The Battle for Welfare Rights chronicles an American war on poverty fought first and foremost by poor people themselves. Judicial interpretation of federal statutes has often been at the center of political controversy in recent years. In fact, it would be difficult to find a major domestic policy area in which statutory interpretation by the federal courts has not played a significant role in shaping the activities of government. In most important cases, judges base their interpretation not on the letter of the law, but on their reading of its history, purpose, and spirit. What judges discover between the lines of statutes often has major policy consequences. This book examines how statutory interpretation has affected the development of three programs: Aid to Families with Dependent Children, education for the handicapped, and food stamps. It explores how these decisions have changed state and national policies and how other institutions—especially Congress—have reacted to them. Although these three programs differ in several important ways, in each instance court action has expanded program benefits and increased federal control over state and local governments. R. Shep Melnick ties trends in statutory interpretation to broader policy developments, including the expansion of the agenda of national government, the persistence of divided government, and the resurgence and decentralization of Congress. He demonstrates that Congress frequently modifies or overturns court rulings, and he explains why statutory interpretation became so controversial in the 1980s. The Promise of Welfare in the Postwar British Novel offers a new literary history of the Second World War and its aftermath by focusing on wartime visions of rebuilding Britain. Shifting attention from the "People's War" to the "People's Peace," this book shows that literature returns to the historic transition from warfare to welfare to narrate its transformative social potential and darker failures. The welfare state envisioned that managing individuals' private lives would result in a more coherent and equitable community, a promise encapsulated in the 1942 Beveridge Report's promise of care from the "cradle to the grave." The postwar novel reveals the intimate effects that follow when infrastructures of collective living seek to organize social interaction, tracing these effects through quasi-administrated home spaces such as girls' hostels, makeshift sanatoria, and experimental schools. Mid-century writers including Elizabeth Bowen, Muriel Spark, and Samuel Selvon used the militarized Home Front to present postwar Britain as a zone of lost privacy and new collective logics. As the century progressed, and as the unrealized dreams of welfare came to be dismantled, authors including Alan Hollinghurst, Michael Ondaatje, and Kazuo Ishiguro registered an unfulfilled nostalgia for a Britain that never was, situating British domestic policies within trajectories of historic and social violence. These campaigns helped expand the nation's penal system, discredit welfare programs, and cast blame for the era's social upheaval on racialized deviants that the state was not accountable to serve or represent. Getting Tough sheds light on how this unprecedented growth of the penal system and the evisceration of the nation's welfare programs developed hand in hand. Julilly Kohler-Hausmann shows that these historical events were animated by struggles over how to interpret and respond to the inequality and disorder that crested during this period. When social movements and the slowing economy destabilized the U.S. welfare state, politicians reacted by repudiating the commitment to individual rehabilitation that had governed penal and social programs for decades. In its place, they championed strategies of punishment, surveillance, and containment. The architects of these tough strategies insisted they were necessary, given the failure of liberal social programs and the supposed pathological culture within poor African American and Latino communities. Kohler-Hausmann rejects this explanation and describes how the spectacle of enacting punitive policies convinced many Americans that social investment was counterproductive and the "underclass" could be managed only through coercion and force. Getting Tough illuminates this narrative through three legislative cases: New York's adoption of the 1973 Rockefeller drug laws, Illinois's and California's attempts to reform welfare through criminalization and work mandates, and California's passing of a 1976 sentencing law that abandoned rehabilitation as an aim of incarceration.
