Anti-Social Behaviour in Northern Ireland by Brendan Sturgeon Pdf

Anti-social behaviour has rapidly emerged as one of the most pressing concerns facing the UK. There are frequent media reports on the issue. Many academics and policy makers have also attempted to define the term and analyze why such disorder happens. The research has been extremely valuable, but few studies have specifically analyzed the issue of anti-social behaviour in Northern Ireland. This book seeks to fill this gap in knowledge. This study considers whether certain aspects of the Troubles in Northern Ireland could be considered as anti-social behaviour in retrospect. It also analyzes the role paramilitary groups played in dealing with incidents of disorder during this period of time. In addition, the book evaluates what impact political settlement has had on the perceptions of anti-social behaviour in the country. The study also explains some of the theoretical problems associated with the term in order to facilitate the specific evaluation of the issue in Northern Ireland. The analysis of what the term represents, the causes and the impact, offers a constructive insight into how best to respond to the problem of anti-social behaviour in the future.

Law in Northern Ireland by Brice Dickson Pdf

This textbook presents an engaging and thorough examination of the law in Northern Ireland. It guides students through the evolution of law-making, the legislative process, courts, and case law and presents a clear overview of the fundamental rules and principles of international law, public law, criminal law, and private law. It contextualises the myriad legal institutions operating in the jurisdiction, sets out how criminal and civil proceedings work in practice, and provides useful information on how people become lawyers, what lawyers actually do once they become qualified, and how the legal system is funded. The appendices set out sample sources of law so that readers can familiarise themselves with what is involved in handling legal documents. This edition has been updated following recent legal developments in Northern Ireland including the 'New Decade, New Approach' agreement of 2020 and the different elements of the power-sharing government, such as the proposed Languages Bill and the Northern Ireland (Ministers, Elections and Petitions of Concern) Bill. It explains the effect of Brexit, in particular the new concept of 'retained EU law' and the effect of the Ireland / Northern Ireland Protocol to the EU-UK Withdrawal Agreement. Setting out the implications of the recent UK-wide reviews of administrative law and the Human Rights Act for Northern Ireland, the book examines the work of the shadow Civil Justice Council and Family Justice Board and looks at the latest developments in the reform of abortion law. It explores new Assembly legislation that addresses the use of committal proceedings in criminal cases, the protection afforded to victims of domestic violence, and the rights of other victims, for example in relation to compensation for victims and survivors of the troubles and the appointment of an interim Victims of Crime Commissioner.

Children, Young People and the Press in a Transitioning Society by Faith Gordon Pdf

This book assesses the implications of how children and young people are represented in print media in Northern Ireland – a post-conflict transitioning society. Gordon analyses how children and young people’s perceived involvement in anti-social and criminal behaviour is constructed and amplified in media, as well as in popular and political discourses. Drawing on deviancy amplification, folk devils and moral panics, this original study specifically addresses the labelling perspective and confirms that young people are convenient scapegoats – where their negative reputation diverts attention from the structural and institutional issues that are inevitable in a post-conflict society. Alongside content analysis from six months of print media and a case study on the representation of youth involvement in ‘sectarian’ rioting, this book also analyses interviews with editors, journalists, politicians, policy makers and a spokesperson for the Police Service of Northern Ireland. Noting the importance of prioritising the experiences of children, young people and their advocates, this timely and engaging research will be of specific interest to scholars and students of criminal justice, criminology, socio-legal studies, sociology, social policy, media studies, politics and law, as well as media professionals and policy makers.

Policing in Northern Ireland by Desmond Rea,Robin Masefield Pdf

The Independent Commission On Policing For Northern Ireland, headed by Lord Patten, concluded in its 1999 report 'A new beginning for democratic accountability is key to a new beginning for policing and to involving the community as a whole in the delivery of policing. We recommend that an entirely new Policing Board be created ...'. This book is about the delivery of that 'new beginning for policing' in Northern Ireland, achieved at a time when most commentators considered the Policing Board was itself likely to fragment along traditional community lines. The story of the Policing Board, from its establishment in 2001 through to the reconstitution of the membership in 2009 is in many ways an inspirational one, showing what can be done by politicians and community representatives working together to bring about a fundamentally different way of policing that better meets the needs of the whole community. It offers valuable lessons and contemporary insights for law enforcement officers, accountability 'bodies' and academics world-wide, in key areas, including the need for a police service's composition to reflect the community that it serves; promoting public confidence in policing and policing with the community; upholding human rights in the context of policing civil unrest and terrorism; how to hold a police service to account while providing the support it requires; and dealing with the legacy of inter-communal violence with over 3,500 deaths. Drawing largely on publicly available material, it is an account by two individuals uniquely well-placed to produce an authoritative record: Professor Sir Desmond Rea, the Policing Board's Chairman for its first eight and a half years, and Robin Masefield, the senior civil servant who headed the British Government's team implementing the recommendations of the Independent Commission.

The Routledge International Handbook of Criminology and Human Rights by Leanne Weber,Elaine Fishwick,Marinella Marmo Pdf

The Routledge International Handbook of Criminology and Human Rights brings together a diverse body of work from around the globe and across a wide range of criminological topics and perspectives, united by its critical application of human rights law and principles. This collection explores the interdisciplinary reach of criminology and is the first of its kind to link criminology and human rights. This text is divided into six sections, each with an introduction and an overview provided by one of the editors. The opening section makes an assessment of the current standing of human rights within the discipline. Each of the remaining sections corresponds to a substantive area of harm prevention and social control which together make up the main core of contemporary criminology, namely: criminal law in practice; transitional justice, peacemaking and community safety; policing in all its guises; traditional and emerging approaches to criminal justice; and penality, both within and beyond the prison. This Handbook forms an authoritative foundation on which future teaching and research about human rights and criminology can be built. This multi-disciplinary text is an essential companion for criminologists, sociologists, legal scholars and political scientists.

Judicial Review in Northern Ireland by Gordon Anthony Pdf

The 3rd edition of this leading text provides a detailed account of the purposes of judicial review; the nature of the public-private divide in Northern Ireland law; the judicial review procedure; the grounds for review; and remedies. As with the previous editions, the focus is on case law that is unique to Northern Ireland, and the book identifies some important differences between principle and practice in Northern Ireland and England and Wales. These now include differences resulting from the Ireland-Northern Ireland Protocol (as amended by the Windsor Framework), and this edition explains how and when EU law continues to apply in Northern Ireland. It also considers the leading Human Rights Act decisions of the Northern Ireland courts and the House of Lords and UK Supreme Court. The new edition refers to case law from the courts in England and Wales and Scotland; the Court of Justice of the European Union; and the European Court of Human Rights. There is a particular focus on recent rulings of the High Court and Court of Appeal in Northern Ireland and of rulings of the Supreme Court in cases heard on appeal from Northern Ireland. It considers the main points of the Judicial Review Practice Direction 03-2018 and surveys the European Union (Withdrawal) Act 2018 and its implications for Northern Ireland (including the incorporation of the Ireland-Northern Ireland Protocol, as amended by the Windsor Framework). The book will be of use to practitioners in Northern Ireland and the rest of the UK, and also to those involved in the study of judicial reasoning in different jurisdictions (both within the UK and elsewhere).
