Researching Elites and Power by Francois Denord,Mikael Palme,Bertrand Réau Pdf

This open access book describes how elite studies theoretically and methodologically construct their object, i.e. how particular conceptualizations of elites are turned into research practice using different methods for collecting, dealing with and analyzing empirical data. The first of four sections focuses on what Mills named the power elite and includes Bourdieu’s field of power. The second section addresses studies of the domain of economic power, whereas the third section centers on research on elite education. The fourth and last section highlights research on symbolic power, either within social fields or as a dimension of social structure at large, areas where recognition is essential. All sections comprise empirical case studies of elites and power, whereby each of which makes explicit the various methodological choices made in the research process. Through focusing on methodological approaches for the study of elites and power and on how such approaches relate to each other as well as to the theoretical perspectives that underpin them, this book will be a valuable source for social scientists.

Public Procurement and Labour Rights by Maria Anna Corvaglia Pdf

This book investigates patterns of fragmentation and coherence in the international regulatory architecture of public procurement. In the context of the major international instruments of procurement regulation, the book studies the achievement of social and labour policies, the most controversial and problematic instrumental uses of public procurement practices. This work offers an innovative comparative approach, discussing the ways in which the different international instruments-namely the EU Procurement Directives, the WTO Agreement on Government Procurement, the UNCITRAL Model Law and the World Bank's Procurement Framework-are able to implement labour and social purposes and, at the same time, ensure a regulatory balance with the principles of efficiency and non-discrimination. Scholarly, rigorous and timely, this will be important reading for international trade lawyers and procurement practitioners.

Joint Public Procurement and Innovation by Gabriella Margherita Racca,Christopher Yukins Pdf

Innovation in public procurement is essential for sustainable and inclusive growth in an increasingly globalized economy. To achieve that potential, both the promises and the perils of innovation must be investigated, including the risks and opportunities of joint procurement across borders in the European Union and the United States. This in-depth research investigates innovation in public procurement from three different perspectives. First, leading academics and practitioners assess the purchase of innovation, with a particular focus on urban public contracting in smart cities involving meta-infrastructures, public-private partnership arrangements and smart contracts. A second line of inquiry looks for ways to encourage innovative suppliers. Here, the collected authors draw on emerging lessons from the US and Europe, to explore both the costs and the benefits of spurring innovation through procurement. A third perspective looks to various innovations in the procurement process itself, with a focus on the effects of joint and cross-border procurement in the EU and US landscapes. The chapters review new technologies and platforms, the increasingly automated means of selecting suppliers, and the related efficiencies that “big data” can bring to public procurement. Expanding on research in the editors’ prior volume, Integrity and Efficiency in Sustainable Public Contracts: Balancing Corruption Concerns in Public Procurement Internationally (Bruylant 2014), this volume builds on a series of academic conferences and exchanges to address these issues from sophisticated academic, institutional and practical perspectives, and to point the way to future research on the contractual models that are emerging from new procurement technologies.

Public Procurement and Human Rights by Olga Martin-Ortega,Claire Methven O’Brien Pdf

This timely work reflects on the role and obligations of the state as a buyer of goods and services, from the dual disciplinary perspectives of public procurement and human rights. Through theoretical and doctrinal analyses, and practice-focused case studies, it interrogates the evolving character of public procurement as an interface for multiple normative regimes and competing policies. Challenging the prevailing paradigm which subordinates human rights to narrowly-defined economic goals, insightful contributions advance a compelling case for greater inter-disciplinarity and policy coherence as crucial to realising international policies such as those embodied in the UN Guiding Principles on Business and Human Rights and 2030 Sustainable Development Goals.

Politics of Favoritism in Public Procurement in Turkey by Esra Çeviker Gürakar Pdf

This book, through an analysis of 49,355 high value public procurement contracts awarded between 2004 and 2011, provides systematic evidence on favoritism in public procurement in Turkey. Public procurement is one of the main areas where the government and the private sector interact extensively and is thus open to favoritism and corruption. In Turkey, the new Public Procurement Law, which was drafted with the pull of the EU-IMF-WB nexus, has been amended more than 150 times by the AKP government. In addition to examining favoritism, this book also demonstrates how the legal amendments have increased the use of less competitive procurement methods and discretion in awarding contracts. The results reveal that the AKP majority government has used public procurement as an influential tool both to increase its electoral success, build its own elites and finance politics. The use of public procurement for rent creation and distribution is found to be particularly extensive in the construction and the services sector through the TOKİ projects and the Municipal procurements.

Discretion in EU Public Procurement Law by Sanja Bogojevic,Xavier Groussot,Jörgen Hettne Pdf

The EU public procurement regime has recently undergone an overhaul and now allows Member States and their contracting authorities to pursue strategic goals via public procurement, including environmental and social objectives. The extent to which such interests may be accommodated in the procurement process is ultimately determined by the broader legal context in which the EU public procurement regime exists, which raises pressing questions regarding the scope and limits of Member States' discretion. This volume scrutinises these new legal acts – particularly Directive 2014/24/EU – focusing on discretion and engaging with questions central to the public procurement regime against the EU legal backdrop, including internal market law and environment law, as well as law beyond the EU.

What We Owe Each Other by Minouche Shafik Pdf

From one of the leading policy experts of our time, an urgent rethinking of how we can better support each other to thrive Whether we realize it or not, all of us participate in the social contract every day through mutual obligations among our family, community, place of work, and fellow citizens. Caring for others, paying taxes, and benefiting from public services define the social contract that supports and binds us together as a society. Today, however, our social contract has been broken by changing gender roles, technology, new models of work, aging, and the perils of climate change. Minouche Shafik takes us through stages of life we all experience—raising children, getting educated, falling ill, working, growing old—and shows how a reordering of our societies is possible. Drawing on evidence and examples from around the world, she shows how every country can provide citizens with the basics to have a decent life and be able to contribute to society. But we owe each other more than this. A more generous and inclusive society would also share more risks collectively and ask everyone to contribute for as long as they can so that everyone can fulfill their potential. What We Owe Each Other identifies the key elements of a better social contract that recognizes our interdependencies, supports and invests more in each other, and expects more of individuals in return. Powerful, hopeful, and thought-provoking, What We Owe Each Other provides practical solutions to current challenges and demonstrates how we can build a better society—together.

Shaping EU Public Procurement Law by Albert Sanchez-Graells,Constant De Koninck Pdf

The first part of the book offers a unique reflection on enduring themes in public procurement law such as the shaping of the scope of this regulatory regime, the development of tighter criteria for the exclusion of candidates and tenderers, the conduct of qualitative selection, the consolidation of the court’s previous approach to technical specifications, new developments in tender evaluation, the inclusion of contract performance clauses with a social orientation, and, last but not least, the development of interpretive guidance concerning several aspects of the procurement remedies regime. The book shows that the period 2015–2017 has been an interesting and rather intense period for the development of EU public procurement law, where the CJEU has not only consolidated some parts of its long-standing procurement case law but also introduced significant innovations that can create future challenges for the consistency of this regulatory regime. The first part of the book concludes with some thoughts on some of the salient aspects of this recent episode of silent reform of EU public procurement law through CJEU case law. The second part of the book contains the essential excerpts of forty-one chronologically ordered judgments issued by the CJEU in the period 2015–2017, which have been selected because they either raise new issues or important matters of public procurement law. Each of the selected judgments is followed by an exhaustive and critical in-depth analysis, highlighting and providing insight into its legal and practical issues and consequences. An exhaustive subject-index offers the reader quick and easy access to the case law treated in this book. This unique book, a ‘must-have’ reference work for judges and courts of all EU Member States and candidate countries and academics and legal professionals who are active in the field of procurement law, will also be valuable for law libraries and law schools across the world and for law students who focus their research and studies on EU law.

The Report: Gabon 2013 by Oxford Business Group Pdf

In recent years, the country has sought to accelerate economic diversification, emphasising growth in its industrial, agricultural and service sectors. The second-biggest economy of the Economic and Monetary Community of Central Africa, which the country is chairing in 2013, Gabon has a population of 1.6m, according to the most recent data available from the World Bank. The country benefits from a wide base of natural resources, including large mineral deposits and timber, as well as arable land – all of which have helped feed its export revenues and boost headline indicators. However, it is the oil and gas sector that has been the dominant sector, with the country’s onshore and offshore blocks making it the fifth-largest producer on the continent. Production has been maturing recently, prompting the search to shift to deep-offshore blocks, but also encouraging greater diversification through the government’s Gabon Emergent strategy, which looks to channel capital and activity into key sectors such as tourism and manufacturing.

Government Favouritism in Europe by Alina Mungiu-Pippidi Pdf

This volume on Government Favouritism in Europe reunites the fieldwork of 2014-2015 in the ANTICORRP project. It is entirely based on objective indicators and offers both quantitative and qualitative assessments of the linkage between political corruption and organised crime using statistics on spending, procurement contract data and judicial data. The methodology used in the analysis of particularism of public resource distribution is applicable to any other country where procurement data can be made available and opens the door to a better understanding and control of both systemic corruption and political finance.
