From Positivism to Idealism by Sean Coyle Pdf

Illuminating the idea of legality by a consideration of its moral nature, this book explores the emergence and development of two rival traditions of legal thought (those of 'positivism' and 'idealism') which together define the structure of modern juridical thought. In doing so, it consciously departs from many of the tendencies and working assumptions that define modern legal philosophy. The book examines the shifts in thinking about the rule of law and the wider significance of law, brought about by changing conceptions of the nature of law: from an understanding of law in which the primary focus is on rights, to an articulation of the legal order as a body of deliberately posited rules, and finally to the present understanding of law as a systematic body of rules and principles underpinned by an abiding concern with individual rights. By exposing the historical and metaphysical underpinnings of these theoretical traditions, the book imparts an idea of their limitations and moves beyond the understandings offered within them of the nature of legality.

The Enforcement of EU Law and Values by András Jakab,Dimitry Kochenov Pdf

It is clear that the current crisis of the EU is not confined to the Eurozone and the EMU, evidenced in its inability to ensure the compliance of Member States to follow the principles and values underlying the integration project in Europe (including the protection of democracy, the Rule of Law, and human rights). This defiance has affected the Union profoundly, and in a multi-faceted assessment of this phenomenon, The Enforcement of EU Law and Values: Ensuring Member States' Compliance, dissects the essence of this crisis, examining its history and offering coping methods for the years to come. Defiance is not a new concept and this volume explores the richness of EU-level and national-level examples of historical defiance - the French empty chair policy, the Luxembourg compromise, and the FPO crisis in Austria - and draws on the experience of the US legal system and that of the integration projects on other continents. Building on this legal-political context, the book focuses on the assessment of the adequacy of the enforcement mechanisms whilst learning from EU integration history. Structured in four parts, the volume studies (1) theoretical issues on defiance in the context of multi-layered legal orders, (2) EU mechanisms of acquis and values' enforcement, (3) comparative perspective on law-enforcement in multi-layered legal systems, and (4) case-studies of defiance in the EU.

Beyond Positivism, Behaviorism, and Neoinstitutionalism in Economics by Deirdre Nansen McCloskey Pdf

A penetrating analysis from one of the defining voices of contemporary economics. In Beyond Positivism, Behaviorism, and Neoinstitutionalism in Economics, Deirdre Nansen McCloskey zeroes in on the authoritarian cast of recent economics, arguing for a re-focusing on the liberated human. The behaviorist positivism fashionable in the field since the 1930s treats people from the outside. It yielded in Williamson and North a manipulative neo-institutionalism. McCloskey argues that institutions as causes are mainly temporary and intermediate, not ultimate. They are human-made, depending on words, myth, ethics, ideology, history, identity, professionalism, gossip, movies, what your mother taught you. Humans create conversations as they go, in the economy as in the rest of life. In engaging and erudite prose, McCloskey exhibits in detail the scientific failures of neo-institutionalism. She proposes a “humanomics,” an economics with the humans left in. Humanomics keeps theory, quantification, experiment, mathematics, econometrics, though insisting on more true rigor than is usual. It adds what can be learned about the economy from history, philosophy, literature, and all the sciences of humans. McCloskey reaffirms the durability of “market-tested innovation” against the imagined imperfections to be corrected by a perfect government. With her trademark zeal and incisive wit, she rebuilds the foundations of economics.

Latin American Positivism by Gregory D. Gilson,Irving W. Levinson Pdf

"Latin American Positivism: Theory and Practice" examines the role of positivism in the intellectual and political life of three major nations: Colombia, Brazil, and M xico. In doing so, the authors first focus on the intellectual linkages and distinctions between Latin American positivists and their European counterparts. Also, they examine the impact of positivist theory on the political cultures of these nations and the more significant impact of the political and socio-economic cultures of those states upon positivist thought. Rather than asserting that the positivist movement was a moving force that reformatted many Latin American modalities, the authors demonstrate that the dynamics of nineteenth- and twentieth-century Latin American societies altered positivism to a greater extent that the positivists altered these nations.

Human Dignity and the Foundations of International Law by Patrick Capps Pdf

International lawyers have often been interested in the link between their discipline and the foundational issues of jurisprudential method, but little that is systematic has been written on this subject. In this book, an attempt is made to fill this gap by focusing on issues of concept-formation in legal science in general with a view to their application to the specific concerns of international law. In responding to these issues, the author argues that public international law seeks to establish and institutionalise a system of authoritative judgment whereby the conditions by which a community of states can co-exist and co-operate are ensured. A state, in turn, must be understood as ultimately deriving legitimacy from the pursuit of the human dignity of the community it governs, as well as the dignity of those human beings and states affected by its actions in international relations. This argument is in line with a long and now resurgent Kantian tradition in legal and political philosophy. The book shows how this approach is reflected in accepted paradigm cases of international law, such as the United Nations Charter. It then explains how this approach can provide insights into the theoretical foundations of these accepted paradigms, including our understanding of the sources of international law, international legal personality and the design of global institutions.

Positivism and Imagination by Catherine LeGouis Pdf

In this book, Catherine LeGouis examines the work of three nineteenth-century positivist critics, each of whom struggled to overcome the contradictions of attempting to separate esthetic, psychological, and sociological concerns from individual subjectivity. These positivists - staunch believers in the authority of scientific reason inspired by Auguste Comte, J.S. Mill, and Hippolyte Taine - attempted to turn literary criticism into an exact science that would observe and explain not only the social context of literature, but also its esthetics, without recourse to subjectivity based on individual reactions.

BEYOND EMOTIONS - The Path of Positivism by Asha Sougaijam Pdf

Helping oneself to think beyond that negativity can accomplish something worth for a lifetime. Sometimes we just got to accept that some things are never going to work out the way we want them to. We just need to pick ourselves up and keep rolling along through life. Let the past live in the past. Let bygones be gone and make space for better and new memories to create. Be gentle to yourself. Our thoughts and emotions are our psychological drama. One has the choice to use it to enhance one's life or to defeat oneself. To grow or to walk towards one's wellbeing and growth, has nothing to do with reality.
