Murphy's wide-ranging and in-depth 2002 survey of U.S. practice in international law in the period 1999–2001 draws upon the statements and actions of the executive, legislative and judicial branches of the U.S. government to examine its involvement across a range of areas. These areas include diplomatic and consular relations, jurisdiction and immunities, state responsibility and liability, international organizations, international economic law, human rights, and international criminal law. Fundamentals of International Aviation by Suzanne K. Kearns Pdf

International aviation is a massive and complex industry that is crucial to our global economy and way of life. Designed for the next generation of aviation professionals, Fundamentals of International Aviation, second edition, flips the traditional approach to aviation education. Instead of focusing on one career in one country, it introduces readers to the air transport sector on a global scale with a broad view of all the interconnected professional groups. This text provides a foundation of ‘how aviation works’ in preparation for any career in the field (including regulators, maintenance engineers, pilots, flight attendants, airline and airport managers, dispatchers, and air traffic controllers, among many others). Each chapter introduces a different cross-section of the industry, from air law to operations, security to environmental impacts. A variety of learning tools are built into each chapter, including 24 case studies that describe an aviation accident related to each topic. This second edition adds new learning features, geographic representation from Africa, a new chapter on economics, full-color illustrations, and updated and enhanced online resources. This accessible and engaging textbook provides a foundation of industry awareness that will support a range of aviation careers. It also offers current air transport professionals an enriched understanding of the practices and challenges that make up the rich fabric of international aviation.

Beyond Open Skies by Brian F. Havel Pdf

'Beyond Open Skies' offers a systematic comparative analysis of the legal and policy dimensions of airline deregulation by federal fiat in the United States and by supranational collaboration in the European Union. The book draws upon a variety of sources, including very recent developments in U.S. and EC international aviation law, policy, and diplomacy, to propose a genuine multilateral air transport system. It examines the potential of the 'open skies' initiative, in the aftermath of the new U.S./EC air transport agreement, to inspire a genuine globalization of the world's air transport industry in such crucial aspects as the following: cabotage; ownership and citizenship requirements; route selection; airline identity; capacity; pricing regimes; competition and public aid; regulatory harmonization; labor laws; provisions for charter and/or cargo transportation; fair operation of and access to computer reservations systems; authorization of code-sharing arrangements; alliances and antitrust immunity; and dispute resolution.

Convention on International Civil Aviation by Ruwantissa Abeyratne Pdf

This book is both a repertory guide to the Convention on International Civil Aviation (Chicago Convention) as well as a legal analysis of the provisions of the treaty. It traces action taken by the ICAO Assembly and the Council in the implementation of the Convention from the first ICAO Assembly in 1947 until 2012. Above all, the book offers a commentary on the functional and moral fabric of the Chicago Convention, which is not only a multilateral legal instrument that sets out basic principles of air navigation and air transport, but also serves as a moral compass that brings the people of the world together. The teleological nature of the Chicago Convention is reflected from the outset – from its Preamble which sets the tone and philosophy of the Convention – that aviation builds friendship and understanding among all people, to its technical provisions that range from rules of the air to landing at airports and customs and immigration procedures. The book effectively demonstrates the Aristotelian principle – that rules make people good by forming habits in them. Standardization, or in other words, compliance, is the driver of the Convention that keeps aviation safe, regular, efficient and economical. To that end, this book traces and details the sustained relevance of the Chicago Convention and the efforts of ICAO and the international aviation community towards keeping air transport on track and ready for its future exponential growth, both in letter and in spirit.

Aviation Security Law by Ruwantissa Abeyratne Pdf

The law plays a significant role in ensuring aviation security. This book addresses new and emerging threats to civil aviation; evaluates security tools now in use such as the Public Key Directory, Advance Passenger Information, Passenger Name Record and Machine Readable travel documents in the context of their legal and regulatory background; and discusses applicable security treaties while providing an insight into the process of the security audits conducted by the International Civil Aviation Organization (ICAO). The book also examines issues of legal responsibility of States and individuals for terrorist acts of third parties against civil aviation and discusses from a legal perspective the latest liability Conventions adopted at ICAO. The Conclusion of the book provides an insight into the application oflegal principles through risk management.

International Air Law and ICAO by Michael Milde Pdf

This is the third edition of the acclaimed International Air Law and ICAO, first published in 2008. The book has been fully updated to take the latest developments into account. Specialized legal literature dealing with different aspects of international air law is rare, the developments often overtake the existing writings and there is a continuous need not only for updating but also for future-oriented thinking. There is a practical need for a compact but exhaustive and easily comprehensible textbook or reference book that deals with the most general aspects of international air law, as well as with the constitutional issues and law-making functions of the International Civil Aviation Organization (ICAO). This book fills this gap as it is a general treatise of the law of international civil aviation aimed at the needs of university students and educators, government authorities, airlines, practicing lawyers, journalists, international organizations and the general public. This book is motivated by the author's 25 years of experience (1966-1991) in the Secretariat of ICAO in Montreal - his last eight years as Director of the Legal Bureau. In equal measure the inspiration for the content of this book came from the author's academic work as Director of the Institute of Air and Space Law of McGill University (1989-1998) and his role as Professor of Law at that Institute until 2006 teaching this subject to graduate students from different parts of the world and different legal cultures. Aviation and Climate Change by Frank Fichert,Peter Forsyth,Hans-Martin Niemeier Pdf

This book analyses the political, economic and managerial challenges for policy makers and the air transport industry as they face climate change. Based on an overview of the scientific background and technological options for emissions reduction, Aviation and Climate Change provides an in-depth assessment of environmental regulation and management. It provides an up-to-the-minute analysis of the effects of aviation on climate change, and an economic analysis of policies to reduce or eliminate greenhouse gas emissions. The main emphasis of the book is on the economic mechanisms used to lessen emissions – carbon taxes, emissions trading schemes and offset schemes. It pays particular attention to the ways these policies work, and to the interaction between them – for instance, the interaction between taxes and emissions trading schemes. One feature of the book is that it analyses the Carbon Offsetting and Reduction Scheme for International Aviation (CORSIA) which has been developed by ICAO for international aviation, and which is due to commence operation shortly. The advantages and disadvantages of this controversial scheme are discussed. This book will be of interest to researchers in diverse areas (economics, political science, engineering, natural sciences), to air transport policy makers, and to managers in the aviation industry.

The Need for an Integrated Regulatory Regime for Aviation and Space by Ram S. Jakhu,Tommaso Sgobba,Paul Stephen Dempsey Pdf

In the new space age after the end of the Cold War, orbit and frequency allocations, traffic control, safety, and a number of support services such as space weather forecast and orbital debris monitoring need to be coordinated transparently and effectively by clear rules at an international level. The establishment of an international civil space regulatory framework is the central theme of this book, in particular, the possible extension to space of the international regulatory framework model adopted for aviation more than 60 years ago with the establishment of the International Civil Aviation Organization (ICAO). The book also highlights the increased reliance of aviation safety on space-based navigation and communication systems, the increasing space systems traffic through the international airspace under the jurisdiction of the ICAO, and the emerging hybrid systems such as aero-spacecraft and space planes, to advocate the practical benefits of directly expanding the ICAO Convention domain beyond the airspace to include outer space up to the geosynchronous orbit.

The Resolution of Inter-State Disputes in Civil Aviation by Luping Zhang Pdf

"This book investigates dispute resolution mechanisms in international civil aviation, with a primary focus on the functions of the International Civil Aviation Organization (ICAO) Council. The Convention on International Civil Aviation (Chicago Convention) has laid the foundation for dispute resolution mechanisms in international civil aviation, which led to the creation of ICAO. However, economic regulations have been left out from the Chicago Convention. Over the years there has been a proliferation of bilateral air services agreements (ASAs) and the multiplication of multilateral treaties. With the advancement of the aviation technology, this book considers whether dispute resolution mechanisms should be modernised, and if so, what form such modernisation might take. The book is divided into five chapters. Chapter I provides an introduction and defines the scope of the research. Chapter II is an empirical chapter, which traces the evolution of dispute resolution clauses under both multilateral air law treaties and bilateral ASAs with the most updated data collected to date. Chapter III analyses how disputes brought to the fora designated under the treaties in Chapter II are resolved in practice. The fourth chapter builds on the empirical evidence provided in Chapters II and III to critically assesses the political and legal means that are involved in the settlement of international aviation disputes. The final chapter proposes reforms on the basis of the lessons learnt in the previous chapters and introduces proposals for amending rules of procedures in ICAO as well as establishing a new arbitral institution"--
