Le paradoxe est manifeste : les élargissements seraient bénéfiques alors que l'Union resterait insaisissable, bureaucratique, éloignée des citoyens, voire rejetée. De plus, le renforcement de ta cohésion sociale et de la responsabilité démocratique est également nécessaire pour augmenter l'efficacité communautaire: la problématique dépasse ainsi largement la légitimation citoyenne. Cet enjeu concerne évidemment la capacité d'intégration future de l'UE mais aussi la Politique de Voisinage car il s'agit bien de ta mise en place, avec te concours des Etats frontaliers, d'une "zone " de voisinage au fonctionnement démocratique compatible et organisé dans le cadre d'Etats de droit et dans le respect des droits de l'homme. La liaison entre les élargissements et la politique de voisinage dépasse cependant ce seul aspect politique, de fait assez abstrait: la PEV évolue en fonction des élargissements qui modifient les frontières. délimitent te voisinage et, en conséquence, déterminent le contenu même de la PEV. La relance du processus de Barcelone (pour les frontières maritimes) comme la mise en place d'une coopération régionale dans la région de la Mer Noire (pour les frontières terrestres) illustrent cette détermination. Néanmoins, la PEV ne fonctionne pas seulement par rapport aux conséquences des élargissements, aux volontés politiques de l'UE ou à la pertinence et à l'efficacité des instruments proposés mais repose avant tout sur une logique de coopération et, donc, s'appuie sur l'histoire même des relations entre Etats de l'UE et Etats du voisinage, l'interlocuteur étant désormais l'UE elle-même. Globalement, les voisins de l'UE, tels que définis par ta PEV sont non seulement situés en "périphérie" de l'Union mais ont également au moins trois autres caractéristiques: ils ont des progrès à faire en matière de droits de l'Homme, ils sont volontaires pour coopérer avec l'Union dans le cadre d'une "relation asymétrique" avec elle (ce qui explique te caractère particulier des relations UE-Russie) et ils n'ont pas, à moyen terme, vocation à adhérer à l'UE. La PEV est ambivalente: à la fois élargissement sans les institutions communautaires et instrument politique d'une Union européenne qui en-tend affirmer sa puissance. Les contributions proposées dans cet ouvrage déclinent explicitement la liaison entre élargissement et PEV et implicitement, souvent, cette ambivalence, dans le cadre d'une confrontation d'universitaires issus d'une dizaine de pays. membres "anciens" ou "nouveaux" de l'UE. "voisins" ou candidats à l'adhésion. Among the criteria for accession to the European Union are democracy and the Rule of Law. In the insightful analysis offered by the author of this book, these concepts - while admirable and even necessary criteria in principle - are almost impossible to measure, and any judgement grounded in them will always be difficult to justify. In his words, 'by including analysis of democracy and the Rule of Law within the field of the EU enlargement law, the Union entered an unstable terrain of vague causal connections and blurred definitions.' Dr Kochenov addresses this problem by proceeding as follows: 1. Outlining EU enlargement law in general, including the principle of conditionality and the role played by the analysis of democracy and the Rule of Law in enlargement preparation; 2. Focusing on the role actually played by the monitoring of democracy and the Rule of Law in ten candidate countries, scrutinizing the way the EU used the legal tools and competences outlined in its enlargement law. The book adopts the EU's own understanding of democracy and the Rule of Law, as derived directly from the substance of the numerous legal and political instruments issued by the Community Institutions and especially the Commission in the course of the pre-accession process. In this way it demonstrates the actual - as opposed to the officially announced - role played by the assessment of democracy and the Rule of Law in the candidate countries in the regulation of enlargement.
