Judgments of personal identity stand at the heart of our daily transactions. Family life, friendships, institutions of justice, and systems of compensation all rely on our ability to reidentify people. It is not as obvious as it might at first appear just how to express this relation between facts about personal identity and practical interests in a philosophical account of personal identity. A natural thought is that whatever relation is proposed as the one which constitutes the sameness of a person must be important to us in just the way identity is. This simple understanding of the connection between personal identity and practical concerns has serious difficulties, however. One is that the relations that underlie our practical judgments do not seem suited to providing a metaphysical account of the basic, literal continuation of an entity. Another is that the practical interests we associate with identity are many and varied and it seems impossible that a single relation could simultaneously capture what is necessary and sufficient for all of them. Staying Alive offers a new way of thinking about the relation between personal identity and practical interests which allows us to overcome these difficulties and to offer a view in which the most basic and literal facts about personal identity are inherently connected to practical concerns. This account, the 'Person Life View', sees persons as unified loci of practical interaction, and defines the identity of a person in terms of the unity of a characteristic kind of life made up of dynamic interactions among biological, psychological, and social attributes and functions mediated through social and cultural infrastructure.

What emerges in this second book of the trilogy is that the very “ground” and content of experience is richer than what can be reduced to a particular account of it. As such, dialogue develops from the “natural” diversity of what is “of” faith and what is “of” reason. Neither faith nor reason, however, originates “from” experience; rather, both are “witnessed” in experience. In other words, taking up questions about the nature of man, whether philosophically, psychologically or in terms of social structures, manifests both a variety of points of departure and, at the same time, the manifold conversations that are possible in the “field of culture”.Focusing particularly on the work of St. John Paul II, the first essay examines the answer of reason and the answer of faith to the same question: What is man? In this classic study, Alan Brudner investigates the basic structure of the common law of transactions. For decades, that structure has been the subject of intense debate between formalists, who say that transactional law is a private law for interacting parties, and functionalists, who say that it is a public law serving the collective ends of society. Against both camps, Brudner proposes a synthesis of formalism and functionalism in which private law is modified by a common good without being subservient to it. Drawing on Hegel's legal philosophy, the author exhibits this synthesis in each of transactional law's main divisions: property, contract, unjust enrichment, and tort. Each is a whole composed of private-law and public-law parts that complement each other, and the idea connecting the parts to each other is also latently present in each. Moreover, Brudner argues, a single narrative thread connects the divisions of transactional law to each other. Not a row of disconnected fields, transactional law is rather a story about the realization in law of the agent's claim to be a dignified end-master of its body, its acquisitions, and the shape of its life. Transactional law's divisions are stages in the progress toward that goal, each generating a potential developed by the next. Thus, contract law fulfils what is incompletely realized in property law, negligence law what is germinal in contract law, public insurance what is seminal in negligence law, and transactional law as a whole what is underdeveloped in public insurance. The end point is the limit of what a transactional law can contribute to a life sufficient for dignity. Reconfigured and expanded with a contribution by Jennifer Nadler, The Unity of the Common Law stands out among contemporary theories of private law in that it depicts private law as purposive without being instrumental and as autonomous without being emptily formal.
