The Law Relating to Interrogatories, Production, Inspection of Documents and Discovery, as Well in the Superior as in the Inferior Courts by Walter Sydney Sichel Pdf

Excerpt from The Law Relating to Interrogatories, Production, Inspection of Documents and Discovery, as Well in the Superior as in the Inferior Courts: Together With an Appendix of the Acts, Forms, and Orders With regard to the New Rules of Procedure in the Superior Courts now imminent, should the published Recommendations of the Committee be pursued, interrogatories at any rate would be allowed only by permission and direction of the Master as, under the Common Law Procedure Acts, by that of the Court; the cases thereunder decided would thus become doubly rele vant, though the learning as to Time might be swept away, and it is conceived that however the machinery be modified the old principles will still, as during three successive alterations, survive. While we write the sad news arrives that Sir George J essel is dead. At such a time it will not be considered presumptuous to add a tribute of respectful gratitude to that great judge's elucidation of a subject which he adorned, like the many far weightier matters he handled, by the simplicity that complete strength alone secures. The Law of Discovery, 1912 by Robert Ernest Ross Pdf

Excerpt from The Law of Discovery, 1912: Being a Comprehensive Treatise on the Principles and Practice Relating to Interrogatories, Discovery of Documents and Inspection of Documents in Proceedings in the High Court and County Court IN this book an attempt has been made to set forth as clearly and succinctly as possible, both the principles which obtain with regard to the administration of Interrogatories, the disclosure of the existence of documents and the inspection of documents in civil proceedings in the High Court and County Court, and the practice or procedure relating to the application of those principles. Discovery is sought in most actions set down for trial, and the subject-matter of this book is, therefore, one of every-day occurrence. It is also a matter not tree from difficulties, with regard, more especially, to the application of the principles to the particular case under consideration rather than with regard to the actual principles themselves. The fact that the rules which obtain both in the High Court and County Court give the Court a large discretion does not make the task of one who seeks to show in what cases and to what extent discovery will or will not be allowed more easy, as the decision in numerous cases amounts to nothing more than that, under the particular circumstances of the particular case, the Court exercised its discretion in a particular way. CODE OF CIVIL PROCEDURE, SECOND EDITION by DAS, JATINDRA KUMAR Pdf

The book, written with the author's extensive teaching experience at The West Bengal National University of Juridical Sciences, (NUJS) Kolkata and Department of Law, University of Calcutta, attempts to critically analyse Indian High Courts and Supreme Court cases on Code of Civil Procedure. It also evaluates the relationship between statutory procedural law and case law as a subject. The book's presentation of recent Supreme Court and High Court rulings is its primary attraction. These rulings have been examined, along with the critical analysis of the radical and extensive effects of the Code. This book is divided into six parts and is clear and well-structured. Part I develops theoretical foundations of the subject. Part II demonstrates certain important issues on the (i) scope of jurisdiction of civil courts to entertain disputes, (ii) principles governing res sub judice, res judicata and foreign judgment, (iii) nature of powers exercised by civil courts in matters relating to place of suing, institution of suit, transfer of cases, withdrawal and compromise of suits, (iv) necessary conditions for first hearing, interim order, trial as well as special suits, (v) scope and ambit of law relating to pleadings, appearance and non-appearance of parties, discovery, inspection, production of documents, death, marriage, insolvency of parties, judgment and decrees. Part III explores various issues on appeals, reference, review and revision. In this part an attempt has also been made to discuss different facets of law on first appeals, second appeals, appeals from orders, appeals by indigent persons and appeals to the Supreme Court.
