Employment regulation has been growing rapidly. This has not exclusively, or even mainly, come from the European Union. Recent UK governments have added such significant new measures as the National Living Wage, workplace pensions and the Apprenticeship Levy. The costs of such regulation are frequently assumed – by both advocates and opponents – to fall on business profits. This isn’t so, except in the very short run. They are instead transferred in part to consumers, but mainly to employees themselves. Mandated benefits – longer holidays or extended maternity leave – mean reduced pay growth and fewer job opportunities. Anti-discrimination laws lead to fewer openings for disadvantaged groups, while employment protection legislation worsens job prospects for the young. Excessive regulation acts as a barrier to entry, shielding incumbents and deterring the foundation of new enterprises. Attempts to restrict new types of employment in the ‘gig’ economy are counterproductive, serving ‘insiders’ at the expense of ‘outsiders’. This book combines a history of employment laws with detailed analysis of the troublesome effects of various interventions. The author argues for a fundamental rethink. Some basic labour market regulation may still be necessary, but far less than we currently have.

The Committee's report examines the current state of employment regulation in the UK, in the light of competing concerns of labour market flexibility and workers rights; as well as looking at the impact of the minimum wage; regulation of agency workers; the Working Time Directive, flexible hours and parental leave. Conclusions drawn include support for the current regulatory balance, including the national minimum wage, as well as for the principles of flexibility allied to social cohesion as set out in the Lisbon Agenda. Although there are abuses in the employment of temporary workers, the Committee remains unconvinced that the Agency Workers Directive is the right way to address these concerns, but argues that the opt-out from the Working Time Directive does not need to be retained as the Directive is sufficiently flexible to accommodate business needs. Flexible working opportunities given to parents of young children should be extended to all those with caring responsibilities.

The rights and responsibilities of employees derive from this contract of service and the various Acts of Parliament which lay down employment standards in addition to other rights and duties imposed by Common Law on the parties to the contract of employment, regarded as rights implied by Common Law. Considering that Parliament is an assembly of delegates of society, and that Common Law arise from decisions of Judges in courts and tribunals of society, a debate on whether a body of law concerned with the relationship between an employer and employee applies to society at large becomes pointless. This essay therefore focuses on the extent to which these laws provide mutual satisfaction for the employer, worker and society at large –providing for their aspirations, and addressing concerns in a manner that suits the composite parties’ interests. A comprehensive assessment of what each of the parties represents, their subsequent aspirations and concerns is thus requisite for an assessment of how far employment laws go in striking equilibrium in interests amongst employers, workers and society at large. Lee (1996: 38) defines an employer as “...a legal entity that controls and directs a worker under an expressed or implied contract of employment and pays (or is obligated to pay) him/her salary or wages in compensation”. This definition focuses on the relationship between an employing entity and a natural being, and their rights and obligations as pertains to this relationship. He further describes an employee as a natural being who contributes labour and expertise to the endeavours of an employer, and is usually hired to perform specific duties packaged into a job. The definitional boundaries of “employee” are often stretched to include or exclude a variety of arrangements for instance, there is a wide variation in opinion as to whether an agency worker can be considered an employee in an implied contract as ruled in Dacas v Brook Street Bureau (UK) Ltd , and overruled in James v London Borough of Greenwich .
