Modelling the Legal Decision Process for Information Technology Applications in Law by Georgios Yannopoulos Pdf

In this book, Georgios N. Yannopoulos appropriately relates the developing field of knowledge based systems in law with the basis in classic philosophy, explicating relations which too often are not properly understood. The decision model developed by the author is important, as it integrates and explains arguments which often have been seen as imcompatible. The use of the theoretical foundation in describing and in giving a critical analysis of the construction of real knowledge bases systems becomes therefore very valuable.and’ Jon Bing, Norwegian Research Center for Computers and Law and‘Expert systems in law have not been as easily achieved as was originally envisaged, because too many thought the task to be trivial and ignored the complex issues involved. Yannopoulosand’ work is valuable because he attempts to detail these issues and overcome them.and’ Philip Leith, Queenand’s University of Belfast and‘Yannopoulosand’ book addresses some of the most crucial problems in the field of information technology and law. The development of more advanced IT solutions for the legal sector will always be closely related to our ability to model and understand the legal reasoning process. In his analysis Yannopoulos elegantly integrates knowledge from many different areas, and in this respect the book reflects an all too seldom seen broadness.and’ Pete Wahlgren, The Swedish Law and Informatics Research Institute (IRI) and‘There has been an abundance of recent research on developing intelligent support systems. Dr Yannopoulosand’ work is especially significant because it examines the necessary legal background for building such systems. It will be an essential reference for the prospective builders of intelligent legal support systems.and’ John Zeleznikow, La Trobe University, Bundoora, Australia

Trust in Electronic Commerce:The Role of Trust from a Legal, an Organizational, and a Technical Point of View by J. E. J. Prins,P. M. A. Ribbers,Henk C. A. Van Tilborg Pdf

Electronic commerce is here to stay. No matter how big the dot-com crisis was or how far the e-entrepreneurs' shares fell in the market, the fact remains that there is still confidence in electronic trading. At least it would appear that investors are confident in e-companies again. However, not only trust of venture capitalists is of importance -- consumers also have to have faith in on-line business. After all, without consumers there is no e-business. Interacting lawyers, technicians and economists are needed to create a trustworthy electronic commerce environment. To achieve this environment, thorough and inter-disciplinary research is required and that is exactly what this book is about. Researchers of the project Enabling Electronic Commerce from the Dutch universities of Tilburg and Eindhoven have chosen a number of e-topics to elaborate on trust from their point of view. This volume makes clear that the various disciplines can and will play a role in developing conditions for trust and thus contribute to a successful electronic market.

Legal Knowledge Representation:Automatic Text Analysis in Public International and European Law by Erich Schweighofer Pdf

This volume is a presentation of all methods of legal knowledge representation from the point of view of jurisprudence as well as computer science. A new method of automatic analysis of legal texts is presented in four case studies. Law is seen as an information system with legally formalised information processes. The achieved coverage of legal knowledge in information retrieval systems has to be followed by the next step: conceptual indexing and automatic analysis of texts. Existing approaches of automatic knowledge representations do not have a proper link to the legal language in information systems. The concept-based model for semi-automatic analysis of legal texts provides this necessary connection. The knowledge base of descriptors, context-sensitive rules and meta-rules formalises properly all important passages in the text corpora for automatic analysis. Statistics and self-organising maps give assistance in knowledge acquisition. The result of the analysis is organised with automatically generated hypertext links. Four case studies show the huge potential but also some drawbacks of this approach.

Open EDI and Law in Europe by Andreas Mitrakas Pdf

Electronic commerce applications all allow the transfer of electronic data from one point to another. Open EDI--a particular application of electronic commerce--also permits commercial transactions to take place in a fully automated and highly organised trading environment. This volume focuses on open EDI and its relationship with law. When confronted with technology, the typical reaction of the law is to support interpretations and amendments of existing statutes so that old laws can accommodate the change. Open EDI, however, does not fit within this traditional regulatory method. Open EDI permits ad hoc open electronic transactions irrespective of geographical border and jurisdictions among trading partners with no prior trade relationship. By doing so, open EDI limits the possibility of using up-front interchange agreements to address the legal problems of the interchange. It therefore requires the use of legal instruments supported by information technology to overcome legal problems. Openness in an electronic environment has the potential to initiate an unobserved change in law. Possible regulations should address users' need to act in such a trading environment without the inhibition of basic legal concerns. Open EDI and Law in Europe concludes that the challenge of open EDI necessitates working toward a new legal framework based on international law and supported by information technology. This volume will assist lawyers and laypersons concerned with the practical and theoretical aspects of the legal issues of the application of open EDI by pointing out subtle issues in the application of law in this area and by provoking thought regarding possible solutions.

Sentencing and Society by Cyrus Tata,Neil Hutton Pdf

Combining the latest work of leading sentencing and punishment scholars from twelve different countries, this major new international volume answers key questions in the study of sentencing and society. It presents not only a rigorous examination of the latest legal and empirical research from around the world, but also reveals the workings of sentencing within society and as a social practice. Traditionally, work in the field of sentencing has been dominated by legal and philosophical approaches. Distinctively, this volume provides a more sociological approach to sentencing: so allowing previously unanswered questions to be addressed and new questions to be opened. This extensive collection is drawn from around one third of the papers presented at the First International Conference on Sentencing and Society. Almost without exception, the chapters have been revised, cross-referenced and updated. The overall themes and findings of the international volume are set out by the opening "Introduction" and the closing "Reflections" chapters. Research findings on particular penal policy questions are balanced with an analysis of fundamental conceptual issues, making this international volume essential reading for: sentencing and punishment scholars, criminal justice policy-makers, and graduate students.

Judicial Applications of Artificial Intelligence by Giovanni Sartor,L. Karl Branting Pdf

The judiciary is in the early stages of a transformation in which AI (Artificial Intelligence) technology will help to make the judicial process faster, cheaper, and more predictable without compromising the integrity of judges' discretionary reasoning. Judicial decision-making is an area of daunting complexity, where highly sophisticated legal expertise merges with cognitive and emotional competence. How can AI contribute to a process that encompasses such a wide range of knowledge, judgment, and experience? Rather than aiming at the impossible dream (or nightmare) of building an automatic judge, AI research has had two more practical goals: producing tools to support judicial activities, including programs for intelligent document assembly, case retrieval, and support for discretionary decision-making; and developing new analytical tools for understanding and modeling the judicial process, such as case-based reasoning and formal models of dialectics, argumentation, and negotiation. Judges, squeezed between tightening budgets and increasing demands for justice, are desperately trying to maintain the quality of their decision-making process while coping with time and resource limitations. Flexible AI tools for decision support may promote uniformity and efficiency in judicial practice, while supporting rational judicial discretion. Similarly, AI may promote flexibility, efficiency and accuracy in other judicial tasks, such as drafting various judicial documents. The contributions in this volume exemplify some of the directions that the AI transformation of the judiciary will take.

Digital Technology Advancements in Knowledge Management by Gyamfi, Albert,Williams, Idongesit Pdf

Knowledge management has always been about the process of creating, sharing, using, and applying knowledge within and between organizations. Before the advent of information systems, knowledge management processes were manual or offline. However, the emergence and eventual evolution of information systems created the possibility for the gradual but slow automation of knowledge management processes. These digital technologies enable data capture, data storage, data mining, data analytics, and data visualization. The value provided by such technologies is enhanced and distributed to organizations as well as customers using the digital technologies that enable interconnectivity. Today, the fine line between the technologies enabling the technology-driven external pressures and data-driven internal organizational pressures is blurred. Therefore, how technologies are combined to facilitate knowledge management processes is becoming less standardized. This results in the question of how the current advancement in digital technologies affects knowledge management processes both within and outside organizations. Digital Technology Advancements in Knowledge Management addresses how various new and emerging digital technologies can support knowledge management processes within organizations or outside organizations. Case studies and practical tips based on research on the emerging possibilities for knowledge management using these technologies is discussed within the chapters of this book. It both builds on the available literature in the field of knowledge management while providing for further research opportunities in this dynamic field. This book highlights topics such as human-robot interaction, big data analytics, software development, keyword extraction, and artificial intelligence and is ideal for technology developers, academics, researchers, managers, practitioners, stakeholders, and students who are interested in the adoption and implementation of new digital technologies for knowledge creation, sharing, aggregation, and storage.

Computer Applications for Handling Legal Evidence, Police Investigation and Case Argumentation by Ephraim Nissan Pdf

This book provides an overview of computer techniques and tools — especially from artificial intelligence (AI) — for handling legal evidence, police intelligence, crime analysis or detection, and forensic testing, with a sustained discussion of methods for the modelling of reasoning and forming an opinion about the evidence, methods for the modelling of argumentation, and computational approaches to dealing with legal, or any, narratives. By the 2000s, the modelling of reasoning on legal evidence has emerged as a significant area within the well-established field of AI & Law. An overview such as this one has never been attempted before. It offers a panoramic view of topics, techniques and tools. It is more than a survey, as topic after topic, the reader can get a closer view of approaches and techniques. One aim is to introduce practitioners of AI to the modelling legal evidence. Another aim is to introduce legal professionals, as well as the more technically oriented among law enforcement professionals, or researchers in police science, to information technology resources from which their own respective field stands to benefit. Computer scientists must not blunder into design choices resulting in tools objectionable for legal professionals, so it is important to be aware of ongoing controversies. A survey is provided of argumentation tools or methods for reasoning about the evidence. Another class of tools considered here is intended to assist in organisational aspects of managing of the evidence. Moreover, tools appropriate for crime detection, intelligence, and investigation include tools based on link analysis and data mining. Concepts and techniques are introduced, along with case studies. So are areas in the forensic sciences. Special chapters are devoted to VIRTOPSY (a procedure for legal medicine) and FLINTS (a tool for the police). This is both an introductory book (possibly a textbook), and a reference for specialists from various quarters.
