This disproportionate relationship between funding and control allows state and federal officials to pass education policy yet excuses them from supplying adequate funding for new programs. The resulting unfunded and underfunded mandates and regulations, Shelly insists, are the true cause of the loss of community control over public education. Shelly outlines the effects of the most infamous of underfunded federal mandates, the No Child Left Behind Act of 2001 (NCLB), and explores why schools implemented it despite its unpopularity and out-of-pocket costs. Shelly's findings hold significant implications for school finance reform, NCLB, and the future of intergovernmental relations.

However, human rights concerns are confronted everyday by people in this democracy, including children. The purpose of this volume is to bring attention to the fact that against the backdrop of neoliberal expansion, serious human rights violations are taking place among children everywhere, including in the US. The daily struggles among groups of school children in the US are specifically considered here, such as children who are sorted by race, homeless children, transient children, child refugees, children as targeted by human traffickers, and/or child migrant workers. As the economy continues to constrict, more and more young people find themselves struggling to grow up on these razor thin margins of survival. Given current economic arrangements, such margins are widening. The definition of “children’s human rights” as understood in this analysis is taken directly from the UN Convention on the Rights of the Child [CRC]. Here emphasis is placed on ways in which the CRC could be used to serve more effectively the needs of the most vulnerable populations of school-age children in the US and elsewhere. Public schools could be the very place where children come to understand they have rights. Unfortunately, many children do not get this information. Instead the protections stated in the CRC and the realities of the lives of so many children are often worlds apart. This volume sets out to be a part of changing this.

This document reports on a congressional subcommittee's review of the federal role in education. The review included visits to 15 states and testimony from more than 225 principals, teachers, and other education stakeholders. The committee's purpose was to identify the steps that lead in the direction of either excellence or failure. The subcommittee found that successful schools and school systems were not the product of federal funding but instead were characterized by parents involved in the education of their children, local control, emphasis on basic academics, and dollars spent on the classroom. The central theme of the findings is that the federal government cannot consistently replicate success stories in the form of federal programs. Rather, the government should empower parents by reducing the family federal tax burden; encourage parental choice in education; return federal elementary and secondary education funds to states and local school districts through flexible grants; use federally funded education programs only for methods backed by reliable, replicable research; streamline and consolidate federal education programs; and reform or eliminate ineffective and inefficient programs. In short, the federal government should serve education as a research and statistics- gathering agency, disseminating findings and enabling states to share best practices with each other. The report was adopted by the subcommittee by a vote along Republican-Democrat party lines of 5-2. The 17 page minority report, "Crossroads Hearings: A Republican Assault on Public Education," is printed as an appendix. (RJM)
