Law and legal discourse both presuppose and produce legal subjects. Views on the nature of the legal subject will constantly shift, therefore, with changes in the law. Contextual Subjects argues that a new view of the legal subject has indeed emerged and that it is now embedded in the social context and relationships. This claim is developed through a contrast of Canadian family law and administrative law as it was in the mid-twentieth century and as it is today. Robert Leckey argues that it is not only the subject that is contextual. Legal discourse and adjudication have also become more contextual, making family law and administrative law themselves contextual subjects. Leckey bolsters this argument through the use of relational theory, a rich strand of feminist political theory that advocates a contextual method and seeks to promote constructive relationships that enable relational autonomy. Developments in family law and administrative law, therefore, exemplify the contextualism called for by relational theorists. Leckey points to the importance of contextualization, but he is not uncritical of relational theory, insisting that it should articulate more forcefully its normative vision of good relationships and offer clear recommendations in contested areas. Contextual Subjects is the most thorough and sustained application of relational theory to legal examples to appear to date. It is unique in Canadian legal scholarship for the way it pairs family law and administrative law, and within legal scholarship in English for its integration of common law and civil law.

On the other, it deals with the various answers coming from the local populations in terms of resistance, negotiation, and construction of social identity.

Rising Subjects explores the change of the public sphere in Russian Poland during the 1905 Revolution. The 1905 Revolution was one of the few bottom-up political transformations and general democratizations in Polish history. It was a popular rebellion fostering political participation of the working class. The infringement of previously carefully guarded limits of the public sphere triggered a powerful conservative reaction among the commercial and landed elites, and frightened the intelligentsia. Polish nationalists promised to eliminate the revolutionary “anarchy” and gave meaning to the sense of disappointment after the revolution. This study considers the 1905 Revolution as a tipping point for the ongoing developments of the public sphere. It addresses the question of Polish socialism, nationalism, and antisemitism. Dangerous Subjects describes the life and times of James D. Saules, a black sailor who was shipwrecked off the coast of Oregon and settled there in 1841. Before landing in Oregon, Saules traveled the world as a whaleman in the South Pacific and later as a crew member of the United States Exploring Expedition. Saules resided in the Pacific Northwest for just two years before a major wave of Anglo-American immigrants arrived in covered wagons. In Oregon, Saules encountered a multiethnic population already transformed by colonialism--in particular, the fur industry and Protestant missionaries. Once the Oregon Trail emigrants began arriving in large numbers, in 1843, Saules had to adapt to a new reality in which Anglo-American settlers persistently sought to marginalize and exclude black residents from the region. Unlike Saules, who adapted and thrived in Oregon's multiethnic milieu, the settler colonists sought to remake Oregon as a white man's country. They used race as shorthand to determine which previous inhabitants would be included and which would be excluded. Saules inspired and later had to contend with a web of black exclusion laws designed to deny black people citizenship, mobility, and land. In Dangerous Subjects, Kenneth Coleman sheds light on a neglected chapter in Oregon's history. His book will be welcomed by scholars in the fields of western history and ethnic studies, as well as general readers interested in early Oregon and its history of racial exclusion.
