays draw on wide-ranging conceptual resources, and combine historical, theoretical, and practical points of view. The contributors develop a variety of perspectives on the central concepts of rhetorical theory, on the work of some of its major proponents, and on the breaks and continuities of its history. The spectrum of thematic concern is broad, extending from the Greek polis to the multi-ethnic city of modern America, from Aristotle to poststructuralism, from questions of figural language to problems of persuasion and interaction. But a common interdisciplinary interest runs through all the essays: the effort to rethink rhetoric within the contemporary epistemological situation. In this sense, the book opens new possibilities for research within the human sciences.

This book introduces a novel approach to the analysis and practice of persuasive speaking and writing: heuristic rhetoric. The book traces the changing relation and intense debates between law and literature in U.S. American culture, using examples from the 18th to the 20th century (including novels by Charles Brockden Brown, James Fenimore Cooper, Harper Lee, and William Gaddis). Since the early American republic, the critical representation of legal matters in literary fictions and cultural narratives about the law served an important function for the cultural imagination and legitimation of law and justice in the United States. One of the most essential questions that literary representations of the law are concerned with, the study argues, is the unstable relation between language and truth, or, more specifically, between rhetoric and evidence. In examining the truth claims of legal language and rhetoric and the evidentiary procedures and protocols which are meant to stabilize these claims, literary fictions about the law aim to provide an alternative public discourse that translates the law's abstractions into exemplary stories of individual experience. Yet while literature may thus strive to institute itself as an ethical counter narrative to the law, in order to become, in Shelley’s famous phrase “the legislator of the world”, it has to face the instability of its own relation to truth. The critical investigation of legal rhetoric in literary fiction thus also and inevitably entails a negotiation of the intrinsic value of literary evidence.

"Rhetoric, broadly conceived as the art of making things matter, is both a practice and theory about that practice. In recent decades, scholars of rhetoric have turned to approaches that braid together poetics, performance, and philosophy into a "practical art." By practical art, they mean methods tested in practice, by trial and error, with a goal of offering something useful and teachable. This volume presents just such an account of rhetoric. The account here does not turn away from theory, but rather presumes and incorporates theoretical approaches, offering a collection of principles assembled in the heat and trials of public practice. The approaches ventured in this volume are inspired by the capacious conception of rhetoric put forth by historian of rhetoric Jeffrey Walker, who is perhaps best known for stressing rhetoric's educational mission and its contributions to civic life. The Practice of Rhetoric is organized into three sections designed to spotlight, in turn, the importance of poetics, performance, and philosophy in rhetorical practice. The volume begins with poetics, stressing the world-making properties of that word, in contexts ranging from mouse-infested medieval fields to the threat of toxin-ridden streams in the mid-twentieth century. Susan C. Jarratt, for instance, probes the art of ekphrasis, or vivid description, and its capacity for rendering alternative futures. Michele Kennerly explores a little-studied linguistic predecessor to prose-logos psilos, or naked speech-exposing the early rumblings of a separation between poetic and rhetorical texts even as it historicizes the idea of clothed or ornamented speech. In an essay on the almost magical properties of writing, Debra Hawhee considers the curious practice of people writing letters to animals in order to banish or punish them, thereby casting the epistolary arts in a new light. Part 2 moves to performance. Vessela Valiavitcharska examines the intertwining of poetic rhythm and performance in Byzantine rhetorical education, and how such practices underlie the very foundations of oratory. Dale Martin Smith draws on the ancient stylistic theory of Dionysius of Halicarnassus along with the activist work of contemporary poets Amiri Baraka and Harmony Holiday to show how performance and persuasion unify rhetoric and poetics. Most treatments of philosophy and rhetoric begin within a philosophical framework, and remain there, focusing on old tools like stasis and disputation. Essays in part 3 break out of that mold by focusing on the utility and teachability of rhetorical principles in education.
