Search and Destroy by Ryan Lovelace Pdf

“You have replaced ‘advice and consent’ with ‘search and destroy.’” —BRETT KAVANAUGH In this deeply researched account, one of Washington’s top legal reporters reveals the massive funding, sophisticated organization, and fanatical zeal behind the campaign to stop Brett Kavanaugh’s appointment to the nation’s highest court. Trump had promised to nominate only Scalia-style “originalists” to the Court—a promise he backed up with a list of potential nominees. The left took him at his word, setting up a titanic political clash when Justice Anthony Kennedy—the decisive vote on abortion—announced his retirement in June 2018. The nomination of Judge Brett Kavanaugh—until that moment universally respected—sent Democratic senators racing to the cameras to announce their opposition, while an armada of activist groups, fueled by “dark money,” launched a coordinated public relations assault of unprecedented scope and fury. Kavanaugh was nevertheless on the brink of confirmation when the Democrats, in desperation, disclosed an allegation of teenaged sexual assault against the stunned nominee, turning Christine Blasey Ford into a #MeToo icon. Ryan Lovelace reports how Kavanaugh’s opponents, unable to produce a shred of corroboration, resorted to the court of public opinion, where the rules of evidence and standards of fairness favor the prosecution. Under the skillful direction of a Clinton henchman and a savvy lawyer, they conducted a show trial in which the compliant media arrived at the desired verdict. Kavanaugh owed his eventual confirmation to the pro-choice Republican senator Susan Collins, whose vote reflected her steel spine and commitment to fairness—“the allegations fail to meet the more-likely-than- not standard”—as well as her conclusion that Roe v. Wade was safe with him on the Court. Lovelace concludes with a thought-provoking assessment of the unexpected consequences of the Kavanaugh controversy and of the cost to the judicial system of a search-and-destroy confirmation process.

Preventing Treaty Abuse by Daniel Blum,Markus Seiler Pdf

Analysis of notion, roots und measures of treaty abuse The OECD initiative on Base Erosion and Profit Shifting has put the issue of treaty abuse and the means to counter it on top of the global political agenda. Preventing treaty abuse is therefore currently one of the most debated topics in international tax law. Diverging national legal traditions in combatting abuse both under domestic and tax treaty law have led to a globally diversified legal framework in this respect and make the OECD’s agenda to harmonize these attempts even more challenging. The aim of this book is to analyze the notion of treaty abuse, its historical roots and the measures to counter it. The book’s topics cover a wide range of both policy and legal issues. The contributions’ main focus lies onanalyzing the proposals put forward by the OECD in BEPS action items 6 and 7. In addition, this book analyzes the lessons which can be learnt from the US tax treaty policy and elaborates on the effects the intensified fight against treaty abuse will have from a Non-OECD member state perspective. Also EU law is taken into account and the question raised which impact the fundamental freedoms might have on the development of new anti-avoidance rules. Finally the relation between domestic and treaty based anti-avoidance is analyzed in great detail, identifying the methodical problems of ensuring a sound and abuse safe legal framework. With this book, the authors and editors hope to contribute to the discussion on selected issues of preventing treaty abuse and the challenges they present to policy makers, judges, tax administrations and tax advisers.

The Max Planck Handbooks in European Public Law by Armin von Bogdandy,Huber Peter M.,Christoph Grabenwarter Pdf

The Max Planck Handbooks in European Public Law series describes and analyzes the public law of the European legal space, an area that encompasses not only the law of the European Union but also the European Convention on Human Rights and, importantly, the domestic public laws of European states. Recognizing that the ongoing vertical and horizontal processes of European integration render legal comparison the task of our time for both scholars and practitioners, the project aims to foster a better understanding of the specific European legal pluralism and, ultimately, to contribute to the legitimacy and efficiency of European public law. The first volume of the series began this endeavour with an appraisal of the evolution of the state and its administration, offering both cross-cutting contributions and specific country reports. The third volume (the second in chronological terms) continues this approach with an in-depth appraisal of constitutional adjudication in various and diverse European countries. Fourteen country reports and two cross-cutting contributions investigate the antecedents, foundations, organization, procedure, and specific approach to constitutional issues throughout the Continent. The fourth volume now compares European constitutional jurisdiction in the European legal space. It examines the structures of the organization, the appointment of judges, the procedures and the methods of argumentation and interpretation, their impact on state and society, their legitimacy as well as their role in the division of powers, and thus completes the picture following the country reports in Volume III. This comparative perspective is supplemented by an examination that illustrates the relationship with the ECJ, the ECtHR, and the Venice Commission as well as their (constitutional) function. Finally, Constitutional Adjudication: Common Themes and Challenges is devoted to the challenges constitutional jurisdiction in the European judicial area is currently facing. The historical, political, and theoretical foundations as well as the basic dogmatic features of constitutional jurisdiction are presented in such a way that the discussion about its role and further development in this legal space is sustainably stimulated.

The most comprehensive guide to all techniques available to European companies, European Cross-Border Mergers and Reorganisations is the ideal reference tool for lawyers, auditors, notaries and scholars working in the field. Providing everything a practitioner needs to co-ordinate a successful cross-border merger, the book analyses the EU Directives and how they have been applied in each of the main EU/EEA member states. The diverging rules for each jurisdiction are highlighted and explained enabling quick comparisons to be made between countries for assessing feasibility of the chosen technique. As well as the requirements, formalities and potential pitfalls of cross-border mergers, each country analysis addresses the relevant aspects of corporate, employment and tax law such as informing shareholders and employees, verification of the legality of the merger, and language requirements. The book also considers other cross-border reorganisation techniques, such as demergers, partial demergers, the transfer of branches of activity, the creation of a Societas Europaea, or a Societas Cooperativa Europea, and the cross-boarder transfer of a company's head office or registered office, providing a practical guide to the best possible solution for a practitioner's client. European Cross-Border Reorganisations: Law and Practice is an easy-to-use reference work for legal, tax and audit professionals involved in mergers.

The Ussr In 1991 by Vera Tolz,Melanie Newton Pdf

This last volume in the annual series chronicles the developments that led up to the abortive August coup, the disintegration of the Soviet Union, and the establishment of the Commonwealth of Independent States. The book is arranged as a day-by-day chronology with boldface headlines identifying individual topics. Among the highlights are analyses of the crackdown in the Baltic republics, the miners' strikes, and the ongoing ethnic warfare in the Transcaucasus; the referendum on the future of the USSR and the prolonged negotiations between the center and the republics over the Union treaty; the emergence of Russia as an alternative center of power; and the banning of the Soviet Communist Party. The volume also documents in depth the failed coup and the political realignment that followed, the disastrous state of the economy, and the discussion of potential future cooperation among the newly independent republics.
