Unions in Court by Charles W. Smith,Larry Savage Pdf

Since the turn of the twenty-first century, Canadian unions have scored a number of important Supreme Court victories, securing constitutional rights to picket, bargain collectively, and strike. Unions in Court documents the evolution of the Canadian labour movement’s engagement with the Charter, demonstrating how and why labour’s long-standing distrust of the legal system has given way to a controversial, Charter-based legal strategy. This book’s in-depth examination of constitutional labour rights will have critical implications for labour movements as well as activists in other fields.

Labour Relations Law by Anonim Pdf

It had been expected that the impact of the Superior Courts Bill - more particularly, the proposed merger of the Labour Court with the High Court and of the Labour Appeal Court with the Supreme Court of Appeal - on the dispute resolution system created by the Labour Relations Act would form a major focus of the revisions to this edition of Labour Relations Law. In the event, at the eleventh hour the Bill was again referred back for further consideration and, at the time of going to print, its final version is still being awaited. However, the most important changes proposed by the existing version of the Bill are included in the chapter on dispute resolution. Should these be implemented, it is hoped that the chapter will provide a concise but serviceable introduction to the new regime of labour litigation in the High Court as well as a guide to the existing system. In the area of substantive law developments have continued apace, fuelled by a number of important and sometimes controversial court decisions. Possibly the most important has been the continued evolution of common law rights and remedies alongside their statutory counterparts. This trend is in marked contrast to the position in the United Kingdom, the source of so much of our individual employment law, where the statutory regime is seen more clearly as having, in principle, superseded the common law regime. Although the phenomenon has thus far manifested itself most clearly in the area of termination of employment, there is no reason why contractual rights should not be asserted in competition with other statutory rights which do not abolish them expressly or by clear implication.

Commonwealth Caribbean Employment and Labour Law by Natalie G.S. Corthésy,Carla-Anne Harris-Roper Pdf

This new edition to the series will provide an up-to-date textbook covering a wide-range of employment and labour law issues which affect the Commonwealth Caribbean. Initially the book will embark on a comparative analysis of employment and labour law in Jamaica, Trinidad and Barbados, as a reference point for distinguishing the laws of other Commonwealth Caribbean jurisdictions. The book will continue to examine how the law operates within the legal systems of the Caribbean, taking into account the umbilical link to British jurisprudence and the persuasive precedent of other Commonwealth jurisdictions, and the impact this has had on the growth and development of the area. Commonwealth Caribbean Employment and Labour Law will be essential reading for students enrolled on Employment Law, Discrimination and Dismissal Law courses in the Caribbean.

International Labour Law Reports - 17 by Zvi H. Bar-Niv,Benjamin Aaron,Thilo Ramm,Jean-Maurice Verdier,Tore Sigeman Pdf

The "International Labour Law Reports" is a series of annual publications of labour law judgements by the highest courts in a number of jurisdictions. "ILLR" is intended primarily for the use of judges, labour law practitioners, industrial relations specialists and students who need or desire ready access to authoritative information of a comparative nature on problems arising in the field of labour law and industrial relations. Each judgement reprinted in "ILLR" is accompanied by Headnotes and in practically all cases by an Annotation which sets forth, among other things, the legal issues involved, the basic facts of the case (if not included in the judgement itself), the relevant statutory provisions and judicial precendents, the labour law and industrial relations context in which the case arose and the significance of the judgement in the development of the law. The "ILLR" provide the reader with factual information that is not coloured by the personal views of the annotators. As a rule, judgements are printed "in extenso"; editorial discretion has been relied upon to delete or to summarize portions of judgements that are purely technical or only of marginal interest. "Volume 17" covers the period 1 October 1996 to 30 September 1997.
