The Organizational Contract by Professor Fabrizio Cafaggi,Professor Giuseppe Vettori,Professor Stefan Grundmann Pdf
This book introduces and develops the paradigm of the organisational contract in European contract law. Suggesting that a more radical distinction should be made between contracts which regulate single or spot exchanges and contracts that organize complex economic activities without creating a new legal entity, the book argues that this distinction goes beyond that between spot and relational contracts because it focuses on the organizational dimension of contracting and its governance features. Divided into six parts, the volume brings together a group of internationally renowned experts to examine the structure of long-term contractual cooperation; networks of contracts; knowledge exchange in long-term contractual cooperation; remedies and specific governance rules in long-term relationships; and the move towards legislation. The book will be of value to academics and researchers in the areas of private law, economic theory and sociology of law, and organizational theory. It will also be a useful resource for practitioners working in international contract law and international business transaction law.

More and more international contracts today are not only drafted in English, but also rely on the principles of Anglo-American common law. This book is intended to provide a general introduction to both the basic common law legal concepts as well as the language of common law contracts. It is intended not only for lawyers and law students, but also business people, negotiators and managers who have to deal with English language contracts as part of their work. Through the use of cases, examples, and by highlighting key differences between common law and civil law an overview is given of the typical contract pitfalls faced in negotiating, drafting, understanding and implementing cross-border contracts. In particular, there is a discussion of the specific translation traps of the English and German language in contracts, and possible solutions are suggested.
Interpreting and Translation Services and the Applied Language Solutions Contract by Great Britain: Parliament: House of Commons: Justice Committee Pdf
Evidence suggests that the MoJ did not have a sufficient understanding of the complexities of court interpreting work. Significant concern was revealed that quality standards could be diminished by the imposition of a tiered system to enable a wider pool of interpreters, and by the introduction of lower levels of pay. However, the Department pushed ahead with the contract and failed to properly anticipate or address the potential for problems with Applied Language Solutions' (ALS) capacity to deliver on its promises. ALS, and more recently Capita, has been unable to recruit qualified and experienced interpreters in sufficient numbers. Professional interpreters have largely boycotted the new arrangements and Capita-ALS clearly needed significantly more resources than it had at its disposal. It also only paid lip service to the regulatory duties accepted under the Framework Agreement, yet did not have the capacity to cope with complaints or to implement basic vetting procedures. The MoJ has had to monitor Capita-ALS very closely to secure the level of improvement necessary to make the Agreement workable, and continues to do so. The existing arrangements may not be financially sustainable as Capita is propping up the continuation of the Agreement, which mean that the Department's savings, originally projected to be £15million, are effectively being secured at the company's expense. Actions taken by MoJ also had the effect of hampering the inquiry when HMCTS issued an edict to its staff instructing them not to participate in the Committee's online consultation, established to invite direct observations from frontline staff of the performance of ALS
