A History of Military Morals by Brian Smith Pdf

This historiography demonstrates how theorists have rationalized killing the innocent in war. It shows how moral arguments about killing the innocent respond to material conditions, and it explains how we have arrived at the post-World War II convention.

The Splendid Blond Beast by Christopher Simpson Pdf

From a National Jewish Book Award–winning author: The “revelatory and shocking” investigation into the CIA’s liberation of Nazi war criminals (Kirkus Reviews). How did Gen, Karl Wolff, one of the highest-ranking members of the Nazi Party’s Waffen-SS, who personally oversaw the deportation of three hundred thousand Jews to the Treblinka extermination camps, escape prosecution at the Nuremberg trials? As revealed in this groundbreaking investigation—culled from recently uncovered archival documents—the answer lies within the US government, which buried reports on the Final Solution and was complicit in the recruitment of Nazi war criminals, all to protect the world economy. Among the key players was CIA director Allen Dulles, who was not only instrumental in Wolff’s exoneration but also responsible for installing former slave-labor specialists into positions of power in postwar Germany. In this damning exposé of American government malfeasance, author Christopher Simpson traces the roots of mass murder as an instrument of financial gain and state power, from the Armenian genocide during World War I to Hitler’s Holocaust through the practice of genocide today. Detailing how the existing structures of international law and commerce have encouraged mass killings, corporate looting, and profiteering at the expense of innocent victims, The Splendid Blond Beast is a disturbing and profound book about the success of evil in our time. The award-winning author of Blowback and Science of Coercion, Simpson also served as research director for Marcel Ophüls’s Oscar-winning documentary, Hôtel Terminus: The Life and Times of Klaus Barbie.

Legal Effect of World War II on Treaties of the United States by Stuart Hull MacIntyre Pdf

This study consists of an empirical examination of the legal effect of war on treaties to which the United States and one or more enemy states were parties at the outbreak of World War II. Doctrine is regarded as of secondary importance to this study and is therefore treated summarily. Some attention is devoted to historical aspects of the problem to lend perspective to the developments of World War II. The basic plan of this work is simple. After definitions have been established for "war" and "treaties," certain assumptions implicit in this study are discussed. Next, relevant doctrinal questions are considered. This is followed by an analysis of American practice concerning the legal effect of war on treaties of the United States from the early part of the 19th century down to World War II. The main part of the study, in which the treaties are arranged according to subject matter, carries the discussion down to the provisions in the peace treaties which relate to revival of prewar agreements. The chapter on the peace treaty provisions concludes with consideration of the special situation arising from the absence of a final peace treaty with Germany. Conclusions are then drawn from the experience of the United States. The literature of international law is filled with opinions on the effect of war on treaties, but only rarely have the authors stopped to analyze the practice of states methodically.

Collective Responsibility and Accountability under International Law by Shane Darcy Pdf

Collective Responsibility and Accountability under International Law examines the extent to which the basic principle of individual responsibility accommodates liability for the acts of others. It examines the debates and legal developments surrounding collective responsibility under international law. The philosophical debates on collective responsibility provide an introduction to the examination of whether collective responsibility is ever appropriate or even lawful under international law. As the international criminal justice project begins to flourish, it is of paramount importance that the extent of the potential liability of individuals for the acts of others is clarified and held up to rigorous scrutiny. It is of equal importance that there is a clear understanding of whether the means of responding to ongoing violations of international humanitarian law can include measures based on collective responsibility. Global events have created an impetus for the parameters of responsibility to be clearly defined. The rise of non-State actors within the international legal regime raises complex questions surrounding their status, power and the means for holding them accountable.

August 1914 by Bruno Cabanes Pdf

A renowned military historian closely examines the first month of World War I in France. On August 1, 1914, war erupted into the lives of millions of families across France. Most people thought the conflict would last just a few weeks . . . Yet before the month was out, twenty-seven thousand French soldiers died on the single day of August 22 alone—the worst catastrophe in French military history. Refugees streamed into France as the German army advanced, spreading rumors that amplified still more the ordeal of war. Citizens of enemy countries who were living in France were viciously scapegoated. Drawing from diaries, personal correspondence, police reports, and government archives, Bruno Cabanes renders an intimate, narrative-driven study of the first weeks of World War I in France. Told from the perspective of ordinary women and men caught in the flood of mobilization, this revealing book deepens our understanding of the traumatic impact of war on soldiers and civilians alike. “An exceptional book, a brilliant, moving, and insightful analysis of national mobilization.” —Martha Hanna, author of Your Death Would Be Mine: Paul and Marie Pireaud in the Great War “This book deserves a wide readership from historians, critics and anyone interested in the catastrophe of war.” —Mary Louise Roberts, Distinguished Lucie Aubrac and Plaenert-Bascom Professor of History, University of Wisconsin, Madison “The sounds, sights and emotions of August, 1914 are all evoked with exceptional skill.” —David A. Bell, author of The First Total War: Napoleon’s Europe and the Birth of Warfare as We Know It
