Consumer Law and Socioeconomic Development by Claudia Lima Marques,Dan Wei Pdf

This book reflects the research output of the Committee on the International Protection of Consumers of the International Law Association (ILA). The Committee was created in 2008, with a mandate to study the role of public and private law to protect consumers, review UN Guidelines, and to model laws, international treaties and national legislations concerning protection and consumer redress. It has been accepted to act as an observer not only when the UNCTAD was updating its guidelines, but also at the Hague Conference on Private International Law. The book includes the contributions of various Committee members in the past few years and is a result of the cooperation between the Committee members and experts from Australia, Brazil, Canada and China. It is divided into three parts: the first part addresses trends and challenges in international protection of consumers, while the second part focuses on financial crises and consumer protection and the third part examines national and regional consumer law issues.

Government Paternalism by Julian Le Grand,Bill New Pdf

Should governments save people from themselves? Do governments have the right to influence citizens' behavior related to smoking tobacco, eating too much, not saving enough, drinking alcohol, or taking marijuana—or does this create a nanny state, leading to infantilization, demotivation, and breaches in individual autonomy? Looking at examples from both sides of the Atlantic and around the world, Government Paternalism examines the justifications for, and the prevalence of, government involvement and considers when intervention might or might not be acceptable. Building on developments in philosophy, behavioral economics, and psychology, Julian Le Grand and Bill New explore the roles, boundaries, and responsibilities of the government and its citizens. Le Grand and New investigate specific policy areas, including smoking, saving for pensions, and assisted suicide. They discuss legal restrictions on risky behavior, taxation of harmful activities, and subsidies for beneficial activities. And they pay particular attention to "nudge" or libertarian paternalist proposals that try to change the context in which individuals make decisions so that they make the right ones. Le Grand and New argue that individuals often display "reasoning failure": an inability to achieve the ends that they set themselves. Such instances are ideal for paternalistic interventions—for though such interventions might impinge on autonomy, the impact can be outweighed by an improvement in well-being. Government Paternalism rigorously considers whether the state should guide citizen decision making in positive ways and if so, how this should be achieved.

The Rise and Fall of Corporate Social Responsibility by Douglas M. Eichar Pdf

Corporate social responsibility was one of the most consequential business trends of the twentieth century. Having spent decades burnishing reputations as both great places to work and generous philanthropists, large corporations suddenly abandoned their commitment to their communities and employees during the 1980s and 1990s, indicated by declining job security, health insurance, and corporate giving. Douglas M. Eichar argues that for most of the twentieth century, the benevolence of large corporations functioned to stave off government regulations and unions, as corporations voluntarily adopted more progressive workplace practices or made philanthropic contributions. Eichar contends that as governmental and union threats to managerial prerogatives withered toward the century’s end, so did corporate social responsibility. Today, with shareholder value as their beacon, large corporations have shred their social contract with their employees, decimated unions, avoided taxes, and engaged in all manner of risky practices and corrupt politics. This book is the first to cover the entire history of twentieth-century corporate social responsibility. It provides a valuable perspective from which to revisit the debate concerning the public purpose of large corporations. It also offers new ideas that may transform the public debate about regulating larger corporations.
