The USA Patriot Act by Howard Ball Pdf

The USA Patriot Act: A Reference Handbook is an in-depth examination of the difficult wartime task of balancing civil liberties against national security. Within weeks of the September 11 terrorist attacks, overwhelming majorities in both houses of Congress passed the USA Patriot Act. The act immediately aroused bitter controversy. Some claim it impermissibly infringes on constitutional rights; others argue it is a necessary tool to ensure the security of the American homeland. Distinguished scholar and prolific author Howard Ball provides the background necessary for a reasoned, historical examination of both positions. He details the threats to America in the last 60 years, emphasizing terrorist acts; examines the temporary surrender of civil rights during past American wars; and uses that history to analyze the USA Patriot Act, both as it exists and as arguments rage over whether to strengthen or weaken the law.

Strengthening Privacy Rights and National Security by Committee on the Judiciary United States Pdf

In the years since September 11th, Congress has repeatedly expanded the scope of Foreign Intelligence Surveillance Act (FISA) and has given the Government sweeping new powers to collect information on law-abiding Americans. Americans have learned that one of these authorities-Section 215 of the USA PATRIOT Act-has for years been secretly interpreted to authorize the collection of Americans' phone records on an unprecedented scale. Information has also been leaked about Section 702 of FISA, which authorizes the National Security Agency (NSA) to collect the communications of foreigners overseas. In the wake of these leaks, President Obama said that this is an opportunity to have an open and thoughtful debate about these issues. Director of National Intelligence, James Clapper, has acknowledged that he provided false testimony about the NSA surveillance programs during a Senate hearing. It is far too difficult to get a straight answer about the effectiveness of the Section 215 phone records program. Whether this program is a critical national security tool is a key question for Congress as it considers possible changes to the law. The bulk collection program has massive privacy implications. The phone records of every American resides in an NSA database. It has been reported that the bulk collection of Internet metadata was shut down because it failed to produce meaningful intelligence. We need to take an equally close look at the phone records program. If this program is not effective, it has to end.

Shifting Positionalities by Aaron Tobler,María Amelia Viteri Pdf

The local-level and international contributors of Shifting Positionalities encompass particular common themes through in-depth social science research in an effort to understand the meanings of the reformulation of state discourses and practices in this post-9/11 era. Current conjunctions between sexual, racial and ethnic identities—and the surveillance practices of those identities—calls for a thorough examination of the multiple and usually unexpected meaning-making practices adapted by individuals. Far from being predictable, the latter speaks to the possibility of individuals and communities utilizing techniques of actively resisting—as opposed to passively embracing—the policing of their daily lives. Shifting Positionalities: The Local and International Geo-Politics of Surveillance and Policing addresses surveillance and policing as practices and sites that speak to the various ways in which bio-power, displacement and resistance converge to constitute particular subjectivities across borders.

Beyond Snowden by Timothy H. Edgar Pdf

Safeguarding Our Privacy and Our Values in an Age of Mass Surveillance America’s mass surveillance programs, once secret, can no longer be ignored. While Edward Snowden began the process in 2013 with his leaks of top secret documents, the Obama administration’s own reforms have also helped bring the National Security Agency and its programs of signals intelligence collection out of the shadows. The real question is: What should we do about mass surveillance? Timothy Edgar, a long-time civil liberties activist who worked inside the intelligence community for six years during the Bush and Obama administrations, believes that the NSA’s programs are profound threat to the privacy of everyone in the world. At the same time, he argues that mass surveillance programs can be made consistent with democratic values, if we make the hard choices needed to bring transparency, accountability, privacy, and human rights protections into complex programs of intelligence collection. Although the NSA and other agencies already comply with rules intended to prevent them from spying on Americans, Edgar argues that the rules—most of which date from the 1970s—are inadequate for this century. Reforms adopted during the Obama administration are a good first step but, in his view, do not go nearly far enough. Edgar argues that our communications today—and the national security threats we face—are both global and digital. In the twenty first century, the only way to protect our privacy as Americans is to do a better job of protecting everyone’s privacy. Beyond Surveillance: Privacy, Mass Surveillance, and the Struggle to Reform the NSA explains both why and how we can do this, without sacrificing the vital intelligence capabilities we need to keep ourselves and our allies safe. If we do, we set a positive example for other nations that must confront challenges like terrorism while preserving human rights. The United States already leads the world in mass surveillance. It can lead the world in mass surveillance reform.

Civil Liberties and the Foreign Intelligence Surveillance Act by Donald Musch Pdf

This volume highlights the judicial and legislative tug of war over civil liberties and government actions, focusing on the actions of a little known but important court with direct and significant impact on individual freedoms - The Foreign Intelligence Surveillance Court. The Foreign Intelligence Surveillance Act by Elizabeth B. Bazan Pdf

Recent amendments to the Foreign Intelligence Surveillance act have given the government expanded powers for electronic investigation under the act. Many have voiced concerns that with such broad rules the personal freedoms enshrined in American tradition are in danger, despite the protestations of federal officials who say they will not abuse their authority. Given the current threats to U.S. security and revelations about intelligence failures leading to September 11, 2001, there is a case to be made that national security trumps individual liberty in certain cases. As questions arise over "battlefield detainees" and the fate of those held for undisclosed violations, the importance of law enforcement regulations takes center stage.

Anticipative Criminal Investigation by Marianne F.H. Hirsch Ballin Pdf

The book assesses the adoption of counterterrorism measures in the Netherlands and the United States, which facilitate criminal investigations with a preventive focus (anticipative criminal investigations), from the perspective of rule of law principles. Anticipative criminal investigation has emerged in the legal systems of the Netherlands and the United States as a consequence of counterterrorism approaches where the objective of realizing terrorism prevention is combined with the objective to eventually prosecute and punish terrorists. This book has addressed this new preventive function of criminal justice and identified the rule of law principles limiting the role of criminal investigation in terrorism prevention. The possibilities and limits of criminal investigation in general and of cooperation and the division of responsibilities between law enforcement and intelligence have been addressed in a manner transcending differences between national legal systems. Valuable for academics and practitioners interested in criminal investigation, rule of law and counterterrorism.
