International Energy Investment Law by Peter D. Cameron Pdf

Many States have also introduced guarantees into their domestic legislation. This multi-tier regime of stability has fundamentally altered the legal framework for energy investors and host States and offers extensive scope for international arbitration in the event of disputes. It is a system that is currently being tested in a number of high-value commercial disputes as a result of a wave of unilateral State action, most evidently in Latin America and East Europe. The protections for investors are being tested as arbitrators develop new notions of legitimate expectations and give content to fair and equitable treatment, while mapping out more precisely the duties which investors have to host States. This book examines critically the interaction between contract and treaty forms of stability in the new multi-tier setting, including two highly detailed regional case studies of Latin America and East Europe. In its concluding section, it looks forward to new challenges arising from climate change, human rights and environmental issues. Readership: Primary: Legal practitioners, arbitrators and academics with an interest in energy law and dispute resolution Secondary: In-house legal departments at energy companies NGO's and government lawyers

The Pursuit of Stability of the Euro Area as a Whole by Luca Lionello Pdf

This book analyses the ongoing reform of the European economic union in the light of the new objective of ‘stability of the euro area as a whole’ in Article 136(3) TFEU. On the basis of the relevant legal sources, it qualifies this objective as the obligation to preserve the existence of the monetary union, the establishment of which was an EU goal laid down in Article 3(4) TEU. While to date the objective has been achieved through fiscal and macroeconomic consolidation in the member states and the activation of stabilisation mechanisms in cases of emergency, the book argues that full stability requires a better system of economic governance, either through a process of partial fiscal centralisation or the return to a more efficient and sustainable market discipline of public finances. It also analyses the concrete legal challenges these raise, including compliance with the conferral principle, the longstanding democratic deficit of the governance and the balance between financial solidarity and fiscal responsibility.

Stability, Sport, and Performance Movement by Joanne Elphinston Pdf

In Stability, Sport, and Performance Movement, renowned physiotherapist and performance consultant Joanne Elphinston teaches that sporting technique is rooted in movement efficiency, stability, symmetry, and balance. These elements work together to ensure that physical restrictions and inefficient muscle recruitment patterns don’t inhibit technical movement goals. The right muscles firing at the right time, and in the right sequence, can help athletes achieve their full physical potential. Elphinston provides clear explanations using applied sports examples, shows how to evaluate movement accurately, and provides a detailed method for improving performance. Filled with Performance Movement guides readers through an approach that has been used with international-level athletes in every sport. A major focus is on injury prevention. Athletes sustain injuries and want to know why they have them and how to prevent them. Sports medicine professionals need to know how to relate their rehabilitation back to sports-specific movement, and coaches need to understand the relationship between injury prevention and performance. This practical guide presents new ways to understand stability as it pertains to injury prevention in sport, bridging the gap between sports science and sports medicine.

The Pursuit of Permanence by Claire Baker,Ian Sinclair,Jenny Lee,Ian Gibbs Pdf

Children in public care complain that they have too many placements. Professionals agree but little is known about the reasons for this instability or how it affects different groups of children. The Pursuit of Permanence explores this core issue for children's services. Based on the largest study of the English care system in recent years, the book examines the children (what they need and what they want), their movements into, out of and within the care system, the nature and quality of their placements and the outcomes (whether the children are settled or happy). It analyses the reasons for movements and outcomes in different groups of children, and the relative impacts of the departments, social work teams and placements. It concludes with suggestions about how the care system should work, what it should offer and how it should be managed and inspected. This detailed, innovative and comprehensive study is essential reading for all professionals and academics involved with fostering, leaving care, adoption and children's services, as well as policy makers and students on social work courses.

In Pursuit of the Public Good by Tom Kent Pdf

Using former cabinet minister and senator Allan J. MacEachen's career in public service as the organizing focus of the collection, contributors contrast the current retreat of government with the activist approach advocated by Allan MacEachen and his generation. They examine whether the public good will be enhanced by continuing retreat or whether that trend is the consequence of policy mistakes that can and should be corrected. In Pursuit of the Public Good addresses a wide range of fields, including politics, economics, social welfare, and public administration, in an engaging and straightforward style. Scholars and general readers alike will find this collection accessible and stimulating.

Nato--the Next Thirty Years by Kenneth A. Myers Pdf

The survival of NATO as a viable alliance is currently challenged by a shift in the strategic balance of power, as well as by global events and contingencies that extend far beyond NATO's boundaries. In the face of these challenges, existing institutional mechanisms are proving inadequate to respond effectively. The distinguished contributors to this volume draw on their vast political and diplomatic experience to identify and analyze the problems confronting NATO for the remainder of the twentieth century. They make clear the need for a trans-Atlantic communication network among policymakers, scholars, and others-a network that will allow an ongoing process of analysis and assessment of NATO's strategic, economic, and political problems, along with the identification of appropriate reactions.

Increasing global financial market integration is presenting new challenges to central banks as they seek to attain low inflation and financial stability. This volume is based on a conference hosted by the IMF in September 2002. The Pursuit of Ecotopia by E. N. Anderson Pdf

The world environmental and social justice crises brought on by our high-throughput global economy can be ameliorated only if we adapt the pragmatic ethics of social cohesion in traditional societies to the modern world. Traditional societies have much to teach the modern world about conservation and environmental management. The Pursuit of Ecotopia: Lessons from Indigenous and Traditional Societies for the Human Ecology of Our Modern World argues that the root of our environmental crisis is that we have not devised modern ways to induce people with diverse interests to think and act cooperatively to secure shared interests. We take a short-term, narrow view of resource management and ethical conduct instead of a long-term, global view of "ecotopia"—a conception in which the destructive corollaries of consumerism are curbed by emotionally grounded policies and ethics of sustainability, social justice, and stewardship. In this controversial and brilliantly written book, author E. N. Anderson maintains that the world can escape impending ecological disaster only by embracing a political and ethical transformation that will imbue modern societies with the same shared sense of emotional rationality practiced by traditional cultures. He draws lessons from ecologically successful traditional societies—and also draws cautionary tales from traditional societies that have responded maladaptively to disruption and failed ecologically as a result.

The Pursuit of Governance by Fabrizio Tassinari Pdf

In a world ravaged by pandemics and climate crises, migration flows and cyberwars, rigid rule-making imparted from above or populist oversimplifications brewing from below can offer only partial and unsatisfactory answers to increasingly complex questions of governance. Tassinari takes inspiration from the Nordic region, where democratic governance has delivered some of its most impressive feats. He shows that populism and technocracy are not the causes of our political malaise, but represent skewed by-products of the most basic instincts in our body politic and need to be channeled and reconciled in our practices of governing.
