Reconstructing Rawls has one overarching goal: to reclaim Rawls for the Enlightenment—more specifically, the Prussian Enlightenment. Rawls’s so-called political turn in the 1980s, motivated by a newfound interest in pluralism and the accommodation of difference, has been unhealthy for autonomy-based liberalism and has led liberalism more broadly toward cultural relativism, be it in the guise of liberal multiculturalism or critiques of cosmopolitan distributive-justice theories. Robert Taylor believes that it is time to redeem A Theory of Justice’s implicit promise of a universalistic, comprehensive Kantian liberalism. Reconstructing Rawls on Kantian foundations leads to some unorthodox conclusions about justice as fairness, to be sure: for example, it yields a more civic-humanist reading of the priority of political liberty, a more Marxist reading of the priority of fair equality of opportunity, and a more ascetic or antimaterialist reading of the difference principle. It nonetheless leaves us with a theory that is still recognizably Rawlsian and reveals a previously untraveled road out of Theory—a road very different from the one Rawls himself ultimately followed.

Social Contract Theory for a Diverse World by Ryan Muldoon Pdf

Very diverse societies pose real problems for Rawlsian models of public reason. This is for two reasons: first, public reason is unable accommodate diverse perspectives in determining a regulative ideal. Second, regulative ideals are unable to respond to social change. While models based on public reason focus on the justification of principles, this book suggests that we need to orient our normative theories more toward discovery and experimentation. The book develops a unique approach to social contract theory that focuses on diverse perspectives. It offers a new moral stance that author Ryan Muldoon calls, "The View From Everywhere," which allows for substantive, fundamental moral disagreement. This stance is used to develop a bargaining model in which agents can cooperate despite seeing different perspectives. Rather than arguing for an ideal contract or particular principles of justice, Muldoon outlines a procedure for iterated revisions to the rules of a social contract. It expands Mill's conception of experiments in living to help form a foundational principle for social contract theory. By embracing this kind of experimentation, we move away from a conception of justice as an end state, and toward a conception of justice as a trajectory. The general question it tries to answer is: what is the principled basis of a free society marked by cultural diversity and group loyalties? More particularly, it explains whether such a society requires political institutions which recognize minorities; how far it should tolerate such minorities when their ways differ from those of the mainstream community; to what extent political institutions should address injustices suffered by minorities at the hands of the wider society, and also at the hands of the powerful within their own communities; what role, if any, the state should play in the shaping of a society's (national) identity; and what fundamental values should guide our reflections on these matters. Its main contention is that a free society is an open society whose fundamental principle is the principle of freedom of association. A society is free to the extent that it is prepared to tolerate in its midst associations which differ or dissent from its standards or practices. An implication of these principles is that political society is also no more than one among other associations; its basis is the willingness of its members to continue to associate under the terms which define it. While it is an 'association of associations', it is not the only such association; it does not subsume all other associations. The principles of a free society describe not a hierarchy of superior and subordinate authorities but an archipelago of competing and overlapping jurisdictions. The idea of a liberal archipelago is defended as one which supplies us with a better metaphor of the free society than do older notions such as the body politic, or the ship of state. This work presents a challenge, and an alternative, to other contemporary liberal theories of multiculturalism.
