A dramatic shift has occurred in recent years as the number of temporary labourers admitted to Canada has increased substantially. Legislated Inequality critically evaluates this radical development in Canadian immigration, arguing that it threatens to undermine Canada's success as an immigrant nation. This book focuses on the neglected yet critical issue of how the global migration of millions of parents as low-waged migrant workers impacts the rights of their children under international human rights law. Migrant women across Asia disproportionately work in precarious, insecure, and informal employment sectors that are subject to few regulations, pay low wages, and expose women to harm, of which domestic work is among the most prevalent. This book uses the cases of the Philippines and Sri Lanka to develop a comprehensive, intersectional, rights-based approach to better protect women migrant domestic workers against exploitation. As accounts of exploitation, gender-based violence, torture, and death among migrant domestic workers increase, the recognition and defence of their human and labour rights is an urgent necessity. The Philippines and Sri Lanka are two of the leading labour-sending states of women domestic workers in Asia, and their economies have become increasingly dependent on the remittances they send back home. Drawing on extensive original research this book argues that these two sending states are guilty of structural violence by sustaining a network of institutions, policies and practices, which serve to systematically disadvantage and discriminate against women migrant domestic workers. The research covers the entire migration process, from pre-departure, through to overseas employment, followed by return and reintegration. This book’s innovative application of structural violence theory as a way to investigate the role of state institutions in labour-sending countries in the Global South will be of interest to researchers from across the fields of migration studies, gender studies, human rights law, and Asian Studies.

The dynamics of labour mobility are heavily influenced by the opportunities perceived and the imaginaries held by both employers and regulating authorities in relation to migrant labour. This volume offers a multidisciplinary approach to the study of the structures and imaginaries underlying various forms of mobility. Based on research conducted in different geographical contexts, including the European Union, Turkey, and South Africa, and tackling the experiences and aspirations of migrants from various parts of the globe, the chapters comprised in this volume analyse labour-related mobilities from two distinct yet intertwined vantage points: the role of structures and regimes of mobility on the one hand, and aspirations as well as migrant imaginaries on the other. This study explores the short term migration of Bangladeshi women to Malaysia to work in labour intensive, export oriented factories, and considers the consequences of their decision to migrate. While international migration is a much discussed issue, so far little attention has been given to the vast flow of South-to-South migration, which is particularly large in Asia. The labour migration flows within this region are typified by their highly regulated nature, temporary character and by the predominance of females undertaking migration. So far, most academic attention has focused on permanent or settlement migration. This study aims to fill a gap in our understanding of migration theory by focusing on temporary migration processes. The study examines the reasons Bangladeshi women gave for migrating and how their experience impacted their lives during their migration and after their return. The findings underscore the importance of incorporating gender in migration theory and integrating it into analyses. While in most cases their migration was socio-culturally contested, the women say they migrated in an effort to improve their socio-economic standing. This proved in general to be more difficult than anticipated; wages were not paid according to contract or labour law, and male peers often opposed their efforts. The complex nature of these women's position and situation preclude unequivocal conclusions as to the possible benefits or losses resulting from migration. But by revealing the experiences of individual women, this study helps to clarify some of the ambiguities of the individual migrants complex reality. The analysis of their experiences exposes important gender dynamics.
This volume makes the case for the fair treatment of female migrant workers from the global South who are employed in wealthy liberal democracies as care workers, domestic workers, home health workers, and farm workers. An international panel of contributors provide analyses of the ethical, political, and legal harms suffered by female migrant workers, based on empirical data and case studies, along with original and sophisticated analyses of the complex of systemic, structural factors responsible for the harms experienced by women migrant workers.
