The invasion and occupation of Iraq rank among the most controversial and complex issues in international law in recent history. This volume of documents covers the occupation of Iraq from the planning stages of the invasion of Iraq in early 2002 to the transfer of governing authority to the Iraqi Interim Government on 28 June 2004. The book presents 595 selected documents including the first complete set of all Regulations, Orders, Memoranda and Public Notices issued by the US-led occupation administration of Iraq, the Coalition Provisional Authority (CPA), several of which were never published on the CPA`s website or promulgated in Alwaqai Aliraqiya, the Official Gazette of Iraq. Some of these legal acts have shaped the economic and political system of present day Iraq and will be part of the country`s legal order for years to come. The book also includes some 120 other CPA and CPA-related documents selected from more than 5000 unclassified CPA documents and received under freedom of information requests lodged in the United States, the United Kingdom, Australia and Switzerland. These documents include instructions and proclamations to the Iraqi people in the early stages of the occupation, organizational charts, internal legal opinions, diplomatic notes, international agreements concluded by the CPA with other States, and numerous internal memoranda for the head of the CPA, Ambassador Paul L Bremer, on legal, diplomatic and political issues. The book also presents for the first time all 235 resolutions passed by the Iraqi Governing Council (IGC) between July 2003 and June 2004. The resolutions as well as many of the 25 other important IGC documents (including various political statements, press releases and decrees of the Council`s Higher National De-Ba`athification Commission) have been translated from Arabic and are presented here for the first time in English. These documents are complemented by the relevant United Nations documents on the occupation of Iraq as well as some 50 policy documents of the United States, the United Kingdom and the Iraqi opposition movement as well as all relevant fatwas (religious rulings) of Grand Ayatollah Ali al-Sistani which shaped the internal Iraqi political process during the occupation. This collection archives these important documents for future use and makes them easily accessible to researchers and professionals. Considering that the main source of information for the occupying powers in Iraq were the precedents set during the First and Second World Wars, the occupation of Iraq will serve as a modern precedent for future administrations of occupied territory. Soon after the coalition's occupation of Iraq began in April 2003, it became evident that prewar assumptions about the security situation that would follow the ouster of Saddam Hussein had been unduly optimistic. The environment was not benign -- it was deteriorating. Iraqi security forces had largely disintegrated, and those that remained were incapable of responding to rising criminality and political violence. In this environment, the coalition confronted three security imperatives: (1) to restore order and neutralize insurgents and terrorists; (2) to rebuild Iraqi security forces, which could eventually take on responsibility for Iraq's security; and (3) to build security sector institutions, such as national security management institutions, the interior and defense ministries, and the justice sector, to ensure that the Iraqi security sector could be an effective bulwark for a democratic Iraq in the future. At the time that the Coalition Provisional Authority (CPA) handed over authority to the Iraqi Interim Government (IIG) on June 28, 2004, it was clear that the coalition had made little progress in the first task. Insurgent and terrorist violence was escalating, organized crime was flourishing, and the security situation was threatening both the political transition and the reconstruction program. The coalition's record on the second and third tasks, however, is somewhat less simply categorized. From April 2003, the coalition embarked on efforts to rapidly field Iraqi security forces and to build security sector institutions. This effort was broad in scope, but its implementation was patchy, its results were varying, and its ultimate success or failure remains difficult to determine. This report focuses on efforts to build both forces and institutions in Iraq. It provides a historical record of the coalition's experience and seeks, insofar as is possible at this early stage, to draw lessons from the successes and failures of that experience.

Assessments of the United States–led effort to create a democratically governed Iraq following the toppling of the Saddam Hussein regime in 2003 have generally been negative. However, these criticisms have, for the most part, ignored the progress Iraq made on putting in place basic public administration practices and political processes that better serve its citizens, particularly at the subnational level. This paper reviews the experience of the Local Governance Program in strengthening the capacities of subnational councils and provincial offices to develop legislation and to plan and budget for capital investments. The discussion reveals how contestation over the legal interpretations of decentralization constrained the autonomy of provincial actors, and how mastery of administrative tools and methods enabled them to maneuver more effectively within evolving provincial governance structures. This experience offers several lessons for international stabilization and reconstruction operations: constitution-making in divided societies paves over differences with ambiguities in order to reach agreement, which pushes the unresolved conflicts into political, legislative, and administrative arenas; decentralization debates are ultimately about the distribution of political power and control and cannot be addressed solely as technical and administrative governance questions; and basic public administration capacity is critical to meeting citizens’ expectations for services, security, and economic opportunity. A final observation is that international governance improvement templates can only be effective if they recognize that technical interventions must account for politics and the incentives facing local actors.

This monograph begins by examining prewar planning efforts or postwar Iraq, in order to establish what U.S. policymakers expected the postwar situation to look like and what their plans were for reconstruction.
