International Human Rights Law in Africa by Frans Viljoen Pdf

This book provides a comprehensive and analytical overview of human rights law in Africa. It examines the institutions, norms, and processes for human rights realization provided for under the United Nations system, the African Union, and sub-regional economic communitites in Africa, and explores their relationship with the national legal systems of African states. Since the establishment of the African Union in 2001, there has been a proliferation of regional institutions that are relevant to human rights in Africa. These include the Pan African Parliament, the Peace and Security Council, the Economic, Social and Cultural Council and the African Peer Review Mechanism of the New Partnership for Africa's Development. This book discusses the links between these institutions. It further examines the case law stemming from Africa' most important human rights instrument, the African Charter on Human and Peoples Rights, which entered into force on 21 October 1986. This new edition contains a new chapter on the African Children's Rights Committee as well as full coverage of new developments and instruments, such as the Convention on the Rights of Persons with Disabilities, the Convention on Enforced Disappearances, and the African Charter on Democracy, Elections and Governance. Three cross-cutting themes are explored throughout the book: national implementation and enforcement of international human rights law; legal and other forms of integration; and the role of human rights in the eradication of poverty. The book also provides an introduction to the relevant human rights concepts.

The Rejection of Consequentialism by Samuel Scheffler Pdf

In contemporary philosophy, substantive moral theories are typically classified as either consequentialist or deontological. Standard consequentialist theories insist, roughly, that agents must always act so as to produce the best available outcomes overall. Standard deontological theories, by contrast, maintain that there are some circumstances where one is permitted but not required to produce the best overall results, and still other circumstances in which one is positively forbidden to do so. Classical utilitarianism is the most familiar consequentialist view, but it is widely regarded as an inadequate account of morality. Although Professor Scheffler agrees with this assessment, he also believes that consequentialism seems initially plausible, and that there is a persistent air of paradox surrounding typical deontological views. In this book, therefore, he undertakes to reconsider the rejection of consequentialism. He argues that it is possible to provide a rationale for the view that agents need not always produce the best possible overall outcomes, and this motivates one departure from consequentialism; but he shows that it is surprisingly difficult to provide a satisfactory rationale for the view that there are times when agents must not produce the best possible overall outcomes. He goes on to argue for a hitherto neglected type of moral conception, according to which agents are always permitted, but not always required, to produce the best outcomes.

Archipelago of Justice by Laurie M. Wood Pdf

An examination of France’s Atlantic and Indian Ocean empires through the stories of the little-known people who built it This book is a groundbreaking evaluation of the interwoven trajectories of the people, such as itinerant ship-workers and colonial magistrates, who built France’s first empire between 1680 and 1780 in the Atlantic and Indian Oceans. These imperial subjects sought political and legal influence via law courts, with strategies that reflected local and regional priorities, particularly regarding slavery, war, and trade. Through court records and legal documents, Wood reveals how courts became liaisons between France and new colonial possessions.

White Cargo by Don Jordan,Michael Walsh Pdf

White Cargo is the forgotten story of the thousands of Britons who lived and died in bondage in Britain's American colonies. In the seventeenth and eighteenth centuries, more than 300,000 white people were shipped to America as slaves. Urchins were swept up from London's streets to labor in the tobacco fields, where life expectancy was no more than two years. Brothels were raided to provide "breeders" for Virginia. Hopeful migrants were duped into signing as indentured servants, unaware they would become personal property who could be bought, sold, and even gambled away. Transported convicts were paraded for sale like livestock. Drawing on letters crying for help, diaries, and court and government archives, Don Jordan and Michael Walsh demonstrate that the brutalities usually associated with black slavery alone were perpetrated on whites throughout British rule. The trade ended with American independence, but the British still tried to sell convicts in their former colonies, which prompted one of the most audacious plots in Anglo-American history. This is a saga of exploration and cruelty spanning 170 years that has been submerged under the overwhelming memory of black slavery. White Cargo brings the brutal, uncomfortable story to the surface.

Research Handbook on Transnational Labour Law by Adelle Blackett,Anne Trebilcock Pdf

The editors’ substantive introduction and the specially commissioned chapters in the Handbook explore the emergence of transnational labour law as a field, along with its contested contours. The expansion of traditional legal methods, such as treaties, is juxtaposed with the proliferation of contemporary alternatives such as indicators, framework agreements and consumer-led initiatives. Key international and regional institutions are studied for their coverage of such classic topics as freedom of association, equality, and sectoral labour standard-setting, as well as for the space they provide for dialogue. The volume underscores transnational labour law’s capacity to build bridges, including on migration, climate change and development.

Fortunes à faire by Catherine Manning Pdf

The history of the French in India has received far less scholarly attention than that of other European nations; English historiography, in particular, has often treated it as no more than a preliminary to the extension of British power. In addition, work hitherto has tended to focus on the trade with Europe, not the Asian trade - the 'country trade' carried on within Asia; the full importance of this trade for the Dutch and British is now being recognised. This book represents the first sustained study of French activities in Asian trade, and fills this gap in the historiography. Catherine Manning is concerned to relate the French traders to their social, regional and financial roots, and to trace their connections with other commercial groups in India, both European and Asian. The French evidence that she assembles, including much archival material, also makes a significant contibution to the debate about economic decline and renewal in 18th-century India. Her analysis stresses the importance of the Indian context, and shows that economic and political developments in South India were crucial to the French move from trade to war in the 1740s. Finally the book examines why the French failed in an enterprise which was to succeed so signally for the British only a few decades later.

The International Labour Organization by Daniel Maul Pdf

This book is the first comprehensive account of the International Labour Organization’s 100-year history. At its heart is the concept of global social policy, which encompasses not only social policy in its national and international dimensions, but also development policy, world trade, international migration and human rights. The book focuses on the ILO’s roles as a key player in debates on poverty, social justice, wealth distribution and social mobility subjects and as a global forum for addressing these issues. The study puts in perspective the manifold ways in which the ILO has helped structure these debates and has made – through its standard-setting, technical cooperation and myriad other activities – practical contributions to the world of work and to global social policy.
