Competition Law Reform in Britain and Japan by Kenji Suzuki Pdf

As market competition replaces state regulation in many economic fields, competition policy has become an area of increasing significance. Against this background, Suzuki highlights the importance of the domestic political structure for competition policy. He does this through the comparative analysis of competition law reforms in Britain and Japan. He argues - controversially - that a country's domestic political structure should be considered a major factor in causing the reform of competition law, and rejects the established view that it is necessarily a result of changes in international economic and political conditions.

Comparative Competition Policy by G. Bruce Doern,Stephen Wilks Pdf

This book provides definitive (and in some cases unique) studies of the six 'model' regimes of the USA, Germany, Japan, the United Kingdom, and the European Union. Each chapter is written by eminent country specialists, is based on original research, and is up to date. The comparative dimension is presented in explicit introductory and concluding chapters but the comparison is also set in the context of the globalization of economic activity and the internationalization of policy.

Cooperation Between Antitrust Agencies at the International Level by Bruno Zanettin Pdf

The issue of international antitrust enforcement is high on the agenda for both developed and developing countries. Bilateral cooperation between antitrust agencies, in particular the European Commission and US agencies, is the focus of this new work. It first shows how bilateral cooperation was developed as a response to the limits of the unilateral and extraterritorial application of national competition laws, and how it has evolved from an instrument initially designed to avoid conflicts into a tool aimed at coordinating joint investigations of international competition cases. It then considers how bilateral cooperation could be used optimally, by analysing two forms of advanced cooperation: the exchange of confidential information, and positive comity, which is the only satisfactory answer competition law can provide to market access cases. It shows that the use of such instruments is limited by significant legal and political obstacles, even in the context of the exemplary EC US relationship. The book therefore argues that the efficient use of bilateral cooperation will be limited to a small number of well-established competition agencies. If international anticompetitive practices are to be efficiently addressed by an increasingly large and heterogeneous group of competition agencies, horizontal cooperation between antitrust agencies must be complemented by a multilateral and supranational solution going beyond proposals currently put forward. The book concludes that only the WTO and its dispute settlement system could provide the basis for such a system.

The Oxford Handbook of Business and Government by David Coen,Wyn Grant,Graham Wilson Pdf

Business is one of the major power centres in modern society. The state seeks to check and channel that power so as to serve broader public policy objectives. However, if the way in which business is governed is ineffective or over burdensome, it may become more difficult to achieve desired goals such as economic growth or higher levels of employment. In a period of international economic crisis, the study of how business and government relate to each other in different countries is of more central importance than ever. These relationships have been studied from a number of different disciplinary perspectives - business studies, economics, economic history, law, and political science - and all of these are represented in this handbook. The first part of the book provides an introduction to the ways in which five different disciplines have approached the study of business and government. The second section, on the firm and the state, looks at how these entities interact in different settings, emphasising such phenomena as the global firm and varieties of capitalism. The third section examines how business interacts with government in different parts of the world, including the United States, the EU, China, Japan and South America. The fourth section reviews changing patterns of market governance through a unifying theme of the role of regulation. Business-government relations can play out in divergent ways in different policy and the fifth section examines the contrasts between different key arenas such as competition policy, trade policy, training policy and environmental policy. The volume provides an authoritative overview with chapters by leading authorities on the current state of knowledge of business-government relations, but also points to ways in which this work might be developed in the future, e.g., through a political theory of the firm.

Public Policy and Economic Competition in Japan by Michael L. Beeman Pdf

Viewed historically as the lapdog of business, bureaucratic and political interests, Japan's Fair Trade Commission has had mixed success in promoting its agenda for stronger antimonopoly policy since the early 1970s. Dr. Beeman unravels antimonopoly politics in Japan through an analysis of the diverse interests of industry, government, and other parties to reveal how and why antimonopoly policy has made important inroads yet ultimately failed to gain deep acceptance in Japan. Employing extensive use of primary research materials and numerous interviews, Dr. Beeman finds predictable patterns of change as well as themes of continuity in the development of Japan's antimonopoly policy. By addressing a broad array of industry sectors and policy issues, the book provides fresh insight into an agency and a policy that have often been criticized from within Japan as too stringent and from outside Japan as too lax.

Japan and the European Union by Atsuko Abe Pdf

"In Japan and the European Union, Dr. Abe sets out to answer a number of crucial questions on the effect of Japan's international relations upon its internal affairs - in particular how international issues, and Japan's growing relationship with the EU, have come to penetrate the political economy and decision-making structure in Japanese industry and legislation. Japan/EU affairs have never been marked by any significant political relations, and until the past twenty years, characterised by a reserved indifference. However, as a result of accelerated political and economic changes in the past decade, the two economic giants have made considerable efforts to nurture bilateral relations largely initiated by trade concerns. The author examines the development of this relationship informed by International Relations perspectives and taking into account the growing dependence of successful bilateral relations on the international political economy." "Furthermore, Dr. Abe explains the attempt that has been made to resolve Japanese/EU disputes by way of a Joint Declaration. This includes an examination of the 1991 Automobile Agreement involving Japan, the EC Commission and the Japanese manufacturers; and the Liquor Tax dispute which ran from 1986-1995. Throughout this account, the concerns of the United States, and its impact on this relationship, are fully registered."--BOOK JACKET.Title Summary field provided by Blackwell North America, Inc. Japanese Inward Investment in UK Car Manufacturing by Young-Chan Kim Pdf

This title was first published in 2002. This compelling text provides fresh insight into an area that is often touched upon, but rarely examined in any great detail - the relationship between Multinational Enterprises (MNEs) and their host governments. Taking Japanese Foreign Direct Investment (FDI) strategy, arguably the model of FDI, Young-Chan Kim takes a revealing look at why the United Kingdom (UK) has dominated among the EU member states for FDI destination, while ironically losing its nationalized car manufacturers. Scholars of business history, international business and business economics will find this work invaluable.
