The Law of Innkeepers and Hotels by Joseph Henry Beale Pdf

Excerpt from The Law of Innkeepers and Hotels: Including Other Public Houses, Theatres, Sleeping Cars The law of innkeepers was the earliest developed and is the simplest and clearest of those topics of law which are concerned with the various public-service callings. While its extent is slight, it is of considerable practical importance; and its theoretical interest is great to those who are concerned with the development and application of public-service law. It is the last aspect of the subject which drew the attention of the author to it. The practical importance and the legal interest of the public-service law justify a thorough study and investigation of it in all its applications. The rapid and enormous growth of the modern public-service corporations has outrun the law. The general principles by which they are governed have been apprehended by the courts, and the success of the courts in applying these principles is a new triumph in our time for the plasticity of the common law; but these principles have not in all cases been formulated, after a careful study of their origin and limitations, in a way which is entirely satisfactory; and a careful study of them in all their applications seemed desirable. In a topic of the law which took form within the Middle Ages, it is essential to glance at the history of the life out of which it grew. Some knowledge of life in the inns of medieval England is helpful if not necessary for an understanding of the law of innkeepers. This book therefore begins with a short and necessarily imperfect sketch of the conditions of life which caused the peculiarities of the law. New Democracy by William J. Novak Pdf

The activist state of the New Deal started forming decades before the FDR administration, demonstrating the deep roots of energetic government in America. In the period between the Civil War and the New Deal, American governance was transformed, with momentous implications for social and economic life. A series of legal reforms gradually brought an end to nineteenth-century traditions of local self-government and associative citizenship, replacing them with positive statecraft: governmental activism intended to change how Americans lived and worked through legislation, regulation, and public administration. The last time American public life had been so thoroughly altered was in the late eighteenth century, at the founding and in the years immediately following. William J. Novak shows how Americans translated new conceptions of citizenship, social welfare, and economic democracy into demands for law and policy that delivered public services and vindicated peopleÕs rights. Over the course of decades, Americans progressively discarded earlier understandings of the reach and responsibilities of government and embraced the idea that legislators and administrators in Washington could tackle economic regulation and social-welfare problems. As citizens witnessed the successes of an energetic, interventionist state, they demanded more of the same, calling on politicians and civil servants to address unfair competition and labor exploitation, form public utilities, and reform police power. Arguing against the myth that America was a weak state until the New Deal, New Democracy traces a steadily aggrandizing authority well before the Roosevelt years. The United States was flexing power domestically and intervening on behalf of redistributive goals for far longer than is commonly recognized, putting the lie to libertarian claims that the New Deal was an aberration in American history.

The Laws of Innkeepers by Gwen Seaquist Pdf

Here is the new, completely updated and expanded edition of the indispensable handbook used throughout the hospitality industry since The Laws of Innkeepers first appeared in 1972. Containing all the legal information essential to the successful operation of modern hotels, motels, inns, bed-and-breakfasts, clubs, restaurants, and resorts, the book has been extensively revised by John E. H. Sherry to accomodate the far-reaching changes that have occured since the publication of the revised edition in 1981. Sherry, a practicing lawyer and professor of hotel administration, carries over from the highly praised earlier editions detailed information on the rights and responsibilities of host and guest alike. He cites actual cases—ranging from the amusing and the bizarre to the tragic—as examples, and spells out in precise and readily understandable terms exactly what state and federal law says. Broadening the scope of the book to keep up with recent legal developments, the author includes many new case decisions and sumamries from various jurisdictions. Three chapters devoted to employment law, environmental law and land use, and catastrophic risk liability are among the highlights of the new material. These new sections present recent rulings and case law on such timely topics as age, disability, and AIDS discrimination, as well as sexual harassment; government regulation of toxic and hazardous substances and hotel and resort development; and acts of God and the Public Enemy and terrorism.
