Political and social changes that took place at the turn of the 20th and 21st centuries and, additionally, technological revolution and the process of digitalisation have resulted in significant social, economic and legal transformations. Then, it can be even said metaphorically that together with the development of the Internet we discovered a new continent. 'Colonization' of this area resembles conquering new areas in times of great geographical discoveries. At first, power and violence were prevailing and only later people tried to introduce effective methods of law enforcement. Nowadays, the next problem is the non-territoriality of phenomena on the Internet. From the point of view of legal actions, it is generally limited to a legal system of a given country, and seems to be a fundamental issue. As it appears, law and legal systems do not handle the challenges of global space and it is rather a gunslinger's speed that turns out to be essential here. However, it should be hoped that with time, as in the case of the real world experience, power will be replaced with powerful arguments based on effective legal mechanisms in particular. All the more so, as these changes happen very rapidly. Thus, referring to the known concept of liquid modernity by Zygmunt Bauman, it can also be said that by regulating the media subject in the field of law to fundamental changes, we are confronted with the uncertainty of legal institutions concerning this part of social life. Hence, we should return to the basics and again pose fundamental questions about media law such as, for instance, what should the press, radio, television be called, and who can be treated as a journalist. Additionally, we should face new legal phenomena and challenges. The collective work we are passing to the readers is an attempt to analyse the current state and present a forecast about further changes as well as answers to at least several questions posed above. Being aware of the fact that it is impossible to deal with or even settle all the aforementioned problems in such a study, the editors hope that, thanks to reviews and deliberations of the authors, the book will significantly contribute to the discussion on media law in the 21st century. The term 'professionalization' arouses controversies in academic discussion, let alone the issue of professionalization of journalism. Journalism considerably departs from the ideal model of professionalization. There is no structured knowledge that directly applies to journalists, although we can talk about defined skills and the practical principles of the journalist's profession. Considering the process of the professionalization of journalism, we can indicate three significant determinants, namely professional autonomy, separate professional standards (self-regulation principles) and serving the public interest. However, it is particularly important to ask about the condition of the journalist's profession nowadays. The ongoing technological revolution on the one hand, and the political and legal transformations accompanied by market trends, such as the tabloidization of the media (so-called infotainment) first and foremost, and citizen journalism on the other, have all generated great doubts about the status of journalists. This calls for a redefinition of the professional position and role of journalists in modern societies. All these transformations may pose a serious threat to the model of traditional journalism and the social and professional position of journalists. The book introduced here consists of four parts, presenting various aspects of professionalization of journalism. The first part treats of diverse topics concerning the essence of this issue, as well as the legal status of journalist's profession. The second part, features texts devoted to the issues of digital media. Part three deals with the disturbing phenomenon of hate speech. The main theme of the last part of the book concerns the issue of lobbying in the process of establishing intellectual property rights. The texts presented here have been written by scholars in the fields of law, media studies and political science on the one hand and practitioners (journalists) fromseveral countries of Europe on the other. The common critique of media- and ratings-driven politics envisions democracy falling hostage to a popularity contest. By contrast, the following book reconceives politics as a speculative Keynesian beauty contest that alienates itself from the popular audience it ceaselessly targets. Political actors unknowingly lean on collective beliefs about the popular expectations they seek to gratify, and thus do not follow popular public opinion as it is, but popular public opinion about popular public opinion. This book unravels how collective discourses on “the popular” have taken the role of intermediary between political elites and electorates. The shift has been driven by the idea of “liquid control:” that postindustrial electorates should be reached through flexibly designed media campaigns based on a complete understanding of their media-immersed lives. Such a complex representation of popular electorates, actors have believed, cannot be secured by rigid bureaucratic parties, but has to be distilled from the collective wisdom of the crowd of consultants, pollsters, journalists and pundits commenting on the political process. The mediatization of political representation has run a strikingly similar trajectory to the marketization of capital allocation in finance: starting from a rejection of bureaucratic control, promising a more “liquid” alternative, attempting to detect a collective wisdom (of/about “the markets” and “the people”), and ending up in self-driven spirals of collective speculation.
