An Argument Open to All by Sanford Levinson Pdf

In An Argument Open to All, renowned legal scholar Sanford Levinson takes a novel approach to what is perhaps America’s most famous political tract. Rather than concern himself with the authors as historical figures, or how The Federalist helps us understand the original intent of the framers of the Constitution, Levinson examines each essay for the political wisdom it can offer us today. In eighty-five short essays, each keyed to a different essay in The Federalist, he considers such questions as whether present generations can rethink their constitutional arrangements; how much effort we should exert to preserve America’s traditional culture; and whether The Federalist’s arguments even suggest the desirability of world government.

The Concept of Argument by Harald R. Wohlrapp Pdf

Arguing that our attachment to Aristotelian modes of discourse makes a revision of their conceptual foundations long overdue, the author proposes the consideration of unacknowledged factors that play a central role in argument itself. These are in particular the subjective imprint and the dynamics of argumentation. Their inclusion in a four-dimensional framework (subjective-objective, structural-procedural) and the focus on thesis validity allow for a more realistic view of our discourse practice. Exhaustive analyses of fascinating historical and contemporary arguments are provided. These range from Columbus’s advocacy of the Western Passage to India, over the trial of King Louis XVI during the French Revolution, to today’s highly charged controversies surrounding euthanasia and embryo research. Excavating foundational issues such as the purpose of argument itself (assent of an audience or critical examination of validity claims) and the contested role of argument as a generator of knowledge, the book culminates in a discussion of the relationship between rationality and reasonableness and criticizes the restrictions of ‘rational’ argument relying on fixed logical, economic or cultural criteria that in reality are mutable. Here, a true, open argument requires the infusion of Paul Lorenzen’s principle of ‘transsubjectivity’, which recognizes but transcends the partiality of the individual and which can be seen in the pragmatic and expanding consensus that humanity can control itself to safeguard the future of a fragile, damaged world.

Open Society Unresolved by Christof Royer,Liviu Matei Pdf

Is the concept of open society still relevant in the 21st century? Do the current social, moral, and political realities call for a drastic revision of this concept? Here fifteen essays address real-world contemporary challenges to open society from a variety of perspectives. What unites the individual authors and chapters is an interest in open society’s continuing usefulness and relevance to address current problems. And what distinguishes them is a rich variety of geographical and cultural backgrounds, and a wide range of academic disciplines and traditions. While focusing on probing the contemporary relevance of the concept, several chapters approach it historically. The book features a comprehensive introduction to the history and current ‘uses’ of the theory of open society. The authors link the concept to contemporary themes including education, Artificial Intelligence, cognitive science, African cosmology, colonialism, and feminism. The diversity of viewpoints in the analysis reflects a commitment to plurality that is at the heart of this book and of the idea of open society itself.

Speech and Debate as Civic Education by J. Michael Hogan,Jessica A. Kurr,Michael J. Bergmaier,Jeremy D. Johnson Pdf

In an era increasingly marked by polarized and unproductive political debates, this volume makes the case for a renewed emphasis on teaching speech and debate, both in and outside of the classroom. Speech and debate education leads students to better understand their First Amendment rights and the power of speaking. It teaches them to work together collaboratively to solve problems, and it encourages critical thinking, reasoned and fact-based argumentation, and respect for differing viewpoints in our increasingly diverse and global society. Highlighting the need for more emphasis on the ethics and skills of democratic deliberation, the contributors to this volume—leading scholars, teachers, and coaches in speech and debate programs around the country—offer new ideas for reinvigorating curricular and co-curricular speech and debate by recovering and reinventing their historical mission as civic education. Combining historical case studies, theoretical reflections, and reports on programs that utilize rhetorical pedagogies to educate for citizenship, Speech and Debate as Civic Education is a first-of-its-kind collection of the best ideas for reinventing and revitalizing the civic mission of speech and debate for a new generation of students. In addition to the editors, the contributors to this volume include Jenn Anderson, Michael D. Bartanen, Ann Crigler, Sara A. Mehltretter Drury, David A. Frank, G. Thomas Goodnight, Ronald Walter Greene, Taylor W. Hahn, Darrin Hicks, Edward A. Hinck, Jin Huang, Una Kimokeo-Goes, Rebecca A. Kuehl, Lorand Laskai, Tim Lewis, Robert S. Littlefield, Allan D. Amending America's Unwritten Constitution by Richard Albert,Ryan C. Williams,Yaniv Roznai Pdf

It is well known that the US Constitution has been amended twenty-seven times since its creation in 1787, but that number does not reflect the true extent of constitutional change in America. Although the Constitution is globally recognized as a written text, it consists also of unwritten rules and principles that are just as important, such as precedents, customs, traditions, norms, presuppositions, and more. These, too, have been amended, but how does that process work? In this book, leading scholars of law, history, philosophy, and political science consider the many theoretical, conceptual, and practical dimensions of what it means to amend America's 'unwritten Constitution': how to change the rules, who may legitimately do it, why leaders may find it politically expedient to enact written instead of unwritten amendments, and whether anything is lost by changing the constitution without a codified constitutional amendment.
