Today, investor-state arbitration embodies the worst fears of those concerned about runaway globalization - a far cry from its framers' intentions. Why did governments create a special legal system in which foreign investors can bring cases directly against states? This book takes readers through the key decisions that created investor-state arbitration, drawing on internal documents from several governments and extensive interviews to illustrate the politics behind this new legal system. The corporations and law firms that dominate investor-state arbitration today were not present at its creation. In fact, there was almost no lobbying from investors. Nor did powerful states have a strong preference for it. Nor was it created because there was evidence that it facilitates investment - there was no such evidence. International officials with peacebuilding and development aims drove the rise of investor-state arbitration. This book puts forward a new historical institutionalist explanation to illuminate how the actions of these officials kicked off a process of gradual institutional development. While these officials anticipated many developments, including an enormous caseload from investment treaties, over time this institutional framework they created has been put to new purposes by different actors. Institutions do not determine the purposes to which they may be put, and this book's analysis illustrates how unintended consequences emerge and why institutions persist regardless.

How do international organizations change? Many organizations expand into new areas or abandon programmes of work. Advocacy and Change in International Organizations argues that they do so not only at the collective direction of member states. Advocacy is a crucial but overlooked source of change in international organizations. Different actors can advocate for change: national diplomats, international bureaucrats, external experts, or civil society activists. They can use one of three advocacy strategies: social pressure, persuasion, and 'authority talk'. The success of each strategy depends on the presence of favourable conditions related to characteristics of advocates, targets, issues, and context. Institutionalization of new issues in international organizations as a multi-stage process, often accompanied by contestation. This book demonstrates how the advocacy-focused framework explains the origins of three workstreams of contemporary UN peacekeeping operations: communication, protection, and reconstruction. The issue of strategic communications was promoted by UN officials through the strategy of persuasion. Protection of civilians emerged due to a partially successful social influence campaign by a coalition of elected Security Council members and a subsequent (and successful) persuasion efforts by Canada. Quick impact projects entered peacekeepers' practice as the result of 'authority talk' by an expert panel. The three issues illustrate the diversity of pathways to change in international organizations, representing the top-down, bottom-up, and outside-in pathways. Moreover, they have achieved different degrees of institutionalization in UN's policies, structures, and frameworks: protection of civilians is the most institutionalized, as evidenced by measures to hold peacekeepers accountable for non-implementation, while quick impact projects are the least institutionalized.

In the 1990s, Americans witnessed live televised images of U.S. soldiers dragged through the streets of Mogadishu, wounded American prisoners of war paraded in front of video cameras in Iraq and Kosovo while their families were interviewed simultaneously on live television at home, and scud missile attacks in Israel and Saudi Arabia during the Persian Gulf War. These events have brought foreign policy directly into America's living rooms. By transforming complex, distant events into entertaining and compelling human dramas, these images have captured the American public's attention to a far greater extent than printed reports, photographs and tape-delayed videos ever could. Does the nature and extent of media coverage of foreign crises influence public opinion in ways that affect presidential decisionmaking, and if so, how? I argue that the Information Revolution has fundamentally changed how the media covers foreign crises, that, as a result, Americans are becoming more attentive to such crises and, in turn, that an attentive public makes it difficult for presidents to use force as a foreign policy tool. I employ content analyses of media coverage of various foreign crises and statistical analyses of public opinion surveys to demonstrate trends in public opinion and to relate increases in attentiveness to changes in the mass media, particularly television. I find that even as the Americans declare themselves in countless surveys to be less concerned with foreign affairs in the post-Cold War era than at any time since World War II, they are simultaneously growing increasingly attentive to foreign crises. I then develop a formal model to derive hypotheses concerning when and how public opinion will influence presidential crisis decisionmaking. To test the hypotheses, I conduct statistical analyses of all U.S. post-WWII foreign crises and a case study of the 199294 U.S. intervention in Somalia. I find that an attentive public can inhibit presidents from escalating foreign crises, particularly if the strategic stakes involved are relatively modest. I also find evidence of a growing reluctance by the U.S. to become engaged in low-stakes military operations and increasingly risk-averse tactics in those low-stakes conflicts in which the U.S. becomes involved.
