Debtor-Creditor Law and Procedure by Laurence M. Olivo,DeeAnn Gonsalves Pdf
"This manual explains the procedures associated with debtor-creditor law taking the reader through the initial searches required to determine what assets are available for recovery through to the enforcement of judgments. This practical guide takes the reader through the drafting of statements of claim, the calculation of pre- and post-judgment interest, and specific procedures associated with both the Superior Court of Justice and Small Claims Court. The fourth edition includes changes to Superior Court of Justice rules following the Osborne report and covers the area of construction liens and bankruptcy and consumer proposals. It also addresses the concept of proportionality in the role of civil procedure. It also includes chapters on Small Claims Court proceedings, including monetary limits for claims as well as forms and procedures."--Pub. desc.

A Treatise on the Application of Payments by Debtor to Creditor by George G. Munger Pdf
Excerpt from A Treatise on the Application of Payments by Debtor to Creditor: Being a Complete Compilation of the Law Pertaining to the Rights of Debtor and Creditor Respectively; And Also Giving the Various Rules for the Guidance of the Courts When No Appropriation Has Been Made by the Parties He discovered that not only was there no separate treatise embodying the law in clear and concise form, but even that there was not any systematic and exhaustive col lection of its doctrines and rules anywhere. A chapter, of greater or less length, in some work com prising a wide range of subjects, where none received more than a general treatment; a note in some book of cases displaying more or less industry in collecting the authorities, but without much attempt at method or arrangement, and one or two magazine articles, summed up all that had been written upon the subject. For any further investigation recourse must be had to the digests or to the reports them selves. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt: ...or is about to remove any of his property out of the state, with intent to defraud his creditors; or, 4th, that he fraudulently, contracted the debt, or incurred the obligation, respecting which the suit is brought; or, 5th, that the defendant is not a resident of the state, and has not resided therein for three months immediately preceding the time of making such affidavit; or, 6th, that the defendant is a foreign corporation.' Goods and chattels are bound by an attachment from the time of serving the writ; but to create a lien upon real estate, a certified copy of the writ, with a description of the realty, must be deposited in the office of the register of deeds of the county where the same is situate. If it appears by the return of the writ that either of the defendants has been served personally, the suit proceeds as in ordinary cases; if there has been no personal service, but property of the defendant has been attached, the plaintiff' is required to publish in a newspaper of the county, or judicial circuit, for six successive weeks, a notice of the attachment, after which, upon filing an affidavit of the fact, he may file his declaration and proceed as if a copy had been served on the defendant. Where perishable property has been attached, it may be sold pending the proceedings by order of the court. Where there has been no personal service, a judgment is rendered in the ordinary form, but it is not conclusive upon the defendant, and on an execution thereupon, the officer is only authorized to sell the property attached. In cases of joint indebtedness, the Writ of attachment may issue against the separate or joint estate of such debtors, or any of them, (a) There are similar provisions authorizing and regulating attachments in...
