When Justice Is a Game by MaDonna Maidment Pdf

All too often the police do not get the right person. Wrongful convictions are framed as mistakes or failures of the justice system. However, many of the wrongfully convicted are from among the poor and visible minority groups. The law then becomes an ideological mask relieving us of the responsibility of engaging with the real issues that underscore wrongful convictions. MaDonna Maidment illustrates how the desire to get a conviction and paint the police and the courts in a positive light often means that false evidence and court decisions based on prejudice and racism lead to innocent people being convicted. “The official version of the law,” says Maidment, “despite its claims of impartiality, neutrality and objectivity, is a tool of the state and its elite club members designed to maintain the illegitimate domination of society.” Turning back to the very sys-tem that got it wrong in the first place therefore should be a non-starter.

Harming Future Persons by Melinda A. Roberts,David T. Wasserman Pdf

Melinda A. Roberts and David T. Wasserman 1 Purpose of this Collection What are our obligations with respect to persons who have not yet, and may not ever, come into existence? Few of us believe that we can wrong those whom we leave out of existence altogether—that is, merely possible persons. We may think as well that the directive to be “fruitful, and multiply, and replenish the earth” 1 does not hold up to close scrutiny. How can it be wrong to decline to bring ever more people into existence? At the same time, we think we are clearly ob- gated to treat future persons—persons who don’t yet but will exist—in accordance with certain stringent standards. Bringing a person into an existence that is truly awful—not worth having—can be wrong, and so can bringing a person into an existence that is worth having when we had the alternative of bringing that same person into an existence that is substantially better. We may think as well that our obligations with respect to future persons are triggered well before the point at which those persons commence their existence. We think it would be wrong, for example, to choose today to turn the Earth of the future into a miserable place even if the victims of that choice do not yet exist.

Autonomy in the Law by Mortimer Sellers Pdf

By juxtaposing European and American concepts of autonomy in the law as they are applied to families, capital punishment and criminal trials, authors reveal the common values that justify all legal systems. This book sheds new light on the fundamental purpose of law by examining how European and American lawyers, judges, and citizens actually apply and should apply legal autonomy to litigation, legislation, and the law itself.

Manufacturing Guilt (2nd edition) by Barrie Anderson,Dawn Anderson Pdf

Manufacturing Guilt, 2nd edition, updates the cases presented in the first edition and includes two new chapters: one concerning the case of James Driskell and another regarding Dr. Charles Smith, whose role in forensic pathology evidence led to several wrongful convictions. In this new edition, the authors demonstrate that the same factors at play in the criminalization of the powerless and marginalized are found in cases of wrongful conviction. Contrary to popular belief, wrongful convictions are not due simply to “unintended errors,” but rather are too often the result of the deliberate actions of those working in the criminal justice system. Using Canadian cases of miscarriages of justice, the authors argue that understanding wrongful convictions and how to prevent them is incomplete outside the broader societal context in which they occur, particularly regarding racial and social inequality.

Lessons Learned by Susan Schmerler Pdf

No one wants to be sued. A lawsuit is an assault on one’s self-image, reputation, and livelihood. It is physically, mentally, and financially draining. The purpose of this book is (1) to provide genetic counselors with varying levels of experience and expertise with heightened awareness of the sources and processes of the law as it can affect their practice; (2) to offer them strategies for minimizing the potential for their being named in a lawsuit; and (3) to provide guidance for the management of current and emerging situations. This is the first book specifically addressing genetic counseling, as opposed to general healthcare risk management.

Freedom and Fulfillment by Joel Feinberg Pdf

Dealing with a diverse set of problems in practical and theoretical ethics, these fourteen essays, three of them previously unpublished, reconfirm Joel Feinberg's leading position in the field of legal philosophy. With a clarity and humor that will be familiar to readers of his other works, Feinberg writes on topics including "wrongful life" suits in the law of torts, or whether there is any sense in the remark that a person is so badly off that he would be better off not existing at all; the morality of abortion; educational options; free expression; civil disobedience; and the duty of easy rescue in criminal law. He continues with a three-part defense of moral rights in the abstract, a discussion of voluntary euthanasia, and an inquiry into arguments of various kinds for not granting legal rights in enforcement of a person's acknowledged moral rights. This collection concludes with two essays dealing with concepts used in appraising the whole of a person's life: absurdity and self-fulfillment, and their interplay.
